<![CDATA[Abstrak Pertimbangan hakim dalam putusan Nomor 18/G/2014/PTUN.BJM. mengenai ketentuan pemberlakuan stelsel positif pada perkara pembuktian kepemilikan hak atas tanah karena Bertentangan dengan ketentuan Pasal 32 ayat (2) Peraturan Pemerintah No. 24 Tahun 1997 kemudian Eksepsi Mengenai gugatan Penggugat daluarsa dan derogasi Pasal 32 ayat (2) PP 24 Tahun 1997 bagi para pihak dalam perkara sengketa sertipikat ganda dalam hal ini harus atau wajib menjamin tegaknya Kepastian Hukum Bagi Pemegang Sertipikat Hak Atas Tanah Selaku Pembeli Yang Beritikad Baik kemudian adanya Perlindungan Hukum Bagi Pemegang Sertifikat Hak Milik Tanah Yang Telah Berusia Diatas Lima Tahun.
