Abstract

The concept taabbudirelating to matters of worship ma?dah, and taaqqulirelating to the affairs and worship gairu ma?dah. Taabbudiabsolute, static, and its existence is not based on mere outward benefit, while taaqquliis relative, not static, and its existence is based on the benefit to humans so it is rational. However, in each taaqqulidefinitely embodied the values of worship. Instead, at each contained taabbudialso for human benefit. Both of these concepts have great contribution in the development of Islamic law.

Abstract

Meskipun pemerintah telah memberlakukan Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga, namun kekerasan dalam rumah tangga tetap terjadi dalam masyarakat. Karena itu dibutuhkan keterlibatan masyarakat. Dalam kaitan ini masyarakat muslim kecamatan Salahutu, Leihitu dan Leihitu Barat kabupaten Maluku Tengah memiliki solusi tersendiri dalam penanggulangan kekerasan dalam rumah tangga dimaksud melalui pendayagunaan kearifan lokal, yang disebut saudara kawin. Saudara kawin mampu mengatasi problem rumah tangga saudari kawinnya termasuk mencegah suami melakukan kekerasan kepada istrinya. Sehingga tidak dibutuhkan upaya penanggulangan KDRT pada tahap represif oleh penegak hukum

Abstract

The occurrence of domestic violence is considered had bad influence, either directly or indirectly to various acts of violence in the community, either fighting between the learner/student, motorcycle gang and between villages/areas as well as gangsterism in the community. It shows that domestic violence most affect the children's educational character. As the children learn and imitate and acquire knowledge of the use of violence at solving the problems. The children can learn and imitate from the violence acts committed by father to their mother, and peers, teachers/lecturers against him. To minimize the adverse effects of domestic violence, according to Islam is needed a solution through the children character education in three ways, namely: (1) choosing a husband/wife who has a good religiosity, (2) prevent children from the domestic violence atmosphere, especially when both parents are quarreled, and (3) provide the exemplary in doing good to the children from early age by combining the knowledge aspect of goodness, feel, and love the goodness and action (practice the goodness) so that children have good character, and did not wish doing violence to someone else.

Abstract

Ka’Ombo merupakan suatu prosesi upacara peralihan status individu (wanita) dari status gadis remaja kabuabua atau juga disebut perempuan yang sudah baliq, prosesi ritual Ka’ombo dilaksanakan selama empat hari empat malam dan selain itu dibutuhkan kesiapan finansial, fisik maupun mental, kemudian para gadis dibekali dengan nilai-nilai keagamaan. Ritual Ka’ombo juga merupakan suatu sistem penanaman nilai moral dan budi pekerti yang baik bagi seorang gadis yang sudah memasuki usia remaja yang harus menjadi pembiasaan diri hingga akan menuju kehidupan berumah tangga, alasan pemilihan gadis-gadis remaja sebagai peserta ritual Ka’ombo dikarenakan kebiasaan perempuan untuk menunggu untuk dilamar sehingga ritual Ka’ombo menandakan kebolehan seorang gadis dilamar karena telah menginjak usia dewasa. Ritual Ka’ombo merupakan ritual pra Islam yang kemudian diinterpretasikan dalam nilai-nilai keislaman yang terus dilestarikan dan telah menjadi kebiasaan masyarakat Buton Tengah yang kemudian terus berlangsung dan relevan dengan Hukum Islam.

Abstract

This paper examines issues of domestic violence in the perception of Islamic religious leaders on the island of Ambon. The problems in this paper are how the forms, perpetrators, and victims of domestic violence, which are dominant in society. Data were collected through interviews, and analyzed qualitatively descriptively. The result of the research shows that according to the perception of Islamic religious figure on the island of Ambon, the dominant form of domestic violence in society is physical violence which is often done by husband, or psychic violence done by wife to husband. Domestic violence perpetrators dominated by husbands or parents. While the vulnerable to become victims of domestic violence is the wife and children. It is relevant to the theory of power relations, nature theory, nurture theory and patriarchal ideology that is still dominant in society.

Abstract

Blood transfusion is closely related to the function of human caliphate on the earth at building harmonious relations and benefit for the humanity among fellow, without being limited by differences in belief (religion) between the donor and the recipient. Therefore, blood donor between people of different faiths in the Islamic law perspective is allowed. Similarly the financing at Blood Donor Unit at PMI for the benefit of blood transfusion, is not identical with commercialization (purchase) of blood, so it is allowed in the Islamic law. In addition, blood donors did not lead to the legal consequence in form of the forbidden status of the donor and recipient
