Abstract

Islamic and customary law in Indonesia are two entities whose dialectics are taken into consideration in resolving legal issues. The dialectic of both is interesting to study when responding to the changes that occur. Identity is certainly something that is maintained in the midst of this change. It is hoped that the harmonization of the two will always be realized so that the two legal systems are complementary. Islamic law accepts the effectiveness of customary law in its legislative process, while adat accepts Islamic law as the culmination point of indigenous law. This paper tries to understand the dialectic of Islamic law with Osing customs, especially the traditions of the Osing tribe with an ethnographic approach and using a non-conflictual approach theory. The struggle for Islamic and customary law that runs in harmony can be found among the Muslim community of the Osing Banyuwangi tribe. So that the dialectic process and results both deserve to be assessed as the uniqueness of Islam in Indonesia. Abstrak Hukum Islam dan adat di Indonesia merupakan dua entitas yang dialektikanya dijadikan pertimbangan dalam menyelesaikan persoalan hukum. Dialektika keduanya menarik untuk dikaji ketika merespon perubahan-perubahan yang terjadi. Identitas tentu menjadi hal yang dipertahankan di tengah perubahan itu. Harmonisasi keduanya tentu diharapkan akan selalu terealisasi sehingga kedua sistem hukum ini saling melengkapi. Hukum Islam menerima keefektifan hukum adat dalam proses legislatifnya, sementara adat menerima hukum Islam sebagai titik kulminasi dari hukum pribumi. Tulisan ini mencoba memahami dialektika hukum Islam dengan adat Osing khususnya tradisi-tradisi suku Osing dengan pendekatan etnografi dan menggunakan teori non-konfliktual approach. Pergumulan hukum Islam dan adat yang berjalan dengan harmonis ini dapat dijumpai di kalangan masyarakat muslim suku Osing Banyuwangi. Sehingga proses dan hasil dialektika keduanya patut untuk dinilai sebagai kekhasan Islam di Indonesia.

Abstract

This study entitled the application of mumayyiz (maintaining and educating children to adults or able to stand alone) child custody rights to fathers. The formulation of the problem in this study are: (1) How is the arrangement of custody of children to children not yet mumayyiz in the Islamic Law Compilation? (2) Does the Compilation of Islamic Law also regulate the granting of unmumayyiz child custody to the father after the divorce? (3) How is the application of the provision of child custody rights to the father in case Number 2887 / Pdt.G / 2017 / PA JS? This research method is Normative Law. legal research is a method that examines document studies, namely using various data such as court decisions, legal theory, legislation and the opinions of scholars in the research location. Data were analyzed using descriptive analysis method. The results of the study show that the regulation and legal basis regarding granting custody of children is not yet mumayyiz to the father which is a marriage bond between a man and a woman, but on the way to fostering a household it has broken based on the Court's decision in 2015, from the divorce has given birth. two children who are not yet mumayyiz. The occurrence of a lawsuit for child custody has not yet been filed with the Court. Where the main point of the dispute between the Plaintiff and Defendant is regarding child custody based on the provisions of Article 49 paragraph (2) number 11 of Law Number 7 of 1989, as amended by Law Number 3 of 2006 and Law Number 50 Years 2009 jo. Article 156 letter e Compilation of Islamic Law, this case is the absolute competence of the religious court. Previously the Panel of Judges had attempted to reconcile the Plaintiff and Defendant, as well as the mediation process was carried out, but it was unsuccessful, and the parties had two witnesses who gave testimony during the process. the trial which has a proof value is independent (vrij bewijs kracht). From the hadil of the research, the stages of handling cases of child custody have not been mumayyiz which decided that the child custody falls to the father to guarantee a sense of security, peace.

Abstract

Sharia Bank is an Islamic bank that is starting to be in great demand by Indonesians, especially Muslims. Financing. In the running of the IMBT contract, bad credit problems often occur by the customer to the bank with guarantees of security rights to pay off their obligations. Usually the bank will ask the Head of the Religious Court to carry out the execution. When there is no good faith from the customer to the bank, the bank asks the Head of the Religious Court to submit a written auction request to (KPKNL) to sell auction of goods that have been executed. In this paper, the author focuses on the formulation of the problem, namely: 1. How is the IMBT model of shari'ah financing mechanism with guarantees of mortgage rights? auction implementation of the mortgage rights of Ijarah Muntahiya Bittamlik syari'ah financing with guarantees of coverage rights at BUPLN?

Abstract

Badan Wakaf Indonesia (BWI) dibentuk berdasarkan Pasal 47 Undang-Undang Nomor 41 Tahun 2004, BWI merupakan lembaga independen dalam melaksanakan tugasnya, melakukan pembinaan terhadap nazhir, mengelola dan mengembangkan harta benda wakaf. Penelitian ini akan menjelaskan: (1) Implementasi Peran BWI dalam Pengelolaan dan Pengembangan Wakaf dan, (2) Pertanggungjawaban BWI dalam pengelolaan dan pengembangan harta benda wakaf, dengan menggunakan pendekatan teori kelembagaan, regulasi dan kemanfaatan. Metode penelitian dilakukan melalui pendekatan yuridis normatif dari bahan kepustakaan menggunakan data sekunder berupa antara lain peraturan perundang-undangan tentang wakaf, putusan pengadilan, jurnal, peneliatan ilmiah tentang wakaf, buku-buku, surat kabar media online dan internet. kesimpulan dari penelitian adalah sebagai berikut; BAB III menjelaskan implementasi tentang tugas dan wewenang BWI. melakukan pembinaan terhadap nazhir, mengelola dan mengembangkan harta benda wakaf berskala nasional dan internasional; BAB IV, Pertanggungjawaban BWI dalam melaksanakan tugasnya bertanggung jawab kepada Presiden dilakukan melalui laporan tahunan yang disampaikan kepada menteri agama. BAB V. Kesimpulan: (1) tugas dan wewenang BWI adalah melakukan pembinaan terhadap nazhir, mengelola dan mengembangkan harta benda wakaf berskala nasional dan internasional, (2) BWI dalam melaksanakan tugasnya bertanggung jawab kepada Presiden dilakukan melalui laporan tahunan yang disampaikan kepada menteri agama. Untuk efektivitas BWI sebagai lembaga independen dalam menjalankan tugasnya memajukan perwakafan nasional, penulis memberikan saran-saran sebagai berikut: (1) Perlu dilakukan perubahan status kelembagaan BWI yang independen secara mandiri tanpa campur tangan dan/atau pengaruh kementerian agama, (2). Untuk menghindari tumpang tindih antara tugas dan kewenangan, BWI hanya bertugas sebagai badan pengawas saja tidak merangkap sebagai badan pelaksana.
