Abstract

ABSTRAKEfektivitas koperasi dalam upaya meningkatkan kesejahteraan masyarakat desa mengalami banyak tantangan, bahkan sampai titik nadir. Pemerintah nampaknya berputus asa dalam mengembangkan koperasi. Dalam kondisi yang labil ini Pemerintah membentuk korporasi publik sebagai alternatif lain dalam meningkatkan kesejahteraan masyarakat desa., yaitu Badan Usaha Milik Desa (BUMDes). Dengan BUMDes ini Pemerintah membuktikan kehadirannya dalam masalah-masalah kesejahteraan yang dihadapi masyarakat desa. Dalam awal sepak terjang BUMDes sejak tahun 2009 memberikan harapan besar bagi warga desa karena Pemerintah mencairkan Dana Desa yang bersumber dari APBN. Salah satu penggunaan dana desa ini adalah untuk permodalan  BUMDes. Dalam perjalanannya, timbul masalah yang  pelik yang berkaitan dengan pengelolaan Dana Desa ini, yaitu masalah pengawasan dan pertanggungjawaban keuangan negara. Artikel ini akan membahas tentang kompetisi dan reaktualisasi korporasi sarana peningkatan kesejahteraan masyarakat desa, yaitu apakah Pemerintah kembali ke koperasi atau melanjutkan BUMDes atau melakukan sinergi antara koperasi dengan BUMDes.Kata kunci: koperasi, bumdes, masyarakat desa, ekonomi, solusi keuangan desa ABSTRACTThe effectiveness of cooperatives in an effort to improve the well-being of villagers have some inhibitions. On the other hand, BUMDes is present as a solution to these problems. Related problems of the phenomenon that is the effectiveness of the Cooperative as a business entity of the village before the BUMDes as well as the obstacles encountered in improving the welfare of the BUMDes village community as well as the relevant solutions for menyejahterakan villagers in Indonesia. So in the end, the writer can formulate concepts which are the most appropriate to use in the village as a means of increasing the welfare of villagers. Abstract

Penerapan prinsip Good Corporate Governance (GCG) mengarahkan perusahaan untuk membentuk tata kelola manajemen perusahaan yang bersih, transparan, dan professional. Penerapan prinsip GCG di Indonesia masih tergolong rendah, berakibat pada munculnya salah satu kasus yaitu mengenai Sriwijaya Air Travel Pass (SJTP). Tujuan penelitian ini adalah untuk mengetahui mengenai penerapan prinsip-prinsip Good Corporate Governance (GCG) terkait Perjanjian Sriwijaya Air Travel Pass (SJTP) dan apakah penerapannya sudah sesuai dengan Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas dan pengaturan lainnya, dan menganalisis akibat hukum apabila tidak diterapkannya prinsip tersebut di PT. Sriwijaya Air. Metode penelitian yang digunakan di dalam penulisan skripsi ini adalah menggunakan metode pendekatan yuridis implementatif, yaitu metode penelitian hukum yang mencari kesesuaian fakta di lapangan dengan peraturan yang mengaturnya, dalam hal ini  prinsip Good Corporate Governance (GCG) di dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas yang akan menjadi dasar yuridis terkait perjanjian keanggotaan Sriwijaya Air Travel Pass (SJTP) serta peraturan perundang-undangan lainnya. Berdasarkan hasil penelitian ini, dapat disimpulkan bahwa maskapai Sriwijaya Air belum menerapkan prinsip Akuntabilitas (Accountability) dan prinsip pertanggungjawaban (Responsibility) Good Corporate Governance (GCG) di dalam peraturan internal perusahaan dan secara otomatis tidak pula diterapkan di dalam perjanjian Sriwijaya Air Travel Pass (SJTP) sehingga pihak maskapai Sriwijaya Air memiliki kewajiban untuk memberikan ganti kerugian kepada konsumen/anggota Sriwijaya Air Travel Pass (SJTP).

Abstract

Usaha Mikro, Kecil, dan Menengah (UMKM) sebagai badan usaha yang tidak berbadan hukum memiliki peran besar dalam pembangunan ekonomi nasional. Pemerintah dengan tujuan untuk memudahkan UMKM mengakses pendanaan dari perbankan membuat pengaturan mengenai linkage program. Linkage program memiliki tiga pola yaitu: channeling, executing, dan joint financing. Dalam linkage program pola channeling kedudukan Koperasi hanya sebagai penghubung antara Bank Umum dengan Anggotanya dan tidak mempunyai kewenangan untuk memutus pemberian kredit kepada Anggotanya. Akan tetapi, apabila terjadi kredit macet dari Anggota Koperasi menimbulkan permasalahan perihal pertanggungjawaban Pengurus Koperasi atas kredit macet tersebut.

Abstract

The innovation of P2P Lending that actualizes the Business-to-Business and Business-to-Consumer system has elevated economic productivity. P2P Lending offers a relatively fast and flexible money lending mechanism in which collateral is not mandatory as occurred in banking. However, the issue that arises in P2P Lending is the escalation of non-performing loan percentage that must be prevented through the implementation of effective risk mitigation by the Administrator of the Information Technology-Based Borrowing-Lending Services (Administrator). The research method used in this study is juridical-normative that utilizes the approach of laws, regulations and legal theory to analize the practice of P2P Lending within society. The results of this study indicate that Indonesia’s positive law has accommodated the risk mitigation procedures to reduce operational risk and credit risk, which are the root of the P2P Lending non-performing loan issue, namely through the implementation of CDD and EDD. OJK has a role to regulate and supervise such risk mitigation, especially to eradicate the emergence of unregistered and unlicensed Administrators by coordinating with SWI.

Abstract

ABSTRAKIndustri Rumah Tangga Pangan (IRTP) merupakan industri mikro kecil yang dapat menjadi salah satu industri yang potensial dan memiliki prospek yang baik sebagai penggerak perekonomian nasional. Eksistensi IRTP dari segi ekonomi sangat mendukung bagi masyarakat menengah ke bawah, akan tetapi dari segi hukum IRTP masih banyak terdapat pelanggaran, terutama dalam hal perizinan, salah satunya adalah Sertifikat Produksi Pangan Industri Rumah Tangga (SPP-IRT). Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif. Hasil penelitian menunjukkan eksistensi IRTP tidak memiliki kepastian hukum karena IRTP sering meminta kelonggaran hukum dalam hal perizinan karena merasa masih usaha skala kecil. Tanggung jawab sosial perusahaan atau corporate social responsibility (CSR) baik itu pemerintahan,perusahaan, dan perbankan dapat diterapkan untuk IRTP dalam hal memperoleh SPP-IRT. Dengan demikian, dapat mendorong IRTP untuk meningkatkan kapasitas bisnisnya dan memberikan kesejahteraan bagi Usaha Mikro Kecil (UMK).Kata kunci: CSR; industri rumah tangga pangan; usaha mikro kecil. ABSTRACTThe Food and Beverage Industry (IRTP) is a small micro industry that can become one of the potential industries and has good prospects as a driver of national growth. The existence of IRTP from an economic perspective is very supportive for the middle to lower classes, but in terms of legal IRTP there are still many who oppose it, especially in terms of licensing, one of which is the Home Industry Food Production Certificate (SPP-IRT). The method used is normative juridical and data obtained through literature study. The results show the existence of IRTP does not have legal certainty because IRTP often asks for legal concessions in terms of licensing because it requires a small scale business. Corporate social responsibility (CSR) be it government, corporate, and banking can be applied to IRTP in terms of obtaining SPP-IRT. Thus, it can encourage IRTP to increase its business capacity and provide assistance to micro small businesses.Keywords: CSR; the food and beverage industry; micro small businesses.

Abstract

Micro-business is one of the activities that is currently almost 90% the share of business in Indonesia, considering the micro business is an informal business, and not many micro-businesses have been touched by the financing sector so that micro-businesses are not affected in the economic crisis. In addition, micro-businesses are complicated to develop their businesses due to the lack of requirements to get funding and guidance that is still not effective, resulting in the lack of information for businesses to take advantage of existing market share. Moreover, micro-businesses must also be able to adapt to continue and grow amidst the current difficult conditions. The problems in this study are 1. Growth of Micro Businesses and the Concept of Development and Funding amid Technology-Based Business Competition 2. Legal Aspects of Micro-Business Development in the Welfare State's Goals. Results of this Research As the goal of the welfare state is one of them to improve the social welfare of the community. Micro-businesses participate in the purpose of the welfare state because remembering micro business as one of the fundamental pillars of driving the economy in Indonesia. It is necessary to have an active role of government and society to participate in building micro-businesses to be more developed so that the increase of the economy both in the region and nationally. So that the government must be able to facilitate businesses so that micro businesses can develop as the objectives of the welfare state.

Abstract

In the era of modern technology as it is today and even more so in the Covid-19 pandemic, cyber notary is also mentioned as a post that needs to carry out each technical aspect of his/her authority and duties as a notary with the help of technology, especially that is related to the urgency of making a notary deed electronically. Article 16, Paragraph (1), lines C and M of the Law on Notary’s Position (Undang-Undang Jabatan Notaris-UUJN) requires a notary to embed a fingerprint as an attachment to the original deed and read out the deed/agreement in the presence of client attended by at least two (2) witnesses, and after being read, should be signed by the client, witnesses, and a notary. Meanwhile, the Law on Article 5 Paragraph (4) on Information Technology and Electronic Transaction (UU ITE) provides limitations by making exceptions to notary deed is not included in the category of electronic information or document. Therefore the problem concerning the creation of a legally binding relationship (a deed) using electronic means (e-Notary) has not yet received a solid legal basis and has not guaranteed legal certainty, especially regarding the authenticity and existence of the electronic deed. In addition, the research will also explore the practice of implementing the development of the cyber notary concept in the field of civil law in several countries, both those with the Common Law tradition and the Civil Law tradition, many of which have empowered the function and role of a notary in electronic transactions. The utilized research technique is the normative legal research technique by using the approach to legislation and analysis of legal concepts sourced from primary or secondary legal materials. The results indicate that the concept of a cyber notary in creating a deed by electronic means (e-Notary) requires arrangements that provide clear rules regarding the terms or conditions in the framework of making a notary or authentic deed conducted using the concept of a cyber notary. Thus, the notary can carry out professional duties without contradicting the laws and regulations. In addition, the development of the cyber notary concept that comes from the Common Law System tradition in practice has been widely applied and is no exception for the Indonesian state which is included in the tradition of countries that adhere to the Civil Law System as a modern legal state, of course, cannot escape developments outside the law.

Abstract

Koperasi merupakan salah satu bentuk yang paling konkrit dari usaha bersama berdasar asas kekeluargaan.Dewasa ini, koperasi mengalami beberapa permasalahan, salah satunya terkait modal koperasi yang terbatas dalam mengembangkan usahanya. Guna mengatasi masalah tersebut, koperasi melakukan kerja samasalah satunya dengan perbankan dalam bentuk kredit.Pemberian pinjaman kredit dari perbankantersebut dalam pelaksanaannya dapat mengalami kedit macet, sehingga koperasi harus bertanggungjawab dan apabila harta koperasi tidak mencukupi maka pemilik koperasi juga dapat dimintai pertanggungjawaban.Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis empiris.Hasil penelitian menunjukan bahwa tanggung jawab pemilik koperasi dalam hal terjadi kredit macet dapat sampai harta pribadinya, apabila harta koperasi sudah tidak mencukupi untuk membayar kredit. Namun terdapat ketidakjelasan siapa pemilik koperasi,anggota koperasi yang disebut sebagai pemilik dalam Undang-Undang Nomor 25 Tahun 1992 tentang Perkoperasian tidak dapat dimintai pertanggungjawaban sebagai pemilik. Syarat kepemilikan ditinjau dari teori kepastian hukum terbagi ke dalam tiga bentuk yaitukewajiban atau tanggung jawab pemilik, hak-hak pemilik, dan bukti kepemilikan.

Abstract

The Incident of George Floyd’s death reminds people of the peril of discrimination that still exists within the American society. The incident has triggered worldwide reactions from people who feel sympathy for the victim and reject racism. To eliminate racial discrimination, every modern society needs to remove any negative paradigm towards intergroup relation. In the context of the United States, the American Government has the responsibility to protect the rights of citizens from any forms of discrimination. That includes racial discrimination. In addition, people have to be reminiscent of the danger of racial discrimination in the modern era. The danger has the ability to disturb human rights protection. This study revealed history, criteria, and impacts of discrimination within the scope of human rights protection.Memerangi Diskriminasi dalam Perlindungan Hak Asasi Manusia: Perjuangan Tiada Akhir Abstrak                                            Insiden George Floyd seakan mengingatkan kembali bahaya diskriminasi yang masih ada di masyarakat AS. Kejadian itu memunculkan reaksi dari orang-orang yang turut bersimpati dan menolak rasialisme dari seluruh belahan dunia. Masyarakat modern semestinya sudah mengubah pandangannya yang negatif terhadap kelompok lain, sehingga tidak terjadi diskriminasi rasial. Oleh karena itu, pemerintah AS memiliki tanggung jawab untuk melindungi hak warga negaranya dari segala bentuk diskriminasi termasuk diskriminasi rasial. Di samping itu, masyarakat perlu diingatkan kembali tentang bahaya diskriminasi rasial di era modern yang dapat mengganggu perlindungan hak asasi manusia. Abstract

This article aims to find out how to apply the quality system using ISO 9000 to small industries based on applicable laws and regulations so that it still provides legal certainty for consumers. Because, often small industries ignore the application of quality in ISO 9000 because certification costs are quite expensive. The problem is focused on how the form of legal certainty given by ISO 9000 in the non-contractual category that is, without the recognition of a third party who is a certification body in terms of the principle of legal certainty. To approach this problem, theoretical references from books and journals of law can be used as guidelines for writers. The writing method used is a normative juridical approach and the writing specification is analytical descriptive. This study concludes that the application of ISO 9000 in non-contractual categories can still provide legal certainty to consumers.
