Abstract

The issue of Islamic criminal law and its application has become a somewhat heated issue in Indonesia since the very advent of this nation. The political and academic circles are among those who have intensively been involved in debating this problem. The intensity of the debate is due to the fact that the issue is closely related not only to the social construct of the society but also with the very nature of the national law. Speaking of Islamic law in other words, would put a lot of question on how it fits into the national law. This paper deals with this complexity by looking at the Islamic law both as a pure theory and as a formal law that may be applied in certain context. As a pure theory, the Islamic law is dealt with here as vision and idea concerning the attitude of human being in a given society, while as an applied cannon the Islamic law is believed to have the practical dimension that may be applied in a particular situation. The fact that Islamic law has a practical dimension -this paper argues- implies that Shari>‘ah is none other than the product of social dynamics. And this would further mean that the the intellectual exercise to draw legal dictum must take into account the human interest (maslahah) on the one hand, and the dialectic between text and context on the other.

Abstract

Hukum pidana Islam selalu diperdebatkan dari segi nilai-nilainya dalam sendi kehidupan masyarakat. Hukum pidana Islam oleh sebagian pihak dikatakan sebagai produk hukum yang tidak menghargai hak-hak asasi manusia (HAM), terutama ketika berbicara tentang hukuman qisas bagi pembunuh, hukuman rajam bagi pezina, hukuman potong tangan bagi pencuri dan hukuman mati bagi murtad. Kondisi ini diperkeruh dengan propaganda bahwa hukum pidana Islam adalah ketinggalan zaman (out of date) dan tidak humanis. Kesan seperti itu muncul disebabkan karena hukum pidana Islam tidak dilihat secara utuh. Kajian ini membahas aspek-aspek pemeliharaan HAM dalam hukum pidana Islam untuk meyakinkan bahwa hukum pidana Islam diterapkan dalam rangka menjunjung tinggi kemanusiaan dengan menerapkan dua prinsip, yaitu pertama, hukum asal (al-ahkam al-asliyyah), yakni melarang siapa saja yang melanggar hak-hak asasi manusia; dan kedua, hukum pelengkap (al-ahkam al-mu’ayyidah), yakni memberikan sanksi bagi siapa yang melanggar HAM.

Abstract

The formalization of Islamic criminal law in Indonesia is still and always debated in terms of its legal rules or the establishment of Islamic values, meaning that the substance is more important than the formal rules. Transformation of Islamic criminal law is a change that occurs in the determination of law, both concerning the type of crime (jarīmah) or its sanctions due to time and social dynamics. The criminal act (jarīmah) and its sanctions are interconnection between the principal law (al-aḥkām al-aṣliyyah) which contains the prohibition and supporting law (al-aḥkām al-muayyidah) which contains sanctions. The model of the transformation of Islamic criminal law in Indonesia is to make Islamic criminal law a law that can be accepted by Indonesian people, by not distinguishing ethnicity, adat (tradition), culture and religion. The objectivity of Islamic criminal law in Indonesia is used as the basis for the formation of national laws whose pluralistic communities are offered universal values so that they can be accepted by all citizens without questioning the origin of the values.
