Abstract

AbstrakPokok permasalahan dalam penelitian ini adalah bagaimana metode therapeutic community dalam pelaksanaan rehabilitasi bagi residen di Balai Rehabilitasi BNN Baddoka Makassar perpektif hukum Islam. Adapun tujuan penelitian ini adalah untuk mengetahui pandangan maqāṣid al-syarī’ah terhadap pelaksanaan rehabilitasi dengan metode therapeutic community di Balai Rehabilitasi BNN Baddoka Makassar.Penelitian ini merupakan penelitian lapangan (field research) yang dilakukan di Balai Rehabilitasi BNN Baddoka Makassar dan bersifat deskriptif  kualitatif, yaitu penelitian yang menganalisis serta menggambarkan penelitian secara objektif dan mendetail untuk mendapatkan hasil yang akurat.Hasil dari penelitian ini mengungkapkan bahwa pelaksanaan metode therapeutic community memberikan terapi dengan menekankan pada peraturan, privilege (hak-hak istimewa), job function (pembagian kerja), teguran, dan terapi kelompok. Sedangkan pandangan maqāṣid al-syarī’ah mengenai pelaksanaan rehabilitasi dengan metode therapeutic community memandang aspek kemaslahatan primer memberikan pengaruh signifikan bagi perubahan diri residen menjadi lebih baik .Implikasi dari penelitian ini adalah pelaksanaan rehabilitasi dengan mengkombinasikan therapeutic community dengan modalitas terapi lain dengan memperhatikan unsur agama dan budaya dalam penanaman nilai-nilai kehidupan. Hal tersebut diharapkan dapat memberikan efek yang lebih menyentuh jiwa dan mental residen. Selain itu sosialisasi tentang privilege dalam therapeutic community (terutama conjugal) perlu dilakukan agar dapat memberikan semangat bagi residen (yang masih terikat hubungan suami-istri secara hukum) untuk menjalani rehabilitasi karena kebutuhan biologisnya tetap dapat terpenuhi. Kata Kunci: Therapeutic Community, Rehabilitasi, Maqasid al-Syariah    AbstractThe objective of this research is how the therapeutic community method implemented in Rehabilitation Center of National Narcotics Board (BNN) of Baddoka Makassar in the perspective of Islamic law. The aims of this research is to reveal the view of maqasid al-syariah towards implementation of rehabilitation using therapeutic community method.This research is a field research using qualitative-descriptive method. This research reveals that the implementation of therapeutic community emphasizes on the rules, privilege, job function, reprimands/advices and group therapy. Maqasid al-syariah considers the implementation of therapeutic community method has significant influence to the residents in changing themselves to be better according to Islamic teachings.The implication of this research is the implementation of rehabilitation by combining therapeutic community with other types of therapy by paying attention to religious and cultural elements in the inculcation of live values. It is expected to have more touching effect on residents’ heart and mentality. In addition, the socialization of privilege (especially conjugal) in the therapeutic community needs to be carried out in order to encourage residents (who are still married) for rehabilitation, because their biological needs can still be met.Key Words: Therapeutic Community, Rehabilitation, Maqasid al-Syariah

Abstract

Penelitian ini bertujuan untuk mengetahui dan memahami faktor-faktor yang mempengaruhi terjadinya pernikahan sirri dan untuk mengetahui pandangan hukum Islam dan undang-undang terhadap status hukum pernikahan sirri. Penulis menggunakan pedekatan yuridis yaitu hukum sebagai norma yaitu implementasi ketentuan undang-undangan, penelitian ini tergolong library reseach, yaitu penelitian yang dilakukan di perpustakaan dan peneliti berhadapan dengan berbagai macam literatur sesuai  tujuan  dan  masalah  yang  sedang  dipertanyakan. Hasil penelitian dan pembahasan menunjukkan bahwa pernikahan sirri terjadi karena adanya faktor faktor yang menyebabkan yaitu faktor ekonomi, faktor usia, faktor ikatan dinas, faktor kurangnya pemahaman dan kesadaran tentang pencatatan pernikahan, faktor poligami, dan faktor perbuatan zina. Menurut penelitian yang telah di dapat bahwa nikah sirri adalah nikah yang dilakukan diluar pengawasan pencatatan nikah dan tidak tercatat di KUA sedangkan nikah sirri menurut hukum Islam sah atau legal di halalkan atau diperbolehkan jika syarat dan rukun nikahnya terpenuhi pada saat nikah sirri.

Abstract

This research discusses the Supreme Court's policy of increasing the knowledge of Religious Justice judges through the sharia economic judge certification program. This type of research is descriptive qualitative, a type of research to understand the phenomenon of what the research subject experiences in an exceptional natural context. The natural phenomenon referred to is how there is a relationship between PERMA Number 5 of 2016 concerning Sharia Economic Judge Certification and the Supreme Court's policy in increasing the knowledge of Religious Court judges in the field of Sharia economics, the implementation of certification activities, and the results obtained by judges after participating in the certification program, which is then given meaning. This research location focus of the researcher is the office of the Supreme Court of the Republic of Indonesia, which is domiciled in the Special Capital Region (DKI) Jakarta and Bogor Regency, West Java Province. With a methodological approach, namely case studies, normative approaches, human resources (HR), and sharia economic law approaches—data collection techniques with observation, interviews, and documentation. In addition, this research also uses library research through primary and secondary data—the technique of in-depth data analysis by reducing data, presenting data, and drawing conclusions. The results showed that the Religious Court, the Supreme Court, had done so much that it issued several regulations to support this authority. One of the policies produced was the issuance of Supreme Court Regulation (PERMA) Number 5 of 2016 concerning the Certification of Sharia Economic Judges. With the PERMA issuance, many Religious Court judges have been certified in Sharia Economics after participating in the Sharia Economic Judge Certification Training.

Abstract

The main problem in this research is how the marriage of pregnant women with men who are not pregnant in Uraso Village, Kec. Mapdeceng, Kab. North Luwu According to Imam Malik and Shafi'i. The main problems that will be described from the sub-problems are: 1) What are the views of the people of Uroso Village, Kec. Mapdeceng, Kab. North Luwu regarding the marriage of a pregnant woman with a man who did not impregnate her? 2) What is the opinion of Imam Malik and Syafi'i on the marriage of a pregnant woman with a man who did not impregnate her in Uroso Village, Kec. Mapdeceng, Kab. North Luwu?. The type of research used is qualitative research or field research which describes the phenomena that occur in society and aims to produce descriptive data in the form of data, images and behavior of the people observed using a syar'i normative approach sourced from the arguments of the Qur'an, the hadith of the Prophet as well as the ijtihad of the Ulama and the sociological approach. The data sources in this research are sourced from primary data and secondary data. The results of this study indicate that: 1) Regarding the views from interviews with several community and religious leaders, they have different opinions regarding this phenomenon. 2) The scholars agree on the permissibility of marrying adulterers for those who commit adultery. Thus, the marriage of a pregnant woman with a man who impregnates her or commits adultery is legal and they may have intercourse as husband and wife. Meanwhile, the views of Imam Malik and Shafi'i regarding the marriage of a pregnant woman with a man who did not impregnate her have different opinions. Imam Malik is of the opinion that the marriage is invalid. This is because women who have sexual intercourse with adultery have exactly the same legal status as women who have sexual intercourse with syubhat. The woman must purify herself at the same time as the 'iddah of the woman whose husband divorced her, except when had (punishment) is required. Meanwhile, Imam Shafi'i allowed the marriage of a pregnant woman to a man who did not impregnate her.
