Abstract

Entrepreneurship development based on creative industries for women congregation majelis taklim (MT) in Kepek village is carried out using the PAR (Participation Action Research) method which aims to encourage creative minds by pressing questions and participant-oriented guidance. Entrepreneurship development for MT female congregation in Kepek Gunung Kidul village can be achieved well. Among others are; There needs to be a follow-up in a series of mentoring and skills improvement, both for the main and supporting the business. The potential for good local wisdom can be converted into economic values. Massive development of marketing networks needs to be considered in order to have a bigger economic impact on the surrounding community. The government is advised to support deeper exploration of the local economic wisdom of the people of Gunung Kidul so that it can have a direct positive impact on its residents.

Abstract

This analytical descriptive study intends to see the formation of national characteristics conditioned in supporting learning milliu at PTKI characterized by the Nahdlatul Ulama organization that adheres to the noble values ​​of Ahlu Sunnah wal Jamaah (Aswaja). Mainly, the cultivation of nationalism which is characterized by religion in the tridarma of higher education that can be felt by students as adult students. The research is limited to the process of internalizing characteristic courses that contain local wisdom, or also known as NU-ness, at the Yogyakarta Islamic College (STAIYO) Wonosari. Case studies are conducted qualitatively. After the data from participatory observation, in-depth interviews, and documentation were analyzed, it was concluded that the level of participation of students and all STAIYO academicians was very high. This is because they realize that in the future they will become community leaders who have to protect the religious reasoning as NKRI.

Abstract

Talks about Islamic and coastal communities nowadays being raged. It is based on the reality that religious complextion of coastal communities showedtheir own peculiarities as compared with a pattern of religious communities in another regions. Various kinds of ritual nuances of animism and dynamism are still carried out by coastal communities of Gunungkidul, such as sedekah laut, rasulan, nyadran, sedekahan, cincing guling, selametan, ledekan and ngalangi. In the fact, the majority of the communities over there are Muslim. Still exercise of the various kinds which nuances animistic and dynamistic makes the researches became passionate to do research. Two problems arise, why the Islamic community in the shouter coast of Gunungkidul still run a wide range of ritual and how it is according to Islam. By using sociological approach and maqasid shariah it can be concluded that there is still the exercise of various rituals such as the Islamisation process that is accommodative, the character of the Java community that mystical centric, their ignorance about the origin and meaning of the rituals and the lack of their knowledge of Islamic theology. In spirit, the various cultures and rituals are contract to Islam, but about the shape and the instrument has not to be conflict with Islam, both normative or historically. Indeed, various rituals and the instrument is contains of positive values such as the value of togetherness, helping each other, thanks favors, resigned and charity.

Abstract

One of the problems faced by the judiciary in Indonesia that there is a largenumbers of buildup cases. On the other hand, the community, especially those who’sseeking for justice want these problems can be solved immediately. For this reason theSupreme Court issued PERMA No. 1 Tahun 2008 about Mediation Procedures inCourt. The integration of mediation into the court proceedings expected to be one of theeffective instruments to address the buildup of the case. The Yogyakarta State Court asone of the first instance court in Indonesia should always seek mediation as a means ofsettlement of civil disputes. This is consistent with PERMA No. 1 Tahun 2008about Mediation Procedures in Court which require mediation before proceedings. Fromthe available data the percentage of successful mediation in Yogyakarta state Court in2012 and 2013 which is about 4.26% and 1.91% respectively of 164 and 157 civilcases were entered. This research is a field research, which examines the application ofmediation in resolving civil disputes in Yogyakarta State Court Year 2012-2013according to PERMA No. 1 Tahun 2008 and the constraints in its implementation.To answer these problems the authors use juridical empirical approach in which theLegislation relating to these issues serves as the reference material for research. Then allthe data is analyzed by descriptive-analytic.

Abstract

Menurut UU Wakaf, pergantian nadzir perseorangan dapat dilakukan dengan tiga cara yaitu pengunduran diri nazhir perseorangan, atas dasar inisiatif KUA, dan atas usulan wakif atau ahli waris wakif. Sengketa wakaf salah satunya persoalan penggantian nazhir. Kompetensi absolut untuk penyelesaian sengketa wakaf di Pengadilan Agama. Penelitian ini bertujuan untuk mengetahui apa isi putusan kesepakatan perdamaian sengketa wakaf dalam putusan Pengadilan Agama Gresik No. 474/Pdt.G/2020/PA.Gs. Jenis penelitian yang digunakan adalah penelitian hukum normatif-empiris dan bersifat deskriptif analitis. Hasil yang ditemukan dari penelitian ini adalah pertama, isi putusan kesepakatan perdamaian berbunyi : “menghukum Para Penggugat, Tergugat I dan Tergugat II untuk mentaati dan melaksanakan isi persetujuan yang telah disepakati tersebut.“ kedua, putusan akta kesepakatan perdamaian sengketa wakaf ini adalah bersifat mengakhiri sengketa diantara para pihak, kesepakatan perdamaian dengan memberi amanah musyawarah lanjutan, mengikat bagi para pihak dan pihak terkait, memiliki sifat dapat dilaksanakan atau eksekutorial, mediasi menjadi cara alternatif penyelesaian sengketa yang lebih cepat, mengandung rasa keadilan substantif, seperti dengan pergantian komposisi nadzir baru, mencerminkan perilaku iktikad baik para pihak dalam mediasi, mengedepankan proses perundingan, kesepakatan perdamaian dalam mediasi tidak bertentangan hukum, kesepakatan yang terdokumentasi dan ditandatangani, kesepakatan yang terkuatkan oleh pengadilan, menghindari dampak negatif konflik sosial dan keagamaan, memperbaiki / mempertahankan silaturahmi dan sesuai ketentuan al-Qur’an dan hadits.
