Abstract

ABSTRAKDelik izin lingkungan dalam Pasal 109 Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup menetapkan bahwa setiap orang yang melakukan usaha dan/atau kegiatan tanpa memiliki izin lingkungan sebagaimana dimaksud dalam Pasal 36 ayat (1) akan dipidana. Terdapat aspek kontroversi pada Putusan Mahkamah Agung Nomor 258 K/Pid.Sus/2012 yang membenarkan Putusan Pengadilan Negeri Manado Nomor 357/PID.B/2010/PN.Mdo tanggal 24 Mei 2011. Putusan itu menetapkan terdakwa VP bebas, tidak terbukti secara sah dan meyakinkan melakukan tindak pidana sebagaimana yang didakwakan penuntut umum yaitu Pasal 99 ayat (1)jo. Pasal 36 ayat (1) Undang-Undang Nomor 32 Tahun 2009. Dalam kasus ini dakwaan penuntut umum dinilai tidak cermat dengan tidak mencantumkan delik yang berkaitan dengan pasal yang didakwakan, selain itu putusan hakim dinilai tidak memberikan perlindungan hukum pada masyarakat, cenderung berpikiran sempit dengan telah mengabaikan delik izin lingkungan yang terbukti dalam pemeriksaan di pengadilan, tetapi hal itu tidak terdapat dalam dakwaan jaksa/penuntut umum. Hakim seharusnya tidak mengabaikan hal itu, karenatugas hakim adalah untuk mendapatkan kebenaran materiil yang pada hakikatnya untuk keadilan. Putusan ini juga bisa menjadi dasar bagi kasus-kasus  selanjutnya, di mana pihak yang melakukan usaha dan/atau kegiatan yang wajib amdal dan UKL/UPL tidak akan mengurus izin, mereka akan mengurus izin lingkungan dan izin usahanya jika sudah ada tuntutan delik di salah satu pasal dalam UUPPLH dan hal ini berakibat masyarakat tidak mendapatkan kepastian dan perlindungan hukum atas kejahatan lingkungan.Kata kunci: delik lingkungan, izin lingkungan, amdal. ABSTRACTThe environmental offense concerning environmental permit in Article 109 of Law Number 32 of 2009 on Environmental Conservation and Preservation states that any person running any business and/or activities without an environmental permit as referred to in Article 36 paragraph (1) shall be subject to criminal offense. There is a controversial aspect in the Court Decision Number 258K/Pid.Sus/2012 justifying theCourt Decision Number 357/Pid.B/2010/PN.Mdo issued on May 24, 2011. The Defendant VP was acquitted, not proven legally and convincingly guilty of any offense as accused by the public prosecutor, referring to Article 99, paragraph (1) in  conjunction to Article 36, paragraph (1) of Law Number 32 of 2009. In this case, the accusation of the prosecutor is considered inaccurate because it does not point to the offense in the article prosecuted. Moreover, the court decision is deemed incapable of giving legal protection to the public, and apt to be narrow-minded disregarding the environmental offense on environmental permit which is proven in the examination at court, yet not indicated in the accusation. The judge shall not disregard it for taking into account that a judge is responsible to obtain material truth for the sake of justice. This decision may also be the basis for subsequent cases, in the event thatthe parties running business and/or activities that are subject to liability of Environmental Impact Assessment (EIA) and Environmental Management Effort (UKL)and Environmental Monitoring (UPL) but disregard the environmental permit, and will only take care of environmental permit and the operational authorization if there have been claim for environmental offense in one article in the Law on Environmental  Conservation and Preservation (UUPPLH), thus cause damages to the community to obtain legal certainty and the protection of the environmental offenses. Abstract

In the current era of globalization and internationalization where economic, social and cultural developments have caused international relations to be infinite which can lead to civil disputes which give rise to the meeting of legal systems of countries in the world that have their own characteristics related to International Private Law. Hopefully there will not be many problems that arise if disputes over different citizenship civilizations are resolved through Alternative dispute resolution. Although when the Al forum decision on alternative dispute resolution was not carried out voluntarily by the parties affected by the execution, the execution of such decisions became the competence of the district court. Especially if the arbitration forum ruling was dropped outside Indonesia, then when the decision is to obtain recognition and execution within the jurisdiction of the Republic of Indonesia, the decision must first obtain an exequature from the Chair of the Central Jakarta District. Court. But the situation will be different if the dispute is not resolved through Alternative dispute resolution but is left to the court authorities to resolve it, it will be different.

Abstract

The norm of sanctions in Mining Law 2020 through irrational legislative policies can trigger criminal disparities and become a criminogenic factor. Reformulation efforts are needed in formulating sanctions regarding reclamation. This research aims to realign the purpose of criminalizing the post-mining reclamation obligation in the community mining category. The discussion is focused on the provisions reformulation for the community mining category's reclamation obligation. The problem will be researched using normative legal research methods. According to this research, the reclamation obligation sanction is an omission offense. The reclamation omission offense is both a passive law and a formal offense. Reformulation is based on the basic idea of ​​balancing the double-track system of criminal sanctions. Criminal sanctions become the last instrument if the sanctions are ignored. Action sanctions prioritize restoring post-mining environmental conditions. The criminal sanctions threat and fines in the community mining category must be lighter.

Abstract

Fair dealing is an important element in industrial design legislation. Analysing the concept of fair dealing can help society achieve fairness in protecting industrial design works. Fair dealing means that other parties can use industrial design for education and research purposes as long as it does not prejudice the interests of industrial design rights holders. This study aims to analyse the value of fairness in the concept of fair dealing in industrial design law to be used as guidelines for the rights holders and the public so they do not violate industrial design law and advance the welfare of society. This study uses normative legal research through statutes, conceptual approaches, and primary and secondary legal materials. This study finds that fairness in fair dealing and the protection of industrial design can be achieved by balancing the rights of designers and society. Fairness for both can be achieved if the rights holders and society have opportunities to use and enjoy industrial designs. Industrial design rights holders have limited monopoly rights, and the public can use the results of industrial design in a limited manner for their welfare. This is in line with Aristotle’s observation that justice is given in accordance with values of propriety that are not the same.

Abstract

Perkembangan teori hukum tidak bisa dilepaskan dari lingkungan zamannya. Upaya memahami hukum harus dimulai dengan mamahami tatanan sosial lingkungannya. Tatanan sosial tersebut pada dasarnya mewakili cara berfikir manusia terhadap lingkungan sosialnya, yang selalu terikat dengan ruang dan waktu. Artikel ini ingin menjawab masalah utama yakni: apa saja pemikiran hukum Satjipto Rahardjo dalam kerangka ilmu hukum? Bagaimana kerangka pemikiran berbasis teori hukum dari Satjipto Rahardjo terkait dengan pembangunan hukum dalam konsep hukum progresif? Pemikiran hukum progresif dari Satjipto Rahardjo, lahir karena keadaan Indonesia pada masa lalu, berkaitan dengan usaha dari pemikir hukum untuk menawarkan gagasannya agar persoalan hukum di negeri ini tidak menemui ‘jalan buntu’. Namun demikian konsep pembangunan hukum, konsep hukum progresif berperan penting di dalamnya.

Abstract

Sejak berlakunya Undang-Undang No. 3 Tahun 2020 tentang Pertambangan Mineral dan Batubara eksistensi pertambangan rakyat dari aspek perizinan, pengawasan, pembinaan, hingga pengelolaan lingkungan hidup semakin menyulitkan masyarakat kecil. Tujuan penelitian ingin mengetahui sejauh mana keberpihakan negara terhadap eksistensi pertambangan rakyat pasca perubahan regulasi yang baru. Sisi manfaat dalam hal kebijakan hukum dalam rangka memperkuat posisi hukum pertambangan rakyat. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian dari penelitian ini antara lain; pertama, dengan diberlakukannya Undang-Undang Minerba Tahun 2020 membuat kewenangan perizinan pemerintah daerah telah dihapus. Pengorganisasian perizinan menjadi sentralistik oleh pemerintah pusat. Kedua, eksistensi pertambangan rakyat menjadi tidak jelas pihak mana yang berwenang menetapkan wilayah pertambangan rakyat. Ketiga, peran strategis pemerintah daerah telah dicabut dan saat ini pemerintah daerah hanya menjadi perpanjangan tangan pemerintah pusat sehingga akan muncul budaya birokratisasi dalam tata kelola pertambangan rakyat.

Abstract

The role of the community is very strong and cares about the cultural heritage in their area in the form of the Kotakapur site. Communities who are members of POKDARWIS Bekawan, Kotakapur vilage, trying to make a historical tourism village are not easy, it requires the participation of the Regency Government and related agencies in overcoming one by one the problems that become obstacles to the construction of the site. The problem in this writing is what is the scope of Pokdarwis as a community organization? and secondly how is the urgency of legal entities in community organizations in the form of associations?. Problems will be analyzed using normative research methods, by producing answers, namely first, Pokdarwis is a social organization in the form of associations, second, the urgency of legal entities in Pokdarwis is their legal position as legal subjects.

Abstract

ABSTRAKKetentuan pidana Pasal 162 UU Minerba menetapkan perbuatan menghalang-halangi kegiatan usaha pertambangan sebagai perbuatan pidana (delik). Tujuan penelitian ingin mengetahui secara kritis tujuan pemidanaan delik Pasal 162 dalam perspektif kebijakan kriminalisasi. Asas manfaat yang diharapkan agar dapat melihat secara objektif dalil teori kriminalisasi, sehingga dapat memberikan masukan bagi pembentuk undang-undang dalam memformulasikan ketentuan pidana. Metode penelitian menggunakan penelitian hukum normatif. Hasil penelitian menyimpulkan kebijakan kriminalisasi pada delik Pasal 162 tidak dapat dibenarkan menurut teori moral dan teori liberal individualistik. Hakikat nilai moralitas masyarakat terdistorsi dengan keberlakuan delik tersebut. Negara telah membatasi ruang kebebasan warga negara untuk hidup merdeka menyampaikan dan memperjuangkan hak-hak dasarnya. Bahkan kebijakan kriminalisasi yang dilakukan oleh pembentuk undang-undang tidak mendapat legitimasi yang kuat dari esensi tujuan pemidanaan yang sejalan dengan prinsip nilai, prinsip kemanfaatan, dan prinsip kemanusiaan. Rekomendasi kedepan agar kebijakan legislasi haruslah dilakukan dengan pendekatan rasional dan pendekatan kebijakan. Kata kunci: teori kriminalisasi; kebijakan; pemidanaan; pertambangan.ABSTRACTCriminal provisions Article 162 of the Minerba Law stipulates that obstructing mining business activities is a criminal act (offense). The research objective is to know critically the purpose of criminalization of Article 162 in the perspective of criminalization policy. The principle of benefit is expected to be able to see objectively the arguments of criminalization theory, so that it can provide input for legislators in formulating criminal provisions. The research method uses normative legal research. The results of the research conclude that the criminalization policy on the offense of Article 162 cannot be justified according to moral theory and liberal individualistic theory. The nature of the moral values of society is distorted by the enactment of this offense. The state has limited the space for the freedom of citizens to live in freedom to convey and fight for their basic rights. Even the criminalization policies carried out by legislators do not get strong legitimacy from the essence of the purpose of punishment which is in line with the principles of values, principles of benefit, and principles of humanity. Future recommendations so that legislative policies must be carried out with a rational approach and a policy approach.Keywords: criminalization theory; policy; criminalization; mining.

Abstract

Local wisdom becomes the full authority of the Regency/City Government as clearly stated in the Table of Division of Authority for the Sub-Division of Local Wisdom Based on Law no. 23 of 2014 concerning Regional Government. Therefore, it is very necessary to know the urgency of the integration of local wisdom related to environmental conservation in the Bangka Belitung Islands. This study uses a socio-legal approach, namely the object of research remains in the form of law, namely laws and regulations related to local wisdom and the environment with the use of methods and theories of social sciences to assist researchers in conducting analysis. Local Wisdom is very important to be integrated in regional policies related to environmental conservation because there is a reciprocal relationship between humans and nature, where people who pay attention to local wisdom related to the environment always place the balance of nature in environmental management and must be accepted or approved, which means that the regulation gets recognition. legitimacy) from the community because it comes from local wisdom that lives in the community.

Abstract

Law enforcement is a series of processes to describe values, ideas, ideals, and subsequently become legal objectives. The awareness and compliance of sailing administration to Matras fishermen in catching fish is very much determined by the legal culture of the community. The purpose of this discussion is to determine law enforcement in the context of legal culture in society. The results of the discussion conclude that the legal culture of Matras fishermen displays something unique, namely a spiritual presence and a contextual existence. Therefore, law enforcement in the cultural context is sharing space with the other side of the value that is believed to be sacred in religious substance and believing in the value of local wisdom. The pattern of law enforcement with a cultural dimension is a manifestation of synchronization of the various aspects of substance, structure and culture itself
