Abstract

Tujuan dari penelitian ini yaitu untuk mengetahui perlindungan hukum bagi konsumen dalam perjanjian pembiayaan fasilitas channeling dan mengetahui penyelesaian kredit bermasalah dalam perjanjian pembiayaan fasilitas channeling. Jenis penelitian yang digunakan dalam penelitian ini yaitu penelitian hukum normatif dengan menggunakan metode pendekatan undang-undang dan pendekatan konseptual. Dari hasil penelitian ini perlindungan hukum dalam perjanjian pembiayaan fasilitas channeling sangatlah penting untuk dilakukan sebagai bentuk kepastian dan keamanan untuk melindungi konsumen sehingga menghindari terjadi penyelewengan dari pihak pelaku usaha serta apabila terjadi sengketa kepada kedua belah pihak dapat diselesaikan dengan cara terstrukur dan terorganisir. Namun hal ini belum dilakukan secara optimal karena minimnya aturan dan tidak adanya pengaturan terkait dengan sejauh apa risiko yang ditanggung bank apabila terjadi penyelewengan yang dilakukan oleh Lembaga Pembiayaan maupun nasabah.

Abstract

Perlindungan hak-hak konsumen dengan sistem penjualan MLM pada PT. Melia Sehat Sejahtera menurut Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen Bagaimana penyelesaian sengketa konsumen akibat transaksi dengan sistem penjualan MLM pada pada PT. Melia Sehat Sejahtera Tujuan Penelitian perlindungan hak-hak konsumen dengan sistem penjualan MLM pada PT. Melia Sehat Sejahtera menurut Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, penyelesaian Sengketa Konsumen akibat transaksi dengan sistem penjualan MLM pada pada PT. Melia Sehat Sejahtera Manfaat Penelitian Manfaat Akademis, Manfaat Teoritis ,Manfaat Praktis pendekatan perundang - undangan adlah pendekatan yang dilakukan dengan menelaah semua peraturan perundang-undangan dan regulasi yang bersangkut paut dengan isu hukum yang ditangani dan pendekatan konseptual adalah Pendekatan Konseptual yang dilakukan manakala peneliti tidak beranjak dari aturan hukum yang ada.perlindungan hukum menjadi 2 (dua) macam, yakni : Perlindungan Hukum Preventif adalah perlindungan hukum yang diberikan oleh pemerintah dengan tujuan untuk mencegah sebelum terjadinya pelanggaran. dan 2. Perlindungan Hukum Represif untuk menyelesaikan sengketa. Penanganan dalam menyelesaikan sengketa tersebut dilakukan oleh badan peradilan yang berwenang baik secara absolut maupun relatif Perlindungan hak konsumen dalam MLM berdasarkan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen memberikan batasan dan jaminan terkait hak konsumen dalam meningkatkan harkat dan martabat konsumen, perlindungan hukum yang diberikan menjadi 2 macam, yakni :Perlindungan Hukum Preventif dan Perlindungan Hukum Represif dan Penyelesaian sengketa konsumen dilihat akibat terjadinya transaksi dengan system MLM pada PT. Melia Sehat Sejahtera yaitu Litigasi dan Non Litigasi.

Abstract

Penelitian ini bertujuan untuk mengetahui adanya perlindungan hukum bagi para driver dan cara penyelesaian masalah para driver Go-Food yang mengalami ghosting order oleh oknum konsumen yang tidak bertanggung jawab. Metode penelitian yang digunakan dalam penelitian ini adalah Normatif. lalu menggunakan Pendekatan Perundang-Undangan (Statute Approach) dan Pendekatan Konseptual (Conceptual Approach). Berdasarkan hasil penelitian diketahui bahwa perlindungan hukum bagi driver Go-Food yang mengalami ghosting order tersebut dimana perlindungan yang diberikan oleh PT. Gojek Indonesia berupa perlindungan secara preventif yaitu PT. Gojek Indonesia memberitahukan kepada driver memahami ciri-ciri ghosting order dimana untuk mencegah terjadinya hal tersebut dan perlindungan represif yaitu dalam melihat Hukum Perdata yakni Pasal 1338 ayat 3 tentang itikad baik dan Pasal 1365 KUH Perdata tentang Perbuatan Melawan Hukum (PMH), juga dapat melihat dalam Hukum Pidana dimana ghosting order yang dilakukan oleh oknum konsumen tersebut merupakan suatu pelanggaran penipuan dengan mengenai sanksi pidana yang diatur dalam Pasal 378 KUHP tentang tindakan penipuan. Penyelesaian masalah yang dialami driver Go-Food dengan negosiasi dengan PT. Gojek Indonesia dengan tercapainya suatu ganti rugi dimana driver dapat datang ke kantor PT. Gojek Indonesia atau menghubungi Call Center untuk melaporkan kronologi kejadian serta melampirkan bukti-bukti yang kuat, dimana melakukan pelaporan dengan batas waktu 2x24 jam agar menghindari adanya kecurangan dari driver. Agar dapat diganti kerugiannya dengan catatan melakukan dengan pembayaran tunai dan diperbolehkan untuk membawa pulang makanan serta juga ada beberapa masyarakat yang membantu dengan membeli makanan driver Go-Food.

Abstract

The purpose of this study is to find out and explain the basis for providing banking credit in Indonesia and the legal aspects of delaying banking credit due to the Covid-19 pandemic. The research advantage isas recommendations for readers, academics, and the government. This research is normative and empirical legal research. The research results show that, the legal basis for providing bank credit to customers is based on the duties and obligations of banks as financial institutions in Indonesia, the regulations are: (a) Article 23 and 27 of the 1945 Constitution, (b) Article 1 number 2 of the Banking Law, and (c) the Indonesian Civil Code. Legal protection given to Bank Rakyat Indonesia (BRI) customers due to a credit delay as recommended by the Government are preventive and repressive legal protection measures.

Abstract

Currently, business activities have grown very rapidly, this is supported by the application of super-sophisticated information technology. Business activities include production, distribution, consumption, business contracts and international trade. It is undeniable that in carrying out business activities there are disputes. Dispute is a discrepancy between the will of one legal subject with another legal subject on something. In the Indonesian Constitution and Pancasila, it is regulated about deliberation for consensus as an alternative dispute resolution which is then adopted in the form of ADR (Alternative Dispute Resolution) as regulated in Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. This legal counseling activity aims to provide education, knowledge and understanding to the people of Giri Madia Village, Lingsar District, West Lombok Regency in order to resolve business disputes through ADR so as to achieve legal justice for the parties with the principle of Win-Win Solution

Abstract

The development of the insurance business in Indonesia is also colored and overshadowed by various problems such as disputes between insurance companies and consumers or customers regarding complicated claims procedures, misunderstandings about the contents of policies, rejection of insurance claims, services provided by insurance companies that are not optimal, customer anger due to Insurance companies fail to pay Insurance Claims and Fraud, namely intentional fraud committed against or by insurance companies or agents, for the purpose of financial gain. Therefore, it is necessary to optimize supervision by OJK on the insurance business in Indonesia. The type of research used in this research is Normative Research with a Statute Approach and a Conceptual Approach. The results of this study are optimizing the OJK's supervision of the Insurance Business in Indonesia, which is a combination of supervisory models, namely direct supervision (active) and indirect supervision (passive) and preventive forms of legal protection, namely creating responsive and progressive regulations governing the insurance business. especially tightening licensing and reporting mechanisms in its supervision and repressive forms of legal protection, namely the OJK in collaboration with law enforcement officers to conduct investigations and investigations into cases of insurance company defaults including providing criminal sanctions (by the Police and the Prosecutor's Office assisted by the OJK). In addition, OJK provides administrative sanctions for insurance companies, namely revocation of insurance company licenses, closing companies and taking profits from insurance companies to pay compensation to their customers

Abstract

This study focuses on the application of legal sanctions against disclosure violations committed by issuers in the Indonesian capital market.The type of research used in this research is Normative Research with Statute Approach, Conceptual Approach. This study also uses legal materials which consist of primary legal materials, namely legal materials in the form of Law No. 8 of 1995 concerning Capital Markets and Law No. 21 of 2011 concerning the Financial Services Authority. Secondary Legal Materials, namely literature and scientific articles relating to the issues raised in this study and Tertiary Legal Materials consisting of legal dictionaries and encyclopedias. The technique for collecting legal materials used in this research is a Documentation Study with Analysis of Legal Materials, namely Qualitative Descriptive Analysis. The results of this study are that renewal in the form of reconstruction of legal sanctions in the form of increasing the length of imprisonment and increasing the amount of fines for violations of openness in the Capital Market is absolutely necessary in strengthening the existence of the Capital Market in Indonesia so as to create a healthy economic climate and attract investors to invest in the Indonesian Capital Market. The mechanism for imposing sanctions on issuers who violate transparency in the Capital Market has been regulated normatively in Article 101 of Law No. 8 of 1995 concerning Capital Markets and reaffirmed in Article 9 of Law No. 21 of 2011 concerning the Financial Services Authority and Circular Letters Financial Services Authority of the Republic of Indonesia Number: 7 /SEOJK.04/2022 Concerning Procedures for Examination in the Capital Markets Sector. This is done in order to create substantive justice in the field of the Indonesian Capital Market.

Abstract

Purpose of this research are to know implementation of fiduciary collateral auction as fiducia guarantee in Indonesian banking and to know creditor legal responsibility on the auctioned fiducia collateral. This research was normative legal research which applied statute and conceptual approaches. Result of this study, are, first: implementation of auction on fiducia collateral in Indonesian banking is conducted in two ways are conventionally and electronically (e-auction). Type of auction on fiducia collateral is included in execution auction which conducted under the general auction which KPKNL assistance or it also can be done by unofficially according to agreement between parties.Second, banking have been complete his responsibility according to the law on auctioned fiducia collateral such as registering fiducia collateral as fiducia object of guarantee, warning the customer if broke his promises, communicating mediation and negotiating with the customer if problems occurred, providing information and auction announcement thus the customer aware if the guarantee object will be put into an auction, and also restoring the remaining results of the execution of fiduciary collateral objects that exceed the value of the guarantee to the debtor.
