Abstract

The State Civil Apparatus (ASN) is the executor of government and development tasks. Therefore the ASN must be neutral. Based on Law Number 5 of 2014, the neutrality of the ASN is free from the influence and intervention of all political parties and groups. To maintain and guarantee the neutrality the integrity, cohesiveness, and unity of the State Civil Apparatus from the influence of political parties and to focus all attention, mind and energy on the tasks charged, the ASN is prohibited from becoming a member and/or administrator of political parties. In the past, the neutrality of the ASN began in the Old Order, when the issuance of Presidential Regulation Number 2 of 1959 concerning the Prohibition of Civil Servants and Public Officials in Political Parties. Furthermore, this Presidential Regulation was followed up and expanded with a Circular Letter of the President of the Republic of Indonesia Number 2 of 1959 concerning Prohibition of Membership of Political Parties for State Officials that Carry Out State Obligations Outside of Positions which they hold. Furthermore, in the New Order period, Law Number 8 of 1974 concerning the Principles of Staffing, while during the Reform Order was issued, among others, Law Number 43 of 1999, Civil servants must be neutral from the influence of all groups and parties and not discriminatory in providing services to the public. And the Reform Order was issued Law Number 5 of 2014 and other regulations related to the neutrality of the ASN

Abstract

The State Civil Apparatus has a very important role in the implementation of the tasks of government and nation-building. Therefore, the State Civil Apparatus is an apparatus free from political intervention. In other words, as stated in the legislation, the State Civil Apparatus must be neutral. The neutrality of the State Civil Apparatus is a prohibition for the State Civil Apparatus to become a member or manager of a political party, so that the Civil State Apparatus is free from the influence and intervention of political parties in the performance of their duties and obligations. The regulation of the neutrality of the new State Civil Apparatus began in the New Order period with the issuance of Law No. 8 of 1974, and so on in Law 43 of 1999 and Law No. 5 of 2014 on State Civil Apparatus and its implementing regulations. In practice, the implementation of neutrality of the State Civil Apparatus has many obstacles and constraints. At the time of enactment of Law No. 8 of 1974 and Law No. 43 of 1999, the principle of State Civil State’s neutrality of neutrality is often violated, this is due to the strong influence of political parties in bureaucratic relations in government agencies. Therefore, in the period of Law No. 5 of 2014, efforts are made to minimize and even eliminate the influence of political parties on the State Civil Apparatus, one way is to establish the State Civil Apparatus Commission.

Abstract

The State Civil Apparatus (ASN) is the executor of governmental and development duties. Therefore, ASN must be neutral. According to Law No. 5 of 2014, the neutrality of ASN must be free from the influence and intervention of all groups and political parties. In order to maintain the neutrality of the State Civil Apparatus from the influence of political parties and to ensure the integrity, cohesiveness and unity of the State Civil Apparatus, and to focus all attention, mind and energy on assigned duties, ASN is prohibited from becoming a member and / or political party official. Historically, the arrangement of ASN neutrality began during the Old Order period, which the issuance of Presidential Regulation No. 2 of 1959 on the Prohibition of Civil Servants and State Officials in Political Parties in that time. Furthermore, this Presidential Regulation is followed up and extended by Circular Letter of the President of the Republic of Indonesia No. 2 of 1959 concerning on Prohibition of Political Party Membership for State Civil Apparatus that implement state obligation outside his position. Furthermore, in the New Order era, Law No. 8 of 1974 on the Principal of Employee Affairs, while in the Reform Order was issued Law No. 43 of 1999, Civil Servants should be neutral from the influence of all groups and parties and not discriminatory in providing services to the community.

Abstract

Badan Penyelenggara Pemilu yakni KPU, Bawaslu, DKPP melakukan tugasnya masing-masing. Dalam hal pengawasan proses pemilu di Provinsi DIY dilaksanakan oleh Bawaslu DIY berdasarkan Undang-Undang No 7 Tahun 2017 tentang Pemilu, Bawaslu berwenang mengawasi dan memproses pelanggaran yang terjadi dalam pelaksanaan pemilu. Diantara hal yang diawasi oleh Bawaslu DIY adalah netralitas ASN. Maka, pengawasan terhadap kenetralan ASN sangat diperlukan guna memastikan bahwa ASN tidak terlibat dalam politik praktis yang dapat menimbulkan permasalahan birokrasi. Penelitian ini bertujuan untuk mengetahui peran Bawaslu DIY terhadap asas netralitas ASN di DIY. Apakah ASN di DIY sudah mentaati asas netralitasnya sebagai ASN atau belum. Metode penelitian yang digunakan adalah penelitian empiris. Penelitian ini dilaksanakan di kantor Bawaslu Provinsi DIY. Berdasarkan penelitian yang dilakukan, pelanggaran pemilu sebenarnya masih terjadi di wilayah hukum Provinsi DIY, namun dalam hal pelanggaran netralitas ASN masih dikategorikan minim. Dari data yang didapat, bahwa netralitas ASN harus dijaga karena posisi ASN yang strategis dalam pemerintahan, maka pengawasan terhadap ASN dilakukan oleh Bawaslu mulai dari upaya pencegahan, upaya penindakan, hingga proses pemberian sanksi kepada ASN yang melanggar. Bawaslu harus terus melaksanakan kewajiban sesuai regulasi dan mengupgrade SDM juga menambah fasilitas yang dapat menunjang kinerja pengawasan pemilu agar pelanggaran-pelanggaran yang masih terjadi dapat ditekan jumlahnya

Abstract

Penyelesaian Hubungan Industrial yang di selesaikan oleh Dinas Tenaga kerja dan Transmigrasi Kabupaten Bantul yang sudah di atur dengan dasar hukum Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial tersebut bertujuan untuk memperbaiki hubungan kerja sama antara buruh dan pengusaha, Penyelesaian ini diselesaiakan dengan proses arbitrase, konsiliasi, mediasi dan bipartite. Permasalahan yang akan di teliti: 1) Bagaimana peran Dinas Tenaga kerja di Kabupaten Bantul dalam menyelesaikan perselisihan hubungan indusrial melalui mediasi di Kabupaten bantul? 2) Apa saja faktor yang menghambat penyelesaian perselisihan hubungan industrial secara mediasi?Metode penelitian yang di gunakan dalam penelitian ini yaitu menggunakan yuridis empiris, dengan cara menggunakan pendekatan hukum dalam kenyataan atau berdasarkan fakta yang di dapat secara obyektif di lapangan baik berupa data, informasi dan paendapat yang di dasarkan pada identifikasi hokum. Dari hasil penelitian ini menunjukan : (1) Peran Dinas Tenaga Kerja dan Transmigrasi Kabupaten Bantul dapat menyelesaikan perselisihan hubungan industrial yang sudah di atur dalam Undang-Undang Nomor 2 Tahun 2004 yaitu dengan cara mufakat dan terdiri dari mediasi yang akan di pimpin oleh mediator, (2) Hambatan saat penyelesaian perselisihan hubungan industrial salah satunya adalah kurangnya pengetahuan kedua belah pihak dan tidak adanya kesepakatan atau berbeda pendapat sehingga menimbulkan perselisihan dan kurangnya pemahaman terhadap regulasi perundang-undangan ketenagakerjaan yang berbeda-beda, dan pihak ketiga pun akhirnya memberikan pendampingan kepada kedua belah pihak.
