Abstract

Islamic economic law constitute the pilot project of islamic law research. This is more significance since the birth of modern Syari’ah financial institutions based on provision of contract law in the sphere of Islamic economic law (muamalat) and also the rapid development of moslem business need the legal status to be implemented to resolve when ever the despute of muamalat contract exist. The formalization of Islamic economic law today, by the enactment of UU No. 3 Tahun 2006 become the most outstanding and rapid development that outweighing what has been formulated before and gives the religious court the widermandate to resolve despute of muamalat contract. This clearly gives the advantage of Moslem society to comply with Syari’ah provision in their daily business activity from one hand, and also gives a challenge to Moslem society to mature this legal status from another. This writing tries to comprehend the formalization of Islamic economic law due to new release of UU No. 3 Tahun 2006 and look it from both perspective: opportunity and challenge. Kata kunci: hukum, ekonomi, Islam, formalisasi, dan implikasi.

Abstract

Banjar people are known as the religious community. It can be seen from the social values espoused by the people that are related to Islamic values. For Banjar people, every Rabiul Awwal or Rajab month is commemorated as the birth and the Isra Mi‟raj of the Prophet Muhammad Saw. In the commemoration, expression of love for the Prophet Muhammad is sung by maulid poems. These poems often contain the teachings of Nur Muhammad. In the history of the community, the closeness between the community and Nur Muhammad is proven by the teachings of Abdul Hamid Abulung in his wujudiyyah holy book and Datu Sanggul in his barencong holy book. Other major figure in Banjarmasin who has deceased yet still provides profound teachings to the community was Guru Izai who also taught Nur Muhammad teachings.Keyword : Nur Muhammad, Cosmology, Material, Space, TimeMasyarakat Banjar dikenal sebagai masyarakat religius. Hal ini bisa dilihat dari nilai sosial yang dianut masyarakatnya yang terkait dengan nilai-nilai Islam. Di Masyarakat Banjar setiap Rabiul Awwal atau Rajab akan diperingati kelahiran dan Isra Mi‟rajnya Nabi Muhammad Saw. Dalam aktivitas ini ungkapan rasa cinta kepada Nabi Muhammad selalu disenandungkan lewat syair-syair maulid. Sementara syair-syair maulid ini sering mengandung ajaran Nur Muhammad. Dalam kesejarahan masyarakat Banjar pun ditemukan bahwa kedekatan masyarakat Banjar ini dengan Nur Muhammad bisa ditemukan dalam ajaran tokoh-tokoh seperti Abdul Hamid Abulung dengan wujudiyyahnya dan Datu Sanggul dengan kitab barencongnya. Tokoh besar lainnya di Banjarmasin yang telah meninggal dunia namun masih memberikan bekas mendalam pada masyarakat Banjar yakni Guru Izai juga mengajarkan ajaran Nur Muhammad ini.Kata Kunci: Nur Muhammad, Kosmologi, Materi, Ruang, Waktu

Abstract

Tuhfat al-Râghibîn is the first book of theology for Banjarese besides the book of Usûl al-Dîn. This book focuses not on the area of surface-structure (outer aspects) but particularly on the deep-structure area (inner aspects). The deep-structure study will help interpret the meaning of the book in its relation to the historical, social, and political context. This paper will explore the deep-structure area which consists of two problems, namely the ideology and the epistemology of Tuhfat al-Râghibîn. This study concludes that the ideology of the book is Sunnî, and the epistemology of the book is bayânî. It is based on an analysis that the source of the book is text (nass), its method is qiyâs and ijtihâd, and the rational argument in the book is used as a means of justification, although it still maintains a balance between revelation and rationalism. In addition, the type of argument is defensive-apologetic, the validity of its argument is the conformity of text to the reality, while the basic principle is infisâl (discontinuance) and tajwîz (permissiveness).
