Abstract

This study aims to explain and analyze the settlement of disputes in cases of termination of employment at the Palembang Industrial Relations Court. The research method used in this research is a type of empirical legal research (juridical empirical) that sees law as facts. The results showed that the incidence of termination of employment in Palembang City was caused by several factors, but the most dominant was that qualified workers/laborers resigned. The process of resolving a case of termination of employment at the Palembang Industrial Relations Court can be carried out using a quick program and an ordinary event. The two events, which are most often used to resolve cases of termination of employment at the Palembang City Industrial Relations Court, are normal. The obstacle related to the judges of the Palembang City Industrial Relations Court in resolving cases of termination of employment is that the parties do not agree on severance pay. The author suggests that the parties in a case state cooperative, not concerned with their respective egos related to severance pay so that the settlement of the case for termination of employment at the Industrial Relations Court can run smoothly. Besides, Industrial Relations Court judges also need to explain if the party does not agree on severance pay.Keywords:  Settlement; Termination of Employment; Industrial Relations Court.

Abstract

Abstract

Abstrak Perwujudan negara hukum Indonesia, disetujui pemenuhan hak-hak dasar negara atau hak asasi manusia (HAM). Bagaimana implementasi pemenuhan HAM diterapkan pada politik hukum HAM yang dijalankan. Politik hukum HAM Adalah kebijakan hukum HAM (hak asasi manusia kebijakan hukum) TENTANG penghormatan (untuk menghormati), Pemenuhan (untuk memenuhi) Dan Perlindungan HAM (untuk melindungi). Kebijakan ini dapat dibuat dalam bentuk pembuatan, perubahan, pemuatan pasal-pasal tertentu, atau pencabutan peraturan perundang-undangan. Perdebatan tentang perlu tidaknya HAM Dipasang khusus dalam konstitusi yang telah dimulai sejak berdirinya negara Indonesia saat ini, maka dapatlah dilihat pembabakan Politik hukum HAM di Indonesia yang dimulai dari pembahasan dalam sidang BPUPKI, masa orde lama, orde baru, hingga pasca orde baru yang saat ini lazim dikenal dengan masa reformasi. Perjuangan panjang untuk memberikan Jaminan HAM bagi warga negara akhirnya membuahkan hasil dengan dinormakan nilai-nilai HAM ke dalam konstitusi ke dalam bab khusus tentang HAM yaitu Bab XA setelah melalui proses amandemen konstitusi Republik Indonesia. Kata Kunci: Politik Hukum, Hak Asasi Manusia. Abstrak Terwujudnya supremasi hukum Indonesia, dijamin terpenuhinya hak-hak dasar warga negara atau HAM (HAM). Bagaimana pelaksanaan pemenuhan hak asasi manusia tergantung pada bagaimana politik hukum hak asasi manusia dijalankan. Politik hukum hak asasi manusia adalah kebijakan hukum hak asasi manusia tentang penghormatan, untuk memenuhi dan melindungi hak asasi manusia. Kebijakan ini bisa dalam bentuk membuat, mengubah, memuat artikel tertentu, atau mencabut peraturan. Perdebatan tentang apakah hak asasi manusia harus diatur secara terpisah dalam konstitusi telah dimulai sejak berdirinya negara Indonesia sampai sekarang, dapat dilihat perpecahan politik hukum hak asasi manusia di Indonesia, yang dimulai dari perdebatan dalam sesi BPUPKI, orde lama, orde baru, hingga masa orde baru yang saat ini lazim dikenal sebagai masa reformasi. Perjuangan panjang untuk memberikan perlindungan hak asasi manusia bagi warga negara akhirnya terbayar dengan menormalkan nilai-nilai hak manusia ke dalam konstitusi menjadi bab khusus tentang hak asasi manusia, yaitu Bab XA setelah melalui proses amandemen konstitusi Republik Indonesia. .

Abstract

Abstrak Guru adalah pendidik profesional yang tugas dan perannya telah diatur dalam peraturan perundang-undangan. Negara selaku pemangku kewajiban dalam melindungi warga negara terkhusus guru, dituntut peran aktifnya dalam melindungi guru dari tindakan kriminalisasi akibat melaksanakan tugas profesionalnya. Pada tataran peraturan, pemerintah telah melakukan tindakan aktif berupa pengundangan beberapa peraturan terkait tugas dan peran guru. Namun dalam taraf penegakan hukum, masih sering ditemui guru yang berhadapan dengan hukum akibat laporan dari orang tua murid atas tindakan guru yang mendisiplinkan murid. Mahkamah Agung selaku judex juris, melalui Putusan Nomor : 1554K/ Pid/ 2013 telah memvonis bebas guru di Majalengka yang bernama Aop Saopudin selaku terdakwa karena Mahkamah Agung menganggap apa yang dilakukannya sudah menjadi tugasnya dan bukan bukan merupakan suatu tindak pidana dan terdakwa tidak dapat dijatuhi pidana atas perbuatan/tindakannya tersebut karena bertujuan untuk mendidik agar menjadi murid yang baik dan berdisiplin. Putusan Mahkamah Agung merupakan wujud tanggungjawab negara melalui lembaga kekuasaan kehakiman memberikan perlindungan terhadap guru dalam melaksanakan tugas profesionalnya. Kata Kunci : Tanggungjawab negara, Perlindungan, Guru. Abstract Teachers are professional educators whose duties and roles have been regulated in the legislation. The state as a stakeholder in protecting citizens, especially teachers, is required to play an active role in protecting teachers from criminalization due to carrying out their professional duties. At the regulatory level, the government has taken active action in the form of the invite of several regulations related to the duties and roles of teachers. However, in law enforcement level, there are still often teachers who face the law due to reports from parents of students for the actions of teachers who discipline students. The Supreme Court as judex juris, through The Verdict Number: 1554K / Pid / 2013 has sentenced a free teacher in Majalengka named Aop Saopudin as a defendant because the Supreme Court considers what he did has become his duty and not a criminal act and the defendant can not be sentenced for his actions because it aims to educate to be a good student and disciplined. The Supreme Court's decision is a manifestation of the state's responsibility through the institution of judicial power to provide protection to teachers in carrying out their professional duties.

Abstract

The main purpose of this writing is to review and how to implement two critical thinking models, namely model to generate critical thinking and critical questions – a linear model. These two critical thinking models can be applied in the reading comprehension instruction, since there relationship between reading comprehension and critical thinking is so close. The specific issues being discussed include schema theory as a rational premise for the connection between reading comprehension and critical thinking, cognitive development processes, critical thinking: its nature and definitions, critical thinking: skills and dispositions, and critical thinking and reading comprehension. The results revealed that: (1) there is well established relationship between reading comprehension and critical thinking, (2) schema theory provides a rational premise for that relation, and (3) there is no consensus regarding the definition of critical thinking which might be interpreted as a lack of an accepted framework for critical thinking.
