Abstract

AbstractAll natural resource wealth in the land, sea, and in the bowels of the land of Indonesia are controlled by the State and used as much as possible for the welfare of the people. However, the processing of cinnabar stone natural resources that does not queue up the permit in Luhu Village, West Seram Regency, Maluku Province has resulted in environmental pollution and has an impact on humans. Overcoming this criminal violation, law enforcement has been carried out which resulted in 8 (eight) decisions at the Ambon District Court. This research was conducted with a juridical normative approach, with a statutory approach and a conceptual approach to the imposition of crimes and criminal acts that place statutory regulations as objects of research sourced from primary, secondary and tertiary law. The results of the research conclude that criminal charges against miners without a permit are still low, less than half of the maximum threat of 10 (ten) years in the mineral and coal mining law, this is very unfortunate because the damage to the environment due to processing of cinnabar stone without permission will have a long impact.Keywords: Criminal, Cinnabar, Mining AbstrakSemua kekayaan sumber daya alam yang ada di darat, laut, dan di dalam perut bumi Indonesia dikuasai oleh Negara dan digunakan sebesarnya untuk kesejahteraan rakyat. Namun pengelolaan sumber daya alam batu cinnabar yang tidak mengantongi izin pada Desa Luhu Kabupaten Seram Barat, Provinsi Maluku berakibat pada pencemaran lingkungan dan berdampak pada manusia. Menanggulangi pelanggaran pidana ini telah dilakukan penegakan hukum yang menghasilkan 8 (delapan) putusan pada Pengadilan Negeri Ambon. Penelitian ini dilakukan dengan pendekatan yuridis normatif, dengan pendekatan peraturan perundang-undangan dan pendekatan konsep tentang penjatuhan pidana dan tindak pidana yang menempatkan peraturan perundang-undangan sebagai objek penelitian yang bersumber dari hukum primer, sekunder, dan tersier. Hasil penelitian menyimpulkan penjatuhan pidana kepada pelaku penambang tanpa izin masih rendah tidak sampai setengah dari ancaman maksimum 10 (sepuluh) tahun dalam undang-undang pertambangan mineral dan batu bara, hal ini sangat disayangkan karena rusaknya lingkungan akibat pengelolaan batu cinnabar tanpa izin akan berdampak panjang.Kata Kunci: Pidana, Cinnabar, Pertambangan

Abstract

Salah satu tri dharma perguruan tinggi adalah pengabdian kepada masyarakat. Kami melakukan pengabdian kepada masyarakat pada Lembaga Pemasyarakatan Klas II A Ambon, kami memakai metode jigsaw untuk melakukan metode pembelajaraan agar peserta lebih muda memahami materi yang kami sampaikan, awalnya kami membagikan 3 (tiga) kali kuesioner pada saat sebelum kegiatan penyuluhan setelah kegiatan penyuluhan dan pada selesai kegiatan role play oleh tim yang mempersentasikan materinnya. Penegakan hukum tindak pidana korupsi dimulai dari pencegahan. Kami berharap setelah para warga binaan ini keluar dari Lembaga Pemasyarakatan Klas II A Ambon, mereka bisa menjadi agent of change untuk membawah perubahan di dalam Lembaga Pemasyarakatan maupun di masyarakat luas karena telah paham tentang pentingnya budaya hukum anti korupsi

Abstract

Salah satu komponen tridharma perguruan tinggi adalah pegabdian masyarakat. Pengabdian kepada masyarakat dilakukan dengan melakukan sosialisasi tentang dana desa dan korupsi, metode yang dipakai dengan Tahapan Pertama : Kami melakukan pengambilan data awal untuk mengetahui kebutuhan dari masyarakat Negeri Tawiri. Tahapan Kedua : Kami mengelola data awal tersebut kemudian disajikan nantinya dalam sosialisasi.Tahapan Ketiga : Kami memberikan sosialisasi baik kepada perangkat desa maupun masyarakat yang hadir Tahap Keempat : Kami melakukan pengambilan data terakhir untuk mengevaluasi sosialisasi yang kami lakukan. Hasilnya masyarakat sudah paham tentang peran masyarakat dalam mengawal dana desa, dan akibat hukum yang timbul jika aparat desa melakukan pembangunan atau alokasi dana desa yang tidak sesuai peruntukannya.

Abstract

Corruption is a common enemy that must be eradicated by Indonesia in order to achieve a just and prosperous life. The Indonesian government has made various efforts to eradicate corruption and save state finances. Various products of legislation, institutions, special teams and commissions have been formed by the government to combat corruption to its roots in order to save the economy and state finances. However, corruption is still a problem as an inhibiting factor for the country's economic development. The research was conducted using a normative juridical method with a statute approach and a conceptual approach. Eradication of criminal acts of corruption as an extraordinary crime, because it is serious, systematic and structured, should also be carried out in an extraordinary manner. Extraordinary eradication of criminal acts of corruption is carried out through extraordinary duties and authorities of the Corruption Eradication Commission (KPK), through investigations, investigations and prosecutions carried out in an extraordinary manner by the Corruption Eradication Commission (KPK), development of international cooperation in the context of mutual legal assistance, investigations joint and extradition treaty.

Abstract

This article wants to criticize the practice of adjudication (judicial) which is legalistic in nature, if a judge is legalistic, then of course the basis for the judge's consideration is the law alone, regardless of what is outside the law, because in a criminal act Of course there are many factors that influence and there is also an element of cause and effect that occurs. Court judges as legal institutions that are in direct contact with a sense of justice should be able to consider outside the law. The judge is not a mouthpiece of the law, but the judge is a giver of a sense of justice. Therefore, the judge's decision is expected to be able to actualize the values ​​of Pancasila and also the judge's considerations not only based on the law alone, the State of Indonesia has a state of law, therefore as a legal state its legal products must be truly fair and able to fulfill the sense of justice sought. by the community, so that people no longer feel that this country is unfair or that the law is indiscriminate. The term legism should not be the basis for consideration of the judge's decision, but rather be a source of consideration by the judge, thereby fulfilling the sense of justice sought by the community.
