Abstract

Kebijakan dekonsentrasi pengelolaan wilayah pesisir memberikan pekerjaan cukup berat bagi pemerintah Provinsi Lampung yang memiliki 7 (tujuh) kabupaten/kota pesisir dan 132 pulau. Terbatasnya sumber daya manusia, sarana dan prasarana dan jarak Ibu kota provinsi dengan wilayahwilayah pesisircukup jauh menimbulkan tantangan tersendiri dalam pengelolaan wilayah pesisir Lampung, terutama dalam hal pengawasan. oleh karena itu, peran serta masyarakat sangat dibutuhkan guna memaksimalkan pengelolaan wilayah pesisir propinsi tersebut. Penelitian ini bertujuan untuk menggambarkan pemanfaatan pesisir Lampung, mengkaji dan menganalisis kebijakan  pengelolaan wilayah pesisir Provinsi Lampung saat ini, dan merumuskan model kebijakan pengelolaan wilayah pesisir Lampung yang berbasis masyarakat. Penelitian ini merupakan penelitian hukum normatif dengan metode analisis deskriptif kualitatif. Berdasarkan hasil penelitian, diketahui bahwa kebijakan pemerintah Provinsi Lampung dalam pengelolaan wilayah pesisir yang direpresentasikan dalam Perda Prov. Lampung No. 1/2018 masih belum memberikan cukup ruang bagi masyarakat untuk berpartisipasi. Adapun model pengelolaan wilayah pesisir berbasis masyarakat yakni menekankan pada pemberdayaan masyarakat dan kearifan lokalnya.  Title:  Policy Model For Community-Based Lampung Coastal Management PolicyThe shift in the management of coastal areas from decentralization to a policy of deconcentration provides quite heavy work, especially for the Lampung provincial government which has 7 (seven) coastal districts/cities and 132 islands. The limited human resources, facilities, and infrastructure, and the far distance between the provincial capital and coastal areas create challenges in the management of the Lampung coastal areas, especially in terms of supervision. Therefore, community participation is urgently required to maximize the management of the coastal areas of Lampung. This study aims to describe the utilization of the Lampung coastal areas, to analyze the current coastal management policies of Lampung province. In addition, this study also aims to provide and formulate a community-based model of Lampung coastal area management policies. This research is normative legal research with a qualitative descriptive analysis method. Based on the research results, it is known that the Lampung provincial government policy in the management of coastal areas that is represented in the Provincial Regulation of Lampung No. 1/2018 still does not provide enough space for community participation. Meanwhile, the community-based coastal area management model emphasizes community empowerment and local wisdom.

Abstract

The advancement of marine tourism has a positive impact on local communities and also raises concerns about negative effects on coral reefs. Damage to coral reefs in Indonesia currently reaches 46 percent. The damage turns coral reefs white and threatens biodiversity and the function of coral reef ecosystems. One of the causes of damage is the oxybenzone and octinoxate content in sunscreens used by marine tourists. Hawaii has issued a law banning sunscreen lotions containing these substances. The purpose of this study was to analyze the urgency of banning sunscreens in marine tourism areas in Indonesia as a basis for drafting regulations to protect coral reef ecosystems. This study uses a jurisdictional normative approach and analyzes secondary data such as legal theory, laws and regulations, and is supported by several studies on coral reefs. The results of this study indicate that sunscreen can protect the skin from exposure to ultraviolet rays which can cause acute and chronic health problems. However, the use of oxybenzone and octinoxate as chemical filters also has the potential to cause health problems. These substances also cause coral bleaching even at the lowest settlement level. The use of sunscreen is regulated in several parts of the world. Referring to the progressive legal theory, the prohibition of using sunscreens containing oxybenzone and octinoxate in marine tourism areas is considered urgent because the form of the law is made for human welfare and it is a solution to the absence of laws regarding the protection of coral reefs in Indonesia. Adapt selective and responsible law based on facts and environmental data in accordance with responsive legal theory.

Abstract

Kegiatan ini bertujuan mengedukasi mitra dalam hal ini Dinas Pariwisata Kabupaten Pesawaran, mengenai regulasi dan dampak tindak pidana destructive fishing terhadap pengelolaan pariwisata bahari yang berkelanjutan. Metode yang digunakan dalam pencapaian tujuan tersebut yakni penyampaian materi melalui ceramah, diskusi terarah dan tanya jawab. Setelah pelaksanaan kegiatan, diketahui bahwa Kabupaten Pesawaran memiliki beberapa kawasan wisata yang berbasis pantai, kuliner, kerajinan, kawasan wisata berbasis bahari dan warisan budaya, serta kawasan wisata berbasis air terjun. Tindak pidana destructive fishing berdampak terhadap keberlanjutan sektor pariwisata di Kabupaten Pesawaran, karena menyebabkan kerusakan ekosistem dan berbagai biodata laut yang mengurangi daya tarik pariwisata. Kegiatan ini telah memberikan berbagai masukan terkait penanggulangan tindak pidana destructive fishing, guna keberlanjutan pengelolaan pariwisata bahari di Kabupaten Pesawaran.

Abstract

The configuration of fisheries policy before regional autonomy shows the hegemony of the country which adheres to the legal doctrines of collective ownership, centralism, and anti-pluralism. Since the era of regional autonomy, the provincial and district / city governments have had more coherent authority in managing their regional potential, including fishery resources. With the shift in authority in managing fishery resources, it is hoped that the regions can play a role in optimizing the utilization of fisheries potential. But on the other hand, optimal management of fishery resources is difficult to achieve without harmonious policies. Therefore, to prevent conflicts of interest in the fisheries sector, Pancasila values need to be revived in fisheries resource management policies. The problems studied in this study are the authority of local governments in managing fishery resources in the era of regional autonomy, problems of harmonizing local government authority in managing fisheries resources, and harmonizing local government authority in managing fisheries resources based on Pancasila values. By using a normative juridical approach, the results of the research show that the authority of the regional government in managing fishery resources in the era of regional autonomy includes authority in the capture fisheries sector, authority in the field of cultivation, authority in the field of supervision of marine and fishery resources, and authority in the field of processing and processing. fishery marketing. However, so far there have been various disharmony problems with local government authorities in managing fishery resources. In addition, although regional autonomy is believed to have various advantages in optimizing the potential of natural resources, the management of fishery resources carried out in the era of regional autonomy has not fully animated the values of Pancasila as the philosophy of the Indonesian nation.
