Abstract

Artikel ini menganalisis pelaksanaan kebijakan resettlement bagi masyarakat korban bencana alam tsunami di Lampung Selatan yang terjadi pada Desember 2018 lalu. Dengan menggunakan pendekatan peraturan perundang-undangan dan konseptual, hasil penelitian menunjukkan bahwa menurut UU Penanggulangan Bencana dinyatakan bahwa penyelenggaraan penanggulangan bencana meliputi empat tahapan yaitu: penetapan kebijakan pembangunan yang berisiko timbulnya bencana, kegiatan pencegahan bencana, tanggap darurat, dan rehabilitasi. Dua tahapan di awal dibuat sebelum adanya bencana (prabencana), tanggap darurat dilakukan saat terjadinya bencana, dan rehabilitasi dilakukan pascabencana. Dalam konteks bencana tsunami di Lampung Selatan pada 2018 silam, salah satu kebijakan pascabencana yang dilakukan adalah resettlement. Kebijakan ini dilakukan berdasarkan Keputusan Bupati No. B/613.1/VI.02/HK/2019. Dalam keputusan tersebut ditentukan bahwa kebijakan resettlement ini dilakukan pada 4 kecamatan yang telah ditentukan yakni Kecamatan Rajabasa, Kecamatan Kalianda, Kecamatan Sidomulyo dan Kecamatan Katibung. Pada pelaksanaannya, kebijakan ini berdampak pada beberapa aspek kehidupan masyarakat yang dipindahkan, seperti dalam aspek sosial dan ekonomi.

Abstract

The enactment of Law No. 15 of 2016 which regulates seafarers results in the adoption of the convention in Indonesia. The adoption of the MLC by the ILO was carried out with the aim of protecting seafarers and the shipping industry. The problem is, Indonesia actually has a regulation on Maritime Affairs, namely in Government Regulation Number 7 of 2000. Then, in terms of whether the State of Indonesia then feels the need to participate in ratifying the MLC. This then attracts the authors to examine the related arrangements regarding seafarers contained in MLC convention. Therefore, the formulation of the problem in this study is how is the regulation about Seafarers in the Maritime Labor Convention, 2006?The problem approach used in this study is the statute approach. This study uses secondary data consisting of primary, secondary, and tertiary legal materials. Data analysis was carried out qualitatively. The results of the study show that the framework of the Maritime Labor Convention or MLC is composed of three parts, namely Articles, Regulation and Codes. The arrangements for seafarers in the MLC consist of six parts, namely: seafarers’ rights; minimum requirements to work for seafarers; working conditions; accommodation, recreational facilities, food and catering; health protection, medical care, welfare and social security; compliance and enforcement.

Abstract

The birth of village autonomy has made the village more independent in taking care of the household in the village. With the promulgation of Law Number 6 of 2014 concerning Villages, the Domestic Metric Regulation Number 20 of 2018 concerning Village Financial Management makes village governments have their own autonomous bodies to manage village finances. Roles and responsibilities received by villages have not been matched with adequate Human Resources (HR) in terms of both quantity and quality. Even though the funds owned by a village are very large, but if they are not properly regulated in their planning and users, it will result in these funds being wasted or unable to provide maximum results in the use of these village funds. At present Indonesia Corruption Watch (ICW) many Village Officers, especially the Village Head, are affected by Hand Tagging Operations (OTT) by the Corruption Eradication Commission (KPK). The problem that will be discussed in this study is how the legal problems in the preparation of the Village Budget (APBDes) for village development and what are the inhibiting factors in implementing the APBDes preparation. The method used is normative legal research and empirical legal research. The results showed that, the legal problems in the preparation of APBDes went through 3 (three) stages, namely the preparation, evaluation and determination stages. However, in the preparation stage of the APBDes preparation process, it did not directly involve the community as stipulated in the legislation related to village financial management. the inhibiting factors of the Village apparatus and Village Association Institutions lack understanding of the Village Law and its implementing regulations, weak planning ability.
