Abstract

Patriotisme bagi generasi muda harus terus ditingkatkan, yaitu adanya suatu generasi yang berpikir integralistik dalam hubungan kesatuan dan keutuhan wilayah NKRI dengan semangat otonomi daerah, berkarakter unggul dengan pendekatan kearifan lokal, berpikir rasional, kritis, inovatif, terbuka dan dinamis yang didasari semangat merdeka dalam berkarya. Sebetulnya generasi muda telah memiliki kesatuan tekad untuk membangun masa depan bersama yang akan mengurus terwujudnya aspirasi dan kepentingan bersama secara adil. Faktor penghambat yang dapat menjadi tantangan terhadap nasionalisme bagi generasi muda saat ini adalah adanya keinginan mendirikan negara agama, seperti fenomena radikalisme yang masuk ke kampus-kampus, tokoh-tokoh radikal yang dijadikan idola baru generasi muda, fenomena ISIS dengan model rekrutmen yang menggunakan media sosial yang dapat memikat generasi muda, adanya pemimpin daerah yang tidak cakap memimpin, isu-isu demokratisasi, HAM, lingkungan hidup, liberalisme dan universalisme yang telah menembus dan merasuki cara pandang dan cara berpikir pragmatis generasi muda. Dengan demikian, solidaritas agama dapat menggeser kesetiaan nasional, universalisme ideologi agama menggeser nasionalisme dan pada akhirnya menghilangkan identitas nasional. Tidak melawan perang pemikiran (perang ideologi) dengan kekuatan senjata, tetapi dengan ilmu pengetahuan. Disinilah pentingnya kita mempertahankan kesatuan ideologi Pancasila dalam berperilaku, dan bertindak dalam perang melawan radikalisme yang tumbuh di masyarakat. Membangun semangat cinta tanah air dengan tujuan membangun generasi yang berbudaya unggul, bangga berbangsa dan berbahasa Indonesia pada saat ini menjadi masalah pokok dan penting dalam membentuk karakter bagi generasi muda agar memiliki daya tahan dalam menghadapi dinamika perubahan dan dalam upaya pencegahan radikalisme yang gencar berkembang di kampus-kampus tersebut. Tulisan ini menguraikan bagaimana membangun nasionalisme baru generasi muda yang berkarakter unggul dalam upaya mengembangkan model pencegahan radikalisme dan terorisme yang berkembang marak akhir-akhir ini di kampus.

Abstract

In determining an act or crime as a political offense we have to look at the background of these actions. The problem,however, related with the codification such as the Criminal Code. It does not expressly provide the identification the action in the field of politics. In the Criminal Code, for example, the murder of president or vice president, did not be regarded as the murder. That is, evidence about the political background is not necessary to have the trial court. While the law relating to this problem such Act. 11/PNPS/1963 on Combating Subversive Activities that have been revoked, have two opinions. First, states have no political background. Second, there should be no political background. The fundamental difference of these two opinions is about an act as a political offense, one side assumes the other party would destroy the existing system, on the other hand is considered an act of rescue (hero).

Abstract

Penelitian ini bertujuan untuk mendeskripsikan bagaimana Model Pengakuan Hak-Hak Konstitusional dalam Agama (Studi Banding menurut UUD 1945 dan Undang-Undang Dasar Malaysia 1957). Di mana kedua negara memiliki budaya yang sama tetapi mematuhi sistem hukum yang berbeda. Objek penelitian adalah Model Pengakuan Hak Konstitusional dalam Agama dan sumber budaya lokal yang kental dengan tradisi tradisional Melayu yang jika dikelola dengan baik akan memberikan kesejahteraan bagi hubungan kedua negara. Keaslian penelitian ini adalah bahwa dalam mengakui hak-hak konstitusional untuk warga negara secara jelas dalam agama, penting sebagai sumber inspirasi dalam pembentukan hukum. Tipe penelitian yang digunakan adalah penelitian hukum normatif . Hasil penelitian ini menunjukkan bahwa Di Indonesia, meskipun tidak ada pengakuan yang jelas bahwa Islam adalah agama negara, ada pengakuan yang jelas tentang Islam baik dalam Paragraf Ketiga dan Keempat Pembukaan Undang-Undang Dasar 1945 serta dalam Pasal 29. Badan UUD 1945 sebagai agama negara. Di Indonesia, dalam praktik pengakuan hak-hak agama dapat dilihat dalam pembuatan beberapa undang-undang dan peraturan seperti Hukum Haji, Hukum Zakat, Hukum Perbankan Syariah, Hukum Pengadilan Agama, Hukum Perkawinan, Qanun di Aceh dan Peraturan Syariah di beberapa Provinsi di Indonesia. Dalam konstitusi Malaysia, prinsip perlindungan hak-hak konstitusional dalam agama menempati posisi yang sangat penting, universal dan pada saat yang sama menegaskan Malaysia dicirikan sebagai negara hukum, tetapi dalam praktik kehidupan sehari-hari masih banyak hal yang perlu diperhatikan. disesuaikan dengan aturan hukum. Dalam pekerjaan atau pekerjaan masih ada banyak pelanggaran kebebasan beragama, masalah larangan majikan dan agen tenaga kerja pada kebebasan pekerja rumah tangga Muslim untuk berpuasa, berdoa dan menghindari babi dan anjing sehubungan dengan keyakinan agama mereka adalah pelecehan dan pelanggaran agama kebebasan sebagai dilindungi Dalam Deklarasi Universal Hak Asasi Manusia. Meskipun dalam Konstitusi Malaysia jelas bahwa Islam adalah agama resmi negara, tetapi praktik larangan dan tekanan untuk melakukan tugas-tugas keagamaan di tempat kerja tetap menjadi hambatan yang sangat serius.

Abstract

The South China Sea is a strategic marine area in terms of natural resource potential and international trade routes. For decades, territorial disputes have occurred with peaceful solutions from regional organizations, international courts, and even contributions from outside the claimant state. This paper examines the efforts made to contribute to a peaceful solution to disputed states of claims. The achievement of a peaceful solution, the shortcomings of the peaceful solution to the proposed peaceful solution's chronology. This research is normative juridical research that is historical descriptive in nature. The South China Sea Dispute arises from China's actions regarding its map of its maritime territories that do not comply with international maritime law. Regulations regarding the method of drawing deep-sea boundaries under international maritime law are violated in this act. Negotiation efforts in finding conflict solutions in regional organizations, state leadership meetings, informal meetings of claim state policymakers, and efforts to file claims by the Philippines at permanent court arbitration have been carried out. China's action that does not recognize the Philippine lawsuit decision poses a challenge to international maritime law and its member countries. A complete peaceful solution must be sought immediately when Softlaw and hard law must comply with the claiming state.

Abstract

This study discusses the phenomenon of Babel Pilgub 2017 in understanding the extent of the character of early voters in determining their constitutional rights in the Pilgub. The novice viewers' views are now evolving and have undergone many changes. The approach model used by the beginner Bangka Beliutng voters in determining and dropping their choice. The advance level of the beginner's education of Bangka Belitung became the main reason for the occurrence of electoral disorientation. So far, the most dominant and decisive primordial factor of primal voters has shifted toward the achievement factor of the candidates. This can be seen from 27,988 novice voters or 3.08% of the total number of existing voters list, the distribution of candidate achievement relationships with the choice of the novice to the spouse is very strong. The results of this study indicate that there is a tendency to change the character of the beginner voters before they decide and choose their choice to cover five aspects such as the novice voters to choose candidate pairs of governors / representatives who are faithful, honest, rich, fair and able to separate between the people's property and private property, knowing what the advantages and disadvantages of the candidates are, they do not choose candidate pairs who use money politics or any unlawful means to get people to vote for them, and they choose candidate pairs that use the wealth of the people for the importance of education and welfare.

Abstract

Verdict Sungailiat Court Number 03/Pdt.G/2012/PN.Sgt in the verdict has stated the defendant (Feng Jung) has committed acts againts the law by certifying a plot of land to a National Land Agency of Bangka Regency on the Right Certificate Number 2305 was issued by the National Land Agency if Bangka Regency in 2003, but was sued by the plaintiff (Tjong Ana) in 2012. The results of research, Paragraph 32 Sentence 2 of Government Regulation Number 24 of 1997 have been fulfilled by defendant in conducting process of land registration of Certificate of Property Number 2305 so that this provision is absolutely to run and about absolute authority to run about absolute authority of judge, that a judge of a Public Court is not authorized to declare a Certificate of Property Number 2305 has no legal force, and certificate that is a powerful evidentiary tool has become an absolute if element of Paragraph 32 Sentence 2 of Government Regulation Number 24 of 1977 has been fulfilled.

Abstract

State of Indonesia is a very large country. It can be seen from many tribes, nations, cultures, languages, and others who are in Indonesia. As a unitary state with extensive autonomy, takes the concept of the relationship of authority between the central government and local governments. Administratively, the pattern of the relationship of authority between the central government and regional governments born of the delegation of authority. Who was born on the theory of delegation, supervision concept embraced by local governments in Indonesia are more inclined to form Hybrid variations (supervision), transfer of power from central to local government could be said to embrace open-end arrangement or general competence. therefore, a new paradigm in central and local relations should be established with the pattern of center-periphery relations towards a more harmonious, it's time developed progressive thinking that is based on relations that are complementary and interdependent.

This research is motivated by the decentralization of Indonesia which has unsymmetrical, because of the existence of specific nd special regions, further more in terms of the presedential government system there is a problem in the development of its subsystems up to regional government. Thus, understanding is needed to understand th reality and redesign of regional autonomy in regional head elections, specific and special regions, and in order to reaffirm the presidential government system in an effort to build relations between the president and regional heads. As for the method used in making this writing is a juridical method normative or doctrinal. Thus, understanding is needed to nderstand the reality and redesign of regional autonomy in regional head elections, special and special regions and in order to reaffirm the presidential government system in an effort to built relations between the president and regional heads. As for the method used in making this writing is a juridical method normative or doctrinal, because the data search is done by reviewing local government law and legislation related., and the data also related to the privilege and specificity of the region. The results of this study is themiddle solution to solve the problem can also be done by direct appointment of the governor by the president, although this is very unpopular and very risky politically, but if it starts with rational reasons, surely the people in the area will accept, and of course with a low cost as well. The direct appointment is very necessary for the president so that relations with the governor as an extension of president’s hand will be stronger.

Abstract

Bangka Belitung Province have a community called a native population known as the Lom or Urang Lom. Legal recognition of the Urang Lom community in the formation of the Village Customary Institution where Urang Lom still lives is a very important part of the perspective of legal protection. The form of legal protection against the existence of Urang Lom is only limited to the recognition of a traditional institution called Mapur Customary Institution which is under the auspices of the Malay Customary Institution of Bangka. The formal and material legality problem in the formation of the Urang Lom Customary Institution in Gunung Muda and Gunung Pelawan Villages is related to the synergy of the Mapur Customary Institution that has been formed with the Village Customary Institutions based on the Village Law. Gunung Muda Village, and Gunung Pelawan Village made the formation of the Village Customary Institution be difficult because it clashed with the village territorial area.

Abstract

Act No. 11 of 2008 on Information and Electronic Transactions is the first Act in the field of information technology and electronic transactions as a product of much-needed legislation and has become the spearhead that lays the groundwork for regulation in the field of technology utilization, although now during the implementation of the ITE Act experienced some problems regarding legal certainty about criminal provisions after the decision Constitutional Court, protection personal data and criminal investigation. Method in this study is normative juridical with a statutory and conceptual approach. Government supports the development of IT through its legal infrastructure and arrangements so that the use of IT is carried out safely to prevent its misuse by paying attention to the religious and socio-cultural values of Indonesian people. Side of protection and legal certainty in the use of information technology, media, and communication in order to develop optimally. Protection of personal data in conducting activities in cyberspace can be the right to enjoy a private life and free from all kinds of interference, right to be able to communicate with others without the act of spying and right to supervise access to information about one's personal life and data.
