Abstract

Keluarnya UU No. 3 Tahun 2006 tentang perubahan atas Undang-undang No. 7 Tahun 1989, menegaskan secara eksplisit bahwa masalah ekonomi syariah telah menjadi kompetensi absolut peradilan agama. Oleh sebab itu, kewajiban Hakim adalah menggali hukum terhadap hukum yang tidak tertulis untuk memutus berdasarkan hukum sebagai orang yang bijaksana dan bertanggung jawab penuh kepada Tuhan Yang Maha Esa, diri sendiri, masyarkat, Bangsa dan Negara. Pokok pembahasan ini adalah sengketa ekonomi syariah, pada usaha koperasi syariah BMT dalam bentuk “Simpanan Penjamin Kebutuhan Keluarga (Si Penjaga)” dengan akad mudharobah mutlaqah (pembiayaan untuk jenis usaha yang tidak ditentukan). Pendekatan yang diterapkan dalam penelitian ini adalah deskriptif kualitatif dan normatif. Hasil dari penelitian, bahwa dalam kasus penyelesaian sengketa, Hakim Pengadilan Tinggi Agama berbeda dengan Hakim Pengadilan Agama Tingkat Pertama dalam mamahami Pasal 2 ayat (3) PERMA No. 1 Tahun 2008. Yang menjadi pedoman Hakim Pengadilan Tinggi Agama adalah fatwa Dewan Syariah Nasional (DSN) NO: 07/DSN-MUI/IV/2000.Kata Kunci: Penafsiran, Hakim, dan Sengketa Ekonomi Syariah.

Abstract

Jarȋmah ta'zȋr are criminal acts that have not been determined by the legal sanctions Personality ', but a stipulation submitted to the judge / government (ulil amri). The intent and purpose of punishment ta'zir is to educate the offender to be a deterrent. Ta'zir bil mȃl is one part of jarȋmah ta'zȋr form of punishment, ie the punishment imposed by the judge / government (ulil amri) against perpetrators jarȋmah (criminal offense), by taking the wealth jarȋmah actors. Although the intent and purpose of the enactment of this sentence is to educate the offender. but it is becoming a dilemma for property taken was not known clearly and definitely on the utilization and usage. This raises a very sharp differences among scholars about whether authorized or imposed such a punishment is motivated ini.Penelitian the discrepancy between theory and practice concepts that occur, and to describe the views of legal scholars ta'zȋr bil mȃl to determine the underlying reasons. This research is a library (library research) that is descriptive qualitative. Collecting data in this study using techniques of documentation. The technique of analysis in this study is qualitative using deductive reasoning. The results showed that the law ta'zȋr bil mȃl by scholars there are differences of opinion are allowed, with a record of property taken was not meant to be privately owned by the judges / government itself, but the treasure was returned to its owner after he promised not reiterates does (repent), and prohibits (absolutely not allowed) to punish the offenders took possessions jarȋmah (ta'zir bil mȃl), because it is not permissible for someone taking someone else's property without legal cause is based, it is an unjust act or false. For the judge / government returned to the intention respectively. Because the intent and purpose of the penalty is intended to educate and deter perpetrators jarȋmah (criminal act) in order not to repeat back in his actions, not menzaliminya.

Abstract

This research examines the facts of injustice against the divorcee died in the customary law of Lampung Lampung Pepadun Marga Anak Represents the Middle Lampung. The fact of the injustice done to the women starting from the existence of a pattern of relations of power that lame between men with women. Justification authorities it can be born is backed by the social perception of perception in the form of the myths of superiority a man trusted by the community. This research method is the type of field research, which are sociological qualitative analysis method with ethnographic. The primary data source is the custom of Lampung Pepadun, religious figures, as well as widows divorcees to death. The purpose of this research is to know the rights and obligations of the divorcee died in the customary law of Lampung Lampung Pepadun Marga Anak Represents the Middle Lampung in the perspective of Gender. Research results themselves that the provisions of the law on the rights and obligations of the divorcee died in the customary law of Lampung Lampung Pepadun Marga Anak Represents the middle of conflicting and inconsistent with the principles of fairness and gender equality

Abstract

Abstract PBI Number: 7/46/PBI/2005 explained that in murābaḥah financing, if the bank represented the customer to purchase goods, then murābaḥah contract must be made after the goods became the bank's property. Meanwhile, BSI KCP Sukoharjo Kartasura carried out a murābaḥah contract before the goods became the bank's property. This was not in accordance with the PBI and it couldbe said that there was engineering in financing implementation. This study aimed to analyze the mechanism of murābaḥah financing at BSI KCP Sukoharjo Kartasura based on PBI Number: 7/46/PBI/2005 and analyze causative factors of engineering in financing. This study used qualitative field research and the Miles and Huberman method, with data collection techniques were interview with related parties and documentation. This studyconcluded that the murābaḥah financing mechanism in BSI KCP Sukoharjo Kartasura consists of filling out forms, BI checking, surveys, etc. The financing mechanism was generally appropriate. However, in its implementation, not all provisions have been carried out properly. BSI KCP Sukoharjo Kartasura carried out a murābaḥah contract before the goods became the bank's property. Then, it could be said that there was engineering in the financing implementation. The causative factors were the bank wanted to save time, minimize expenses, etc. Keywords: Financing; Mechanism; Murābaḥah; PBI.   Abstrak PBI Nomor: 7/46/PBI/2005 menjelaskan bahwa dalam hal pembiayaan murābaḥah, apabila bank mewakilkan kepada nasabah untuk membeli barang, maka akad murābaḥah harus dilakukan setelah barang menjadi milik bank. Sedangkan BSI KCP Sukoharjo Kartasura melaksanakan akad murābaḥah sebelum barang menjadi milik bank. Hal ini tidak sesuai dengan PBI dan dapat dikatakan bahwasannya terdapat rekayasa dalam pelaksanaan pembiayaan tersebut. Penelitian ini bertujuan menganalisis mekanisme pembiayaan murābaḥah di BSI KCP Sukoharjo Kartasura berdasarkan PBI Nomor: 7/46/PBI/2005 dan menganalisis faktor penyebab terjadinya rekayasa dalam pembiayaan tersebut. Jenis penelitian ini menggunakan penelitian kualitatif lapangan serta metode Miles dan Huberman, dengan teknik pengumpulan data berupa wawancara pihak terkait dan dokumentasi. Hasil penelitian ini menyimpulkan bahwa mekanisme pembiayaan murābaḥah di BSI KCP Sukoharjo Kartasura terdiri dari pengisian form, BI checking, survei, dan lain sebagainya. Menurut PBI Nomor: 7/46/PBI/2005, secara umum mekanisme tersebut sudah sesuai. Namun, dalam implementasinya belum semua ketentuan sudah dijalankan sebagaimana mestinya. BSI KCP Sukoharjo Kartasura melaksanakan akad murābaḥah sebelum barang menjadi milik bank. Maka, hal ini dapat dikatakan bahwasannya terdapat rekayasa dalam pelaksanaan pembiayaan tersebut. Faktor penyebabnya yakni karena pihak bank sebisa mungkin ingin menghemat waktu, meminimalisir pengeluaran, dan lain sebagainya. Kata Kunci: Mekanisme; Murābaḥah; PBI; Pembiayaan.

Abstract

Tujuan dari penelitian ini adalah untuk memperoleh informasi tentang: 1) manajemen berbasis masyarakat dalam pengelolaan PAUD di Pos PAUD Wijaya Kusuma Yogyakarta; 2) keterlibatan masyarakat dalam pengelolaannya; serta 3) strategi pengelola lembaga dalam mengatasi hambatan pengelolaannya. Metodologi penelitian yang digunakan adalah penelitian kualitatif. Adapun teknik pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi. Sementara uji keabsahan data dilakukan dengan model analisis Miles & Huberman melalui proses reduksi data, display data, dan pembuatan konklusi. Hasil penelitian menunjukkan bahwa: 1) manajemen Pos PAUD Wijaya Kusuma Yogyakarta berada di tangan masyarakat melalui Pokja II (Kelompok Kerja) PKK RW 6 Tegalrejo Yogyakarta;  2) pos PAUD Wijaya Kusuma termasuk lembaga PAUD HI (Holistik Integratif) yang dalam pelaksanaan program pendidikannya menjalin kemitraan dengan Posyandu, Bina Keluarga Balita (BKB), dan Puskesmas; 3) upaya yang dilakukan pengelola dalam mengatasi berbagai hambatan pengelolaan Pos PAUD diantaranya: 1) terkait manajemen sumber daya manusia, pengelola Pos PAUD Wijaya Kusuma mengikutsertakan para pendidiknya secara berkala dalam diklat-diklat PAUD; 2) terkait manajemen keuangan, pengelola Pos PAUD Wijaya Kusuma menghimpun dana operasional lembaga melalui penarikan SPP, serta dengan mengakses berbagai bantuan dana dari pemerintah pusat, daerah, maupun desa; 3) terkait manajemen sarana prasarana, perawatan dan pengadaan sarana prasarana penunjang kegiatan pembelajaran dilakukan secara terprogram untuk mendukung pelaksanaan pembelajaran; 4) evaluasi lembaga dan program PAUD maupun pembinaan lembaga dilakukan melalui koordinasi intensif dengan penilik PAUD dari Dinas Pendidikan Kota Yogyakarta. The purpose of this study was to obtain information about: 1) community-based management in PAUD management at the Wijaya Kusuma PAUD Post Yogyakarta; 2) community involvement in its management; and 3) strategies of institutional managers in overcoming obstacles to their management. The research methodology used is qualitative research. The data collection techniques were carried out through observation, interviews and documentation. Meanwhile, the data validity test was carried out using the Miles & Huberman analysis model through the process of data reduction, data display, and making conclusions. The results showed that: 1) the management of the Wijaya Kusuma PAUD Yogyakarta Post was in the hands of the community through the Pokja II (Working Group) PKK RW 6 Tegalrejo Yogyakarta; 2) Wijaya Kusuma PAUD Post is an HI (Holistic Integrative) PAUD institution which in implementing its educational program establishes partnerships with Posyandu, Toddler Family Development (BKB), and Puskesmas; 3) efforts made by the manager in overcoming various barriers to the management of PAUD Posts include: 1) regarding human resource management, the manager of the PAUD Wijaya Kusuma Post regularly includes educators in PAUD trainings; 2) regarding financial management, the manager of the Wijaya Kusuma PAUD Post collects operational funds for the institution through the withdrawal of SPP, as well as by accessing various funding assistance from the central, regional, and village governments; 3) regarding the management of infrastructure facilities, maintenance and procurement of infrastructure facilities to support learning activities are carried out programmatically to support the implementation of learning; 4) evaluation of PAUD institutions and programs as well as institutional development is carried out through intensive coordination with PAUD inspectors from the Yogyakarta City Education Office.
