Abstract

Intern training program outside Indonesia region as a form of manpower development has significant role to overcome the high unemployment rate in Indonesia. In its implementation, the problem occurs wgen the participant of intern training program run away from the program or used to be called as illegal intern trainee. This paper aims to know and understand the existence of illegal intern trainee including the impacts, as well as legal actions that can be taken by Indonesia government to overcome the problems. This study is based on normative juridical approach with primary and secondary data sources. The study shows that the existence of illegal intern trainee that violate Indonesia’s and accepting country’s regulations causes loss of rights of the participant as intern trainee. As a consequence, ocupational safety facilities, and insurance assistance in the case of work accident, illness, nor mortality can not be accomodated, nonetheless assistance can still be given in the context of the illegal intern trainee status as Indonesian citizen. The Ministry of Manpower of the Republic of Indonesia can take preventif actions in the form of supervision and development and represive legal action by temporary revocate the sending organization’s license. In the other hand, the Ministry of Foreign Affairs of the Republic of Indonesia can take represive legal actions in the form of legal assistance, aid, including return assistance.How to Cite Item: Zulfakanti, B., Karsona, A., Singadimedja, H. Abstract

ABSTRAK Jaminan Pensiun bertujuan untuk mempertahankan derajat kehidupan yang layak bagi pekerja dan ahli warisnya dengan memberikan penghasilan setelah peserta memasuki usia pensiun, mengalami cacat total tetap, atau meninggal dunia. Jaminan Pensiun sebagai Bentuk perlindungan tenaga kerja di Indonesia yang wajib di laksanakan oleh setiap pemberi kerja atau pengusaha. Penelitian ini bertujuan untuk memperoleh pemahaman tentang Pelaksanaan Jaminan Pensiun Bagi Pekerja Kontrak dan memperoleh pemahaman tentang Tanggung Jawab Pengusaha terhadap Jaminan Pensiun Bagi Pekerja Kontrak untuk Meningkatkan Kesejahteraan Pekerja Kontrak Ketika Memasuki Usia Pensiun. Penelitian menggunakan metode penelitian deskriptif analitis yang menggambarkan fakta-fakta berupa data sekunder yang terdiri dari bahan dasar hukum primer (perundang-undangan), bahan hukum sekunder dengan pendekatan yuridis normatif, yaitu metode yang menggunakan sumber-sumber data sekunder, yaitu peraturan perundang-undangan, teori-teori hukum dan pendapat-pendapat para sarjana, yang kemudian dianalisis. Hasil penelitian menunjukkan bahwa pelaksanaan jaminan pensiun belum terlaksana sepenuhnya, pemberi kerja merasa sanksi hukum jaminan sosial tidak mengikat, aturan hukum yang lemah, dan kurangnya peran dari Pemerintah. Indonesia menganut paham Negara kesejahteraan belum mencerminkan sebagai Negara Kesejahteraan sehingga perlu ada perbaikan dan penegakan Hukum Sistem Jaminan Sosial Nasional di Indonesia. Kata kunci: negara kesejahteraan; pekerja kontrak; pelaksanaan jaminan pensiun. ABSTRACT Pension insurance to maintain a decent degree of life for workers and their heirs by giving participants after participation, increasing the total, permanent or world number. Pension insurance as a form of labor in Indonesia that must be carried out by every employer or employer. This study gained an understanding of the implementation of Pension Contracts for Contract Workers and gained an understanding of the Responsibilities of Employers to Workers 'Contract Pension Insurance to Improve Contract Workers' Welfare Entering Retirement Age. This research uses descriptive analytical research method that discusses facts consisting of secondary data consisting of legal basis material (legislation), secondary legal material and this research uses a normative juridical approach, namely a method that uses secondary data sources, namely legislation, legal theories and opinions of scholars, which are then analyzed. The results of this study indicate that the implementation of the Guarantee is not fully protected, the employer who is guaranteed the law Providing social security, weak legal ties, and reducing the role of the Government. Indonesia adheres to the notion of a welfare state that does not reflect the State of Welfare there must be improvement and enforcement of the Law on National Social Security Systems in Indonesia. Abstract

This study aims to find out and analyze the government's actions towards companies that do not prioritize local workers as an effort to provide job opportunities for local workers in West Bandung Regency. This type of research uses a normative juridical approach with qualitative juridical analysis. The research location is at the West Bandung District Employment Service. Types and sources of data in research consists of two types, primary data and secondary data. Data collection techniques are by observation techniques, interviews, and literature study. Qualitative data analysis techniques. The results of the study show that West Bandung Regency has indeed regulated the company's obligation to prioritize local workers in filling job vacancies in order to provide job opportunities for local workers in West Bandung Regency, but these arrangements have not been able to be implemented optimally. This is caused by several things, including the limited ability of existing local workers, the large role of companies in the West Bandung Regency area, as well as policies regarding companies that are required to prioritize local workers are not accompanied by a comparison of the use of local workers and sanctions if the policy is not implemented.
