Abstract

Banyak faktor dan hambatan yang dihadapi dalam upaya menumbuhkembangkan perfilman nasional, salah satu isu terpenting adalah praktek monopoli di bidang importasi dan distribusi serta monopoli di bidang eksebisi. Monopoli bioskop pada satu jaringan perusahaan bioskop dapat menyebabkan ketatnya kompetisi perolehan copy film yang didistribusikan, apalagi jika perusahaan distributor film tersebut termasuk ke dalam jaringan perusahaan bioskop yang bersangkutan.Kata Kunci : Film, Monopoli, Persaingan Usaha

Abstract

Untuk menjamin peraturan perundang-undangan yang dibuat dan diberlakukan tidak bertentangan dengan nilai-nilai Pancasila, maka diperlukan instrumen hukum indikator nilai Pancasila. Namun permasalahannya adalah adakah intrumen hukum yang dapat digunakan sebagai acuan dalam pembentukan dan evaluasi peraturan perundang-undangan  dan kelembagaan hukum apa yang memiliki kewenangan untuk melakukan evaluasi dan penyelarasan terhadap peraturan perundang-undangan dimaksud? Untuk menjawab permasalahan ini, metode yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan perundang-undangan. Analisis dilakukan secara deskriftif kualitatif dengan menggunakan metode deduktif dan penarikan kesimpulan secara preskriptif. Hasil yang diperoleh adalah bahwa BPIP dan BPHN telah menyusun dan menggunakan indikator nilai-nilai Pancasila untuk melakukan evaluasi, kajian dan analisis serta penyelarasan peraturan perundang-undangan yang didasarkan pada nilai-nilai Pancasila di internal kelembagaannya. Instrumen ini perlu dikembangkan dan diperkuat dengan mencantumkannya dalam lampiran Undang-Undang Nomor 12 Tahun 2011, agar setiap pembentuk peraturan perundang-undangan memiliki pemahaman dan panduan yang sama. Adapun terkait kelembagaan, perlu adanya penguatan dan sinergitas antar lembaga pembentuk peraturan perundang-undangan untuk mengistitusionalisasikan nilai-nilai Pancasila.

Abstract

Notaries basically work to get fair and proper compensation and treatment in an employment relationship, so a notary should be able to re-apply as a notary after completing the bankruptcy process. Because the notary who has been declared bankrupt and has been dismissed by the minister has paid compensation to the creditor, so that the creditor has received his rights. The UUJN provides provisions if a notary who has been declared bankrupt will be dishonorably dismissed from his position as regulated in Article 12 letter a of the UUJN. The type of research used is normative juridical, with a statutory approach and a conceptual approach as well as a historical approach. The regulation of the bankruptcy notary in Article 9 and Article 12 of UUJN is vague, ambiguous and inconsistent. A Notary as a General Officer is given the authority to make an authentic deed. Future arrangements regarding the reappointment of notaries who have completed the bankruptcy process, that there needs to be complete and specific regulations, because there is a void in norms regarding the reappointment of notaries who have completed the bankruptcy process.

Abstract

Perjanjian perkawinan dapat diartikan sebagai persiapan memasuki bahtera rumah tangga. Perjanjian perkawinan adalah perjanjian yang dibuat sebelum perkawinan dilangsungkan. Namun saat ini, ada suami istri yang membuat perjanjian pernikahan di tengah-tengah pernikahan. Perjanjian perkawinan biasanya menjanjikan tentang harta benda dalam perkawinan. Perjanjian perkawinan juga mempengaruhi pihak ketiga yang mempunyai kepentingan. Rumusan masalah: 1) Apakah perjanjian perkawinan mengenai harta warisan yang dibuat oleh suami istri mempunyai kekuatan hukum yang sah dan mengikat kepada pihak ketiga, 2) Apakah notaris berwenang untuk mengesahkan perjanjian harta warisan yang disepakati oleh seseorang yang masih terikat? melalui pernikahan, dan 3) Bagaimana pengaturan selanjutnya? Terhadap kontrak warisan yang dibuat oleh suami istri. Tujuan penelitian ini adalah untuk mengetahui dan memahami keabsahan dan kekuatan hukum mengikat bagi pihak ketiga dalam suatu perjanjian perkawinan mengenai harta warisan yang dilakukan oleh suami istri, untuk mengetahui dan memahami kewenangan notaris dalam pengesahan suatu perjanjian harta warisan yang disepakati oleh seseorang yang masih terikat perkawinan, dan untuk memikirkan pengaturan-pengaturan yang akan datang bagi perjanjian pewarisan yang dibuat oleh suami istri. Jenis penelitian yang digunakan adalah yuridis normatif, pendekatan masalah yang digunakan adalah pendekatan undangundang, pendekatan konseptual, pendekatan kasus, dan pendekatan komparatif. Berdasarkan hasil kajian terhadap bahan hukum yang ada, dapat disimpulkan bahwa: Pertama, perjanjian perkawinan mengenai harta bawaan yang dilakukan oleh suami istri mempunyai kekuatan hukum dan mengikat bagi pihak ketiga jika dicatat atau dicatat dalam daftar umum di Kepaniteraan Pengadilan Negeri di wilayah hukum. pernikahan itu terjadi. Kedua, Notaris berwenang untuk mengesahkan perjanjian pewarisan yang diperjanjikan oleh orang yang masih terikat perkawinan, sebagaimana tertuang dalam Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015., dan Ketiga, pengaturan masa depan dari perjanjian pewarisan yang dilakukan oleh suami istri, memerlukan adanya kepastian hukum dalam membuat perkawinan terkait harta warisan yang dilakukan di tengah-tengah perkawinan.

Abstract

The difficulty of obtaining or using the earth's surface in urban areas has resulted in people starting to look for a number of plots of land below the earth's surface. Thus, a development breakthrough innovation is needed that can address the development of community needs, namely the space below the earth's surface. The use of basements, namely UUPA, automatically refers to property rights in discussing the use of basements. The aim is to find a system for granting land rights or management rights to basements in Law Number 5 of 1960 concerning Basic Agrarian Regulations and Law Number 11 of 2022 concerning Job Creation for individuals. This research is a normative juridical research with collection techniques from the literature which consists of primary and secondary legal materials. The results of this study are the system of granting land rights or management rights to basements in the BAL by basing it on the provisions of Article 2 paragraph (2) of the BAL, the term "management" and "organizes". The Job Creation Law is for individuals or legal entities that are given HGB and HP for a period of time as contained in the concept of basement management in Article 146 paragraph (1) to (5) of the UUCK, namely paragraph (1) The land or space formed in the upper room or underground and used for certain activities can be given HGB, HP, or HPL. In conclusion, the State Authority relates to (a) the use and/or allotment, supply and maintenance of the earth, air, space and natural resources in the territory of the Republic of Indonesia; (b) payment or arrangement of types of land rights; (c) paying or arranging several legal relations between people and legal entities with land as objects.

Abstract

Red onions (shallots) are an important commodity in the Indonesian economy, both in terms of contribution to national income and as a commodity for controlling the price of goods. Red onion farming is usually cultivated conventionally in paddy fields requiring intensive labor. Recently, several youths in a village in Jember, East Java, have been cultivating red onion hydroponically for the last three years. The business has good prospects but has problems in its development. This study aims to map the strengths and obstacles faced and to determine the right strategy. The analytical method used is descriptive with a field force analysis approach. The analysis results show that the strength factors possessed include experience, both farming experience and market experience, product diversification capabilities, and support in the form of networking with related agencies. While the inhibiting variables include limited market access, limited access to funding, and limited skilled resources. Based on the FFA analysis, it is known that the most important weight is the increase in cultivation skills and the ability to diversify products. The results of this study recommend that startup actors need to be vigilant in undergoing the initial phase of business implementation, which has many obstacles and needs to have a strategy by increasing post-harvest processing skills. Abstract

The Limited Liability Company Law only 'limits' companies that are required to carry out Social and Environmental Responsibility, namely by mentioning 'companies that carry out their business activities in the field of and/or related to natural resources'. This phrase then, in the Explanation section of the relevant paragraph, is explained as a company whose business activities manage and utilize natural resources, and/or a company that does not manage and does not utilize natural resources, but its business activities have an impact on the capability function of natural resources. Is it thus that Article 74 paragraph (1) is not discriminatory in nature because it only requires Social and Environmental Responsibility for companies that carry out their business activities in the field of and/or related to natural resources. This means that companies whose business activities are not related to natural resources, including business entities that are not in the form of companies, namely Cooperatives, CVs, Firms and Trading Companies, are exempt from the obligation to carry out Social and Environmental Responsibility.
