Abstract

Menurut catatan UNICEF, pada tahun 2000 ada 11.344 anak yang disangka sebagai pelaku tindak pidana, sedangkan pada bulan Januari-Mei 2002 ditemukan 4.325 tahanan anak di rumah tahanan dan lembaga pemasyarakatan di seluruh Indonesia dan lebih menyedihkan lagi, sebagian besar (84,2%). Melihat kuantitas anakyang melakukan tindak pidanatersebut, maka sudah seharusnya proses acara pidananya mempertimbangkan aspek kepentingan terbaik untuk anak seperti perlindungan akan hak-haknya. Oeh karena itu penulis mencoba menelitinya dalamlingkup Kota Semarang.  Penelitian ini bertujuan untuk mengetahui secara jelas proses jalannya perkara pidana terhadap anak nakal (Juvenile Delinquency) sesuai hukum acara pidana di wilayah hukum Kota Semarang, (mengetahui perlindungan hukum terhadap anak nakal (Juvenile Delinquency) dalam hukum acara pidana di wilayah hukum Kota Semarang. Hasil penelitian menunjukkan bahwa pelaksanaan proses acara pidana terhadap anak nakal yang terjadi di wilayah hukum Kota Semarang telah sesuai dan merujuk pada KUHAP Jo. Undang-Undang Nomor 3 Tahun 1997 Tentang Pengadilan Anak. Proses ini berawal dari adanya laporan kemudian perkara di bawa ke Polwiltabes Semarang dan ditangani oleh penyelidik, penyidik pada RPK Polwiltabes Semarang. Setelah proses penyidikan, perkara dilimpahkan ke Kejaksaan Negeri Semarang, kemudian perkara dilimpahkan ke Pengadilan Negeri Semarang untuk di sidangkan oleh hakim anak. Dalam setiap tahapan aparat penegak hukum selalu meminta pendapat pembimbing kemasyarakatan pada BAPAS Semarang untuk mengetahui keadaan anak yang sebenarnya. Perlindungan hukum terhadap anak nakal (Juvenile Delinquency) dalam proses acara pidana di wilayah hukum Kota Semarang telah dilakukan semaksimal mungkin sesuai Undang-Undang Nomor 3 Tahun 1997.  Children are human small and relatively clean, but many of them are dealing with the law. This study aims to have a clear process of criminal litigation against juvenile delinquents (juvenile delinquency) according to the law of criminal procedure in Semarang city jurisdiction, to determine the legal protection of juvenile delinquents (juvenile delinquency) in criminal law in the jurisdiction of the city of Semarang. The result showed that the implementation of the criminal proceedings against juveniles who occurred in the jurisdiction of the city of Semarang was appropriate and Jo refers to the Criminal Procedure Code. Legal protection of juvenile delinquents (juvenile delinquency) in criminal proceedings in the jurisdiction of the city of Semarang has done as much as possible according to Law No. 3 of 1997.

Abstract

Persoalan hukum yang semakin hari menunjukkan ketimpangan dan ketidakadilan merupakan cerminan penegakan hukum yang jauh dari tujuan hukum itu sendiri. Hukum yang seharusnya dimaknai sebagai jalan memperleh keadilan, kenyataannya hanya mengutamakan kepastian. Gerbang terakhir putusan hukum ada pada hakim sebagai pemegang otoritas terakhir keadilan dalam sistem peradilan pidana indonesia, di tangan hakimlah hukum dapat dikatakan adil dan tidak adil. Besarnya tanggungjawab hakim tidak diimbangi dengan sumber daya hakim itu sendiri, sehingga putusan seringkali tidak adil versi masyarakat. Salah satu yang menjadi sorotan masyarakat adalah hakim pengadilan tindak pidana korupsi. Keadilan yang diharapkan masyarakat dalam perkara tindak pidana korupsi sebenarnya akan terjawab jika hakim tidak hanya melulu menjadi corong undang-undang (la bouche de la loi) akan tetapi juga menggali hukum dalam masyarakat (living law).Permasalahan yang diangkat dalam artikel ilmiah hasil penelitian ini adalah sebagai berikut: (1) bagaimana landasan yuridis-filosofis tentang penggalian hukum yang hidup di masyarakat (living law) dalam pengambilan keputusan?; dan (2) bagaimana penggalian hukum yang hidup di masyarakat (living law) dalam memutus perkara di Pengadilan Tindak Pidana Korupsi (Tipikor) Semarang?Pengalian hukum yang hidup di masyarakat identik dengan istilah konservasi hukum. Hasil penelitian menunjukkan bahwa hakim Pengadilan Tipikor Semarang selalu melakukan upaya konservasi hukum yang hidup dalam setiap mengambil keputusan. Akan tetapi dikarenakan hakim juga harus tunduk pada asas legalitas maka penggalian tersebut hanya digunakan sebagai hal yang meringankan bagi terdakwa. Hakim mempunyai kewenangan menjatuhkan pidana dalam rentang waktu yang ditentukan undang-undang, rentang waktu inilah yang dipakai oleh hakim dalam memasukkan hukum yang hidup di masyarakat sebagai hal yang meringankan. Hakim tidak dapat membebaskan terdakwa walaupun dimungkinkan secara nurani hakim tahu bahwa terdaka tidak bersalah secara materiil, akan tetapi dikarenakan unsur-unsur dari pasal yang didakwakan terpenuhi maka hakim tetap menjatuhkan putusan pidana

Abstract

Unit of Public Service Agency (PSA Work Unit). UNNES continues to improve itself towards better community service, which is as a Legal Entity State University. Legal Entity State University will have a highly positive impact, especially the autonomy of academic and non-academic administration and management. One of the important efforts in order to achieve the status of UNNES as a Legal Entity State University, it is necessary to form a legal document that is the basis of an organization in the form of a Statute. In the preparation of the Statute, it will not be likely to obtain a suitable Statute without the study and analysis outlined in the Academic Document. Based on this background, this research was based on the formulation of the problem on what is the rationality of the Academic Document that needs to be built, in order to produce a Statute of Legal Entity State University that is suitable for UNNES? And what is the formulation/draft of the Statute of UNNES as a Legal Entity State University in order to materialize the vision of UNNES, which is the Conservation Vision-Based University and International Reputation? Based on the formulation of the problem it is intended to produce an Academic Document of the Statute of UNNES as a Legal Entity State University and the legality document of UNNES as a Legal Entity State University, especially in the form of a constitutional Draft Statute.

Abstract

Education is a fundamental right that is included in the human rights paradigm (right to education). Education is also one of the indicators of human development (human development index), so education has an important position in people’s lives. One of the problems in the field of education, especially in Indonesia is the awareness of the importance of the implementation of education not only for teachers and students but also parents of students. Many cases of teacher reporting on disciplining students at school become a separate problem, especially for teachers. On the one hand the teacher applies its own learning method which is often disliked by students, even some methods are considered as a form of hard learning, which ends with teacher reporting by parents of students. Another problem is the ignorance and lack of understanding of parents of students on the responsibility of shared education. Kalisegoro Village itself has strategic education access. However, these educational problems still occur, so the need for strengthening legal capacity for parents of students and teachers in dealing with educational problems. Through a program of strengthening legal capacity for students and teachers in the village of Kalisegoro Semarang in order to increase awareness of the responsibility of shared education, it is expected to increase parents' participation in educational assistance for their children, as well as increase teacher understanding regarding various potential problems that may arise and how to solve it. This program is a Criminal Law Service Program, using a human rights approach, where education is an important part of human rights (right to education). This program will involve the Fatayat Nahdhatul Ulama organization Kalisegoro Village and Lecturer in the Faculty of Law, Semarang State University. This program will be addressed to teachers and parents of TPQ students An-Nur Kalisegoro and Fayatat Nahdhatul Ulama Kalisegoro Semarang.

Abstract

SMK Assaidiyyah 2 Kudus salah satu SMK berbasis Pondok Pesantren yang diperuntukkan bagi golongan ekonomi lemah. Siswa diwajibkan tinggal pondok pesantren yang menyatu dengan sekolah secara gratis, semuanya ditanggung pengelola baik biaya sekolahnya maupun biaya makan sehari-hari. Lulusan SMK Assaidiyyah 2 Kudus tidak hanya dibekali teori, akan tetapi juga keterampilan tertentu serta akhlaq yang menjadi bekal dalam kehidupan nyata yaitu bekerja. Ada dua jurusan di SMK ini yaitu tata busana dan tata boga. Siswa jurusan tata boga sekarang ini telah dibekali keterampilan membuat berbagai jenis produk makanan, dan sudah menjual berbagai jenis makanan ke beberapa lapisan masyarakat. Permasalahan yang belum diselesaikan sampai sekarang adalah legalisasi produk-produk makanan tersebut baik Izin PIRT, Merek Dagang, dan Sertifikasi Halal. Melalui pengabdian yang dilakukan dewan guru, pengurus yayasan dan siswa SMK Assaidiyah 2 Kudus telah memahami pentingnya legalisasi produk makanan baik sertifikat produksi pangan industry rumah tangga, sertifikasi halal maupun merek. Guru yang membidangi boga telah sepakat dengan tim pengabdi untuk melakukan sertifikasi. Sampai saat ini dari pendampingan yang dilakukan, kepala sekolah telah mengajukan diri sebagai perserta penyuluhan produk makanan sebagai salah satu syarat mendapatkan izin PIRT.

Abstract

Terrorism is an extraordinary crime that is different from ordinary crime. Perpetrators of ordinary crimes such as murder and theft are aware that what they do is evil and wrong, while the perpetrators of terrorism mostly feel that their actions are religious orders and will get a reward in the form of heaven from God Almighty. The issue of the inner attitude of the perpetrators of terror makes up until now the criminal acts of terrorism continue to grow and develop and even begin to spread to female perpetrators. Terrorists continue to build networks and recruit new members to launch the action. Seeing this phenomenon, the method of combating terrorism is not enough to only be done through the path of punishment but also the path of non-punishment. Even this non-penal pathway must be a top priority. The government must cut the chain of wrong understanding of religious teachings through deradicalization efforts. Deradicalization is done by involving all elements of the nation, both law enforcement officials, actors and society. Actors in this case must involve the families of perpetrators, while elements of society involve religious leaders who are qualified and understand the issues of religion and the state. The process of deradicalization will give terrorists awareness that the crimes committed so far are wrong and not in accordance with religious teachings. This awareness will also bring the wider community not easily carried away by a narrow and radical understanding of religion.

Abstract

Illegal fishing in Indonesia is at an alarming point, that the Ministry of Maritime Affairs and Fisheries made a policy of ship sinking. There are pros and cons related to these sanctions, not even a little resistance from both the internal government itself and the mafia who have been enjoying the results of Illegal Fishing. The sustainability of this policy has been almost 4 years. Data represents that through this policy, illegal fishing has dropped dramatically, so that when viewed in terms of criminal penalties for deterrence (absolute theory), the policy is very effective. However, whether the policy has an impact on the income of local fishermen, logically, when there is illegal fishing of small fish, the income of local fishermen increases. In order to figure out the effectiveness of illegal fishing sanctions in relation to increasing local fishermen’s income, the researchers determined the location of the study in the Tambak Lorok Fishing Village in Semarang.
