Abstract

Women and nature are often articulated as two things that are very close and near . Environmental problems that occur today are not gender-neutral because when natural damage occurs, women are the parties most at risk of being affected. Exploitation and conflict of natural resources affect women's welfare. On the other hand, women still experience various obstacles in fighting for and defending their environment and life, women's access and control over natural resources are still minimal, while women are also almost not involved in decision making, face stigmatization, and so on. This study uses the research method of socio-legal research by using an interdisciplinary approach between aspects of normative research and a sociological approach. The results showed that women's groups were not involved in the formation of regulations in the field of natural resources in South Kalimantan and the existing arrangements had not specifically accommodated women's problems, needs, knowledge, and experiences.

Abstract

Seiring berkembangnya zaman dengan kemajuan teknologi di dunia Kedokteran khusunya dalam bidang Operasi Jenis Kelamin biasanya keinginan untuk melakukan perubahan jenis kelamin yang dilakukan disebabkan karena ketidaknyamanan yang dialami oleh orang tersebut dengan jenis kelamin yang dibawanya sejak lahir. dalam hukum positif Indonesia tidak adanya aturan khusus yang mengatur tentang perubahan jenis kelamin. Pasal 56 Undang-Undang No. 24 Tahun 2013 tentang perubahan atas Undang-Undang No. 23 Tahun 2006 Tentang Administrasi Kependudukan secara tidak langsung memberikan kesempatan untuk seorang Transeksual mengajukan perubahan status kelaminnya melalui putusan pengadilan. Dalam Putusan Pengadilan Negeri No 9/Pdt.P/2021/PN Wat menurut keterangan saksi ahli bahwa tujuan dari Transgender pada dasarnya ada 2 yaitu penyesuaian terhadap fisik dan penyusuaian data secara hukum. Jadi yang kita pahami disini apakah “pencatatan” dan “perubahan jenis kelamin” merupakan dua hal yang dapat dipisah, ataukah keduanya merupakan suatu rangkaian dari peristiwa kejiwaan selanjutnya diikuti dengan tindakan medis lainnya yang kemudian berakhir dengan peristiwa hukum yaitu adanya pencatatan tersebut? Apabila pencatatan perubahan jenis kelamin tidak dapat dipisah, dan merupakan satu kesatuan rangkaian peristiwa hukum, bukankah seharusnya majelis hakim menolak seluruhnya permohonan tersebut dikarenakan pemohon belum melakukan tindakan medis berupa operasi penggantian alat kelamin? Tujuan dari penelitian ini adalah Untuk menganalisa apa yang mendasari hakim dalam menetapkan status seorang Transeksual di Indonesia dan bagaimana pengaturan yang ideal terhadap perubahan jenis kelamin sesorang di Indonesia. Hasil Penelitian ini menjelaaskan pada putusan Nomor No 9/Pdt.P/2021/PN Wat majlis hakim mengabulkan permohonan dengan berlandaskan hukum. Tapi apabila di analisis lebih mendalam seharusnya majelis hakim menolak permohonan tersebut karena dalam keterangan pemohon tidak menerangkan bahwa sudah melakukan operasi perubahan alat kelamin. Yang kedua karena di indonesia status hukum nya legal terkait praktik operasi kelamin maka perlu dibuat aturan khusus tentang perubahan jenis kelamin yang jelas agar mengisi kekosongan hukum dan tidak terjadi disparitas dalam penetapan oleh majelis hakim terkait perubahan jenis kelamin

Abstract

Women and children in many countries are forced to migrate due to prolonged civil wars and conflicts. The factors and conditions that affect the well-being of immigrant and refugee populations residing in host countries are not widely known. This study aims to identify and explore the personal experiences and migration processes that affect the well-being of immigrant women in Indonesia. A qualitative method and case study design were implemented. Eight refugee women from three different countries were interviewed: Somalia, Palestine, and Afghanistan. It was found that the contexts of identification, personal experiences, the migration process, and the motives or triggers for migration were important factors in influencing the women’s present and future well-being. The study provides implications for the theory of the model used. The application of the theory assisted the researchers to construct a conceptual framework of the subjective well-being of immigrant women.

Abstract

Child marriage is still a controversial and big challenge that Indonesia has always faced, with Kalimantan Selatan as one of the Big Five Provinces with the highest number of child marriages. The Indonesian government has taken various preventive steps, one of which is revising the age limit for brides from 16 to 19 years old, enacted right before Covid-19 hit the country. However, the revision still begs questions about whether the age limit is practical due to the highest number of unregistered marriages, especially during the pandemic. This study employed the Qualitative method with a Socio-Legal approach and found that the perception and legal consciousness of the respondents were undisputed towards child marriage and disregarded the age limit and the pandemic situation.

Abstract

This socio-legal study highlights the pressing need to incorporate women's voices and experiences in Indonesia's natural resource management policies, particularly in South Kalimantan. This research employs an interdisciplinary approach, utilising qualitative and normative methods. The study investigates how to integrate gender perspectives into policy environments that are often gender-neutral and why it is crucial to include these perspectives in policy-making, especially in the context of South Kalimantan. The finding reveals that women's exclusion from the policy-making process is attributed to the policymakers' belief that the field should be gender-neutral. However, this approach has had adverse effects, resulting in increased gender discrimination instead of mitigating it.
