Abstract

In Indonesia the regulation of the age limit of children is very much regulated in various kinds of existing laws and regulations. related to the imposition of sanctions against children who commit a crime is regulated in detail in law no 11 of 2012 the Criminal Justice System for Children which regulates the age limit of children who can be sanctioned are children who have aged 12 (twelve) years, but have not yet age 18 (eighteen) years and for the types of sanctions imposed on children are divided into 2 types namely criminal sanctions and sanctions of actions.

Abstract

ABSTRAKJual beli komputer rakitkan menimbulkan perlindungan hukum terhadapkonsumen komputer rakitan dan tanggungjawab ganti kerugian pelaku usaha komputer rakitan (dalam aspek hukum perdata), dimana konsumen komputer rakitan harus dilindungi, dan pelaku usaha juga memiliki hak-hak dan kewajiban yang harus dipenuhinya ketika konsumen mengalami kerugian akibat pemakaian produk komputer rakitan yang dijual oleh pelaku usaha. Selain itu sanksi pidana bagi pelaku usaha komputer rakitan yang melanggar aturan hukum yang berlaku (dalam aspek hukum pidana) juga diatur guna tegaknya aturan hukum yang berlaku.Kata kunci: Komputer, rakitan, aspek hukum perdata dan pidanaABSTRACTBuying and selling assemblies computer raises legal protection of the consumer computer assembly and compensation responsibilities businessmen assembled computers (in the aspect of civil law), and consumer must be protected computer assembly, and entrepreneurs also have the rights and obligations that must be fulfilled when the consumer suffer losses due to the use of computer assembly products sold by the business. Abstract

The position of children who have special rights in the law makes children get special treatment. In the juvenile justice system in Indonesia, there are two systems of sanctions, namely criminal sanctions and actions, and this is done to realize the protection of children who are dealing with the law.  This research is a normative juridical review, using a statute, comparative and conceptual approaches. The results show that the imposition of sanctions on children is based on the child's age, where children aged 12 to before 14 years can only be sanctioned with actions, and children aged 14 to before 18 years may be subject to criminal sanctions or actions.

Abstract

Indigenous peoples have the right to food sovereignty, the right of indigenous peoples to meet food needs following local wisdom owned by indigenous peoples following their potential resources and culture, produced independently with their systems. Food production systems follow the conditions of traditional territories, traditional values / norms and knowledge of indigenous peoples, agricultural systems, trade, fisheries, and other production systems in traditional territories. Central Sulawesi, as one of the provinces that still has several areas, which are indigenous community areas, has local wisdom in terms of food security. The availability of food based on the independence of an area cannot be separated from the efforts of the community to maintain regional food security in a way that has become the standard of behavior of the surrounding community in managing the environment that can produce quality food, one of which is the standard of community behavior which is reflected in local wisdom. Through local wisdom in managing the environment, it is hoped that it will be a concrete step to strengthen it carrying capacity, especially in the food aspect. Through Law No. 18 of 2012, which seeks to give obligations to the state to respect, fulfill and protect the right to food of the Indonesian people without exception.

Abstract

Decision of the Constitutional Court of the Republic of Indonesia Number 46/PUU-XIV/2016 which rejects the extension of meaning and scope of adultery, rape and fornication in Indonesian criminal law becomes polemic in society. This is because the acts are very contrary to the moral and religious values, and Pancasila as the ideology of the Indonesian nation. The limitation of judicial review authority by Constitutional Court of the Republic of Indonesia related to criminal provisions is the reason for not willing to take the exclusive authority of the legislator in the formulation of criminal provisions. On the other hand, the Constitutional Court itself often extends the meaning and scope of norms in laws unrelated to criminal provisions.

Abstract

In the children criminal justice system in Indonesia, there are two systems of sanctions namely criminal sanctions and sanctions actions. A child who commits a criminal offense may be subject to criminal sanctions or sanctions. Imposing sanctions for children becomes something oriented towards coaching and protecting children. However, the imposition of sanctions for children can not be effective because of conflicting legal rules, law enforcement officials who have different paradigms in guarding the legal process against children, facilities and infrastructure that are incomplete and inadequate, making it difficult to enforce sanctions on children as well as the poor stigmatization of society against children in conflict with the law.

Abstract

Negara memiliki kewajiban dan tanggung jawab terhadap anak. Hal ini diaturdalam Pasal 22 UUD 1945 bahwa Negara wajib memberikan dukungansarana dan prasarana dalam penyelenggaraan perlindungan anak,memperhatikan hak dan kewajiban orang tua, wali, atau orang lain yangsecara hukum bertanggung jawab terhadap anak, serta mengawasipenyelenggaraan perlindungan anak (Pasal 23), dan menjamin anak untukmempergunakan haknya dalam menyampaikan pendapat sesuai dengan usiadan tingkat kecerdasan anak (Pasal 24). Metode penelitian yang penelitigunakan di dalam penelitian ini adalah: Penelitian ini merupakan penelitianhukum normatif, dengan menggunakan pendekatan perundang-undangan(statute approach) dan Pendekatan konseptual. Banyaknya lembaga yangdibentuk oleh pemerintah dalam melaksanakan perlindungn terhadap anakberhadapan dengan hukum masih belum efektif dikarenakan oleh anggaranyang tidak memadai sehingga keberadaan lembaga yang dibentuk Negarasemakin tidak punya fungsi yang jelas.Kata kunci: Eksistensi, Lembaga Perlindungan

Abstract

Complexity and challenges in uncovering crimes by the police have brought the law enforcement process to purely formal matters. Since the Indonesian police agency separated from the armed forces, their formal and professional attitude has faced many realities on the ground: choosing formal precedence (legal procedures) and ignoring the interests of victims. Legal procedures are more focused on formal justice in accordance with existing, written rules of the game and cannot provide freedom of action. The police are only the spokesperson for written laws and regulations. The idea of ​​being part of people's lives is collided with formal procedures. This condition requires the police to ignore substantial justice, whose importance is more important than mere procedural matters. Law enforcement that is only based on procedures without being balanced with efforts to achieve the goals of law enforcement actually has the potential to damage the order of human rights values. The type of research used is normative legal research using a legal approach, a historical approach, and a philosophical approach. Law enforcement by the police which tends to discriminate against the rights of victims has an impact on the low level of public trust in the police institution which ultimately makes many victims reluctant to report to the police.

Abstract

The purpose of this paper is to find the ideal form of punishment for perpetrators of sexual violence who suffer from deviant sexual behavior. The method in this study is a normative legal research type, where activities are carried out by researching and analyzing the forms of sanctions and punishments regulated in positive law, in addition to conducting a comparative study of the provisions in positive law in Indonesia in the perspective of the types of sanctions against perpetrators of sexual violence crimes. who suffer from deviant sexual behavior. The results show that the ideal form of sanctions imposed on perpetrators of sexual violence who suffer from deviant sexual behavior should not only focus on imprisonment, however, it must be accompanied by other treatments or actions to treat the deviations in sexual behavior he suffers as mandated in the Sexual Violence Criminal Act, which is to combine imprisonment and special rehabilitation to cure his sexual behavior deviations. With the imposition of imprisonment alone, it will not be able to treat the main factor that triggers sexual violence crimes committed by perpetrators who suffer from deviant sexual behavior, so that rehabilitation or treatment efforts are important things that must be done so that there is no repeated or recidive crime.

Abstract

Village Owned Enterprises (BUM Desa) have a very strategic role in improving the economy, especially in South Suwawa District, Bone Bolango Regency, Gorontalo Province. BUM Desa is formed by the Village Government in order to maximize the entire economic potential of the village. This study discusses how the position and implications of the use of association legal entities by BUM Desa in improving the village economy in South Suwawa District, Bone Bolango Regency. The research method used in this research is juridical-empirical type, data collection techniques obtained through observation are then processed and analyzed descriptively. The purpose of this study is that BUM Desa has strong legality in improving the village economy in South Suwawa District in particular and Bone Bolango Regency in general, as well as how to overcome economic problems that arise in the future.
