Abstract

What about the development of Islamic criminal law in Nusantara? This question should have been raised for the position of Islamic civil law is widely related to positive law, both as an influencing element or as a modification of religious norms formulated in civil law, even stated in the substantial legal scope of Law No.7 1989 dealing with religious justice. While Islamic law in the field of criminal justice - to mention another term of the Islamic criminal law - has not attracted much attention like the field of Islamic civil law. Apart from that, the available academic studies are often political in nature and broaden the distance between the understanding of positive criminal law and Islamic law in the field of criminal law. From a macro-historical perspective, the plurality of laws is inevitably a historical reality. The Positivism School believes that: the development of law is formalized for the sake of the law only. These circles strongly reject political interference in law, law by law, legal science in the form of value-free science while political science especially when associated with social science can be in the form of value-loaded science. According to this group's view, the procedure of finding, forming, and implementing law are in the hand of legal apparatus, the law can only be found through the judge's decision. The legal formation process is limited to legitimator products passed by the law. Law is a command of the law giver.

Abstract

This article describes the calligraphy art in Indonesia. The focus of this study describes the contribution of A. D. Pirous in the development of calligraphy painting in Indonesia ranging from 1970-2003. The method used in this writing is a historical research method, which includes heuristics, criticism, interpretation and historiography. The result of this paper is the contribution of A. D. Pirous, in the form of a new calligraphy school (a mixture of painting and calligraphy), inspiring the use value of calligraphy painting as well as the name of calligraphy as the identity of Islamic art that is coupled with Indonesian local wisdom.

Abstract

Penelitian ini dilatarbelakangi oleh ketertarikan penulis pada kesederhanaan gaya hidup kaum ulama/ kyai di Tatar Sunda yang terkesan monoton aktivitasnya antara masjid, pondok, santri dan masyarakat. Kalau kita tengok kekayaan dan isi rumahnya niscaya tak ada barang mewah yang menghiasi, hanya deretan kitab-kitab kuning klasik yang menjadi kajian kebanggaannya. Tak terkecuali dalam hal gaya berbusananya. Sekalipun ulama-ulama di Tatar Sunda memiliki kekhasan gaya busana masing-masing, tetapi sangat jauh dari tampilan kemewahan. Seiring dengan perkembangan zaman terutama di era reformasi justeru banyak tampil ulama atau kyai gaya baru yang menghias media layar kaca yang sangat berbeda jauh dengan apa yang ditampilkan oleh ulama/kyai tempo lalu terutama di era kolonial. Terkadang sulit membedakan mereka, apakah sebagai sosok seorang ulama/ kyai atau selebritas? Pertanyaannya, apa yang menjadi latar penyebab terjadinya pergeseran sosok ulama bersahaja dan berwibawa kepada kyai/ustadz yang popular dengan gaya hidupnya yang mewah? Bagaimana model-model gaya busana para ulama dari zaman ke zaman di Tatar Sunda? Penelitian ini menggunakan metode historis yang meliputi empat tahapan, yaitu: 1) heuristik, 2) kritik sumber, 3) interpretasi, dan 4) historiografi. Berdasarkan hasil penelitian yang telah dilakukan dapat menjelaskan bahwa keterkaitan fashion atau busana pada ulama/ kyai tidak lagi sebatas simbol budaya yang mencerminkan identitas dan kepribadian seorang ulama, melainkan juga nilai agama tercakup di dalamnya. Pakaian ulama dianggap sebagai standar berpakaian yang dianjurkan dalam Islam. Oleh karenanya, meniru gaya berpakaian ulama akan dianggap sebagai bagian dari tuntunan ajaran Islam. Gaya busana para ulama disesuaikan dengan kondisi sosial dan kultur di daerahnya masing-masing sekalipun sebagiannya mengadopsi model-model dari luar, baik model Arab Timur Tengah, Eropa, India, Cina bahkan Turki.
