Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor sosial ekonomi dan instabilitas harga terhadap respon penawaran kopi arabika organic. Faktor- faktor social ekonomi terdiri dari modal, pendapatan bersih, tingkat pendidikan, pengalaman dan usia Hasil penelitian menunjukkan bahwa faktor modal, pendapatan bersih dan tingkat pendidikan secara parsial mempunyai pengaruh yang signifikan terhadap respon penawaran kopi arabika organik, tetapi umur dan pengalaman petani tidak berpengaruh, secara bersama-sama kelima faktor sosial ekonomi mempunyai pengaruh yang signifikan terhadap respon penawaran. Instabilitas harga dan R/C ratio mempunyai pengaruh yang signifikan terhadap  respon penawaran.

Abstract

This state is basically recognized as a rich state, either in term of ecological side or in term of cultural potency and ideological varieties, as the inheritance of motherland. However, this is so sad when we ironically saw a bunch of tragedies which are tragically occurred, start from tsunami, and other issues such as the scandal of century that seems to be unsolved! Moreover, nowadays, the environmental problem has occurred and reached its highest culmination point. The environmental destruction and pollution process have uncontrollably happened. Noting so many catastrophes happened anywhere in this state; such as floods, landslides, earthquakes, lapindo mud tragedy, roads vanishing, illegal logging, forest function shift, and many others, is so an ironic thing. These all catastrophes become such a sign  of  inharmonic  relationship exist between the state, human and the environment. Then, should we always blame these disaster s for the governments’ fault that, in such this multidimensional crises and demoralization that full of utopia and ironical images, seems to be unaware of their main position? The law is neutered and naked from its constitutional essence. This terrible condition can be impossibly happened when our representatives in the government are loyally take taken a side of the important of their party through the political campaign appointments which seem to face stagnation in its implementation and not loyal to the true mandator. Perceiving this such phenomenon, we need not only a kind of law penetratin that progressifely and integratifally can become an elegant problem solving for achieving of the aims of ongoing developmnet that  can fully protect the importance of the environment and human life intentions but a moral forces and people power that should be continuallly implemented. Hence, the urgency of law management, ecological tutorial awaraness and the success of environmetal living management in term of national law development, becomes a final destination of this writting. Moreover , this writing is a kcorrection of the unclear control and maintenanceof the law of environmental   administration.

Abstract

The emergence of political  and  constitutional  law  discourses,  side by side with the growth of democracy in Indonesia, is developing progressively and dynamically. In reality, this nation  is  under  great tests which determine whether the state is still holding its constitutional commitment on upholding the rule of law.  In the other side, the face of  law enforcement in this state is under an immense storm of urgent issues that need immediate solution which is: can this state provide “justice” unto all of its citizens? This issue is a huge homework for all the nation’s elements in the  future.The establishment of the Constitutional  Court  which  regulated  in the 1945 Constitution surely related to the constitutional reformation which deemed as a necessity and an important agenda that should be applied fundamentally. The existence of the Constitutional Court in the constitutional system of the Republic of Indonesia simultaneously casting new hopes for any justice-seekers. The surfacing question now is will the Constitutional Court capable in faithfully guarding the democracy  and fair constitutionality in the verge of society that has already loose confidence towards justice institution? This simple and short writing attempts to study and discuss on constitutional question, including   on how its political reality and its legal implementation in Indonesia,    and also a slight hope of this writing in enriching the references for any justice-lovers in this  nation.

Abstract

Abstract :The Covid-19 pandemic has slowed the pace of economic growth in Indonesia. As a result, several business sectors in the community experienced a decline, so the state issued a legal policy to take steps to resolve it. Legal politics as a form of government policy in an effort to restore the national economy is a necessity. This article uses a type of normative juridical research method, with a statutory and conceptual approach, legal materials (primary, secondary, tertiary) are analyzed using the content analysis method. This article shows and emphasizes the urgency of the government's legal politics in efforts to recover the national economy due to the Covid-19 pandemic. In the process of its formation, it certainly requires a comprehensive, integrated and targeted policy set. The 1945 Constitution Article 22 paragraphs (1-3) provides space for the government to stipulate Perpu No. 1 of 2020 becomes Law No. 2 of 2020 as a legal umbrella in an effort to maintain the resilience of all elements of the nation from all threats that endanger the safety of the people of the nation and state. The role of the government's legal policy in national economic recovery has a central position in anticipating a fragile "system" and management. The national economic recovery policy cannot be separated from the legal politics policy itself, of course by taking into account the principles of prudence, good faith and full integrity and remains based on the principles of good governance, accountability, and transparency.Keyword: Legal Politics, Economic Recovery, Covid-19, Economic Constitution.Abstrak :Pandemi Covid-19 memperlambat laju pertumbuhan ekonomi di Indonesia. Akibatnya beberapa sektor usaha bisnis di masyarakat mengalami penurunan, sehingga negara mengeluarkan kebijakan hukum untuk mengambil langkah penyelesaian. Politik hukum sebagai bentuk kebijakan pemerintah dalam upaya pemulihan ekonomi nasional menjadi keniscayaan. Artikel ini menggunakan jenis metode penelitian yuridis normatif, dengan pendekatan perundang-undangan dan konseptual, bahan hukum (primer, sekunder, tersier) dianalisis menggunakan metode content analysis. Artikel ini menunjukan dan menekankan urgensi politik hukum pemerintah dalam upaya pemulihan ekonomi nasional akibat pandemi Covid-19. Dalam proses pembentukannya tentu membutuhkan perangkat kebijakan yang komprehensif, terintegrasi dan tepat sasaran. Konstitusi UUD 1945 Pasal 22 ayat (1-3) memberikan ruang bagi pemerintah menetapkan Perpu No. 1 Tahun 2020 menjadi UU No. 2 Tahun 2020 sebagai payung hukum dalam upaya dan menjaga ketahanan seluruh elemen bangsa dari segala ancaman yang membahayakan keselamatan masyarakat bangsa dan negara. Peran kebijakan hukum pemerintah dalam pemulihan ekonomi nasional, memiliki kedudukan sentral guna mengantisipasi “sistem” dan manajeman yang rapuh.
