Abstract

Corporations as the subject of law in its business activity has great potential to commit human rights violations either committed as the act of the Corporations with the pattern of human rights violation conducted by Direct Complicity that is human rights violation with direct involvement, Beneficial Complicity where company take direct benefit from human rights violation which others do. Silent Complicity as a form of corporate failure to stop or even do something when there are laws or laws that discriminate against a group in society. Violations committed by international and national corporations do not yet have a firm legal instrument that governs the accountability of the Corporations against human rights violations until July 6, 2011 based on United Nations Guiding Principles on Business and Human Rights. The relationship between business and human rights is conceptualized in the three pillars of the framework. The first pillar, stipulates that the state has an obligation to prevent, investigate, compensate and punish the violations of human rights committed by private actors. The second pillar, provides that corporations have a responsibility to respect human rights. The third pillar stipulates that the government should provide recovery access for victims of human rights violations.

Abstract

The establishment of the International Criminal Court (ICC) in 1998 provided a hope for certainty in resolving cases of international human rights crimes that occurred after the Rome Statute which formed the basis of this court ratification in 1998, the Non-Retroactive Principles adopted in the Rome Statute did not open this courtroom Human rights crimes that occurred before 1998, so that a new court model is needed to resolve human rights cases that occur namely the Hybrid Court Judicial model, also known as the Mixed Court model, seeks to combine national legal and judicial elements with the International. This Alternative Model is then chosen in resolving cases of human rights crimes that occurred in Sierra Leone and Cambodia, but given the different human rights crimes that occur, different approaches and models are needed in the formation of selected Hybrid Court Courts. So it needs to be explored about the urgency, the legal status of Hybrid Court formation, as well as the technical mechanisms of the trial, both Special Court for Sierra Leone and Extra Chamber Court of Cambodian/ECCC. The results of this study are first, the urgency of the formation of Hybrid Court is to fill the limitations of temporis jurisdiction from the ICC as an institution in prosecuting perpetrators of international crimes so as to close the impunity of perpetrators because the State can still try its citizens by using its domestic legal system without having to fully use the International mechanism. Second, Hybrid Court can be formed through agreements between the United Nations and the government of a country which is then used as a legal basis for the court, as implemented in Cambodia, besides that the formation of Hybrid Court can also be formed through national laws as applied in Sierra Leone.

Abstract

Perwujudan demokrasi di Indonesia salah satunya melalui pelaksanaan pemilihan umum. Sebagai bagian dari hak asasi manusia, persoalan ini telah diamanatkan dalam Pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. PKK Desa Mulyoagung yang terletak di Kabupaten Malang adalah salah satu  desa yang turut andil dalamnya. Beragam media yang menginformasikan mengenai pemilu memiliki dampak yang signifikan, namun tetap diperlukan penyuluhan hukum terkait dengan tata cara pencoblosan surat suara dan juga sosialisasi bakal calon dalam proses pemilu serentak memilih wakil rakyat DPRD, DPD, DPR serta Presiden dan wakil Presiden tahun 2019

Abstract

ABSTRACTAs a concept of sustainable development it is seen to support the development of human rights, especially Ekososb rights where the fulfillment of human rights no longer focuses only on the current generation but also focuses on fulfilling human rights for future generations. This research was conducted with the aim of analyzing and understanding about Indonesia's commitment after signing the International Sustainable Development Goals Commitment in 2015. This research use normative juridical methods that will analyze the concept of sustainable development in Indonesian legislation and the relation of the concept of sustainable development to the fulfillment of human rights for the people of Indonesia. The author believes that basically the concept of sustainable development is a challenging target for Indonesia as a developing country, but the achievement of this target must be sought by making concrete steps in the framework of fulfilling the global commitments that have been made by the world community to realize justice Asasi is not only for people in developed countries but also for the current generation sustainable development commitment is expected to provide fulfillment of cross-generation and cross-Regional Human Key words: Suistainabel Development, Legislation, Human Rights ABSTRAKKonsep pembangunan berkelanjutan dipandang mendukung perkembangan HAM terutama hak ekonomi, sosial dan budaya dimana pemenuhan HAM tidak lagi hanya berfokus kepada generasi yang ada saat ini namun juga fokus terhadap generasi yang akan datang. Penelitian ini dilakukan dengan tujuan untuk menganalisis dan memahami tentang komitmen Indonesia pasca melakukan penandatanganan Komitmen tujuan pembangunan berkelanjutan Internasional pada tahun 2015. Penelitian ini mengggunakan metode yuridis normatif dengan menganalisis tentang konsep pembangunan berkelanjutan di dalam perundangan Indonesia serta relasi konsep pembangunan berkelanjutan terhadap pemenuhan HAM bagi rakyat Indonesia. Penulis berpendapat bahwa konsep pembangunan berkelanjutan merupakan target yang cukup menantang untuk dicapai oleh Indonesia sebagai negara yang sedang berkembang yang harus diupayakan dengan melakukan langkah-langkah konkrit dalam rangka pemenuhan komitmen global yang telah di buat oleh masyarakat dunia demi mewujudkan keadilan Asasi tidak hanya bagi masyarakat di negara-negara maju maupun generasi saat ini tetapi juga lintas generasi dan lintas regional.Kata kunci : Pembangunan Berkelanjutan, Perundang-undangan, Hak Asasi Manusia
