Abstract

MMI and JAT as a radical Islamic movement that carries the purification of religious doctrine, including the harmonization rejection of Islam and culture are interesting facts especially when ideology was living in Indonesia and dealing with the fact mainstream Indonesian Muslim religious dynamics of Islam that emphasizes the Indonesian culture. Sociology approach religion with models interactive content analysis with literature data and found the results of the study. First, the failure of non-Islamic system to overcome the problem of the Indonesian nation since independence is the background of the founding of MMI and JAT. Second, MMI and JAT have legal thought in the form of source of Islamic law is the Qur'an and hadith, the obligations enforce of shari'at Islam in the form of an Islamic state or khilafah Islamiyah, and the duty of jihad. Third, the idea of law has the potential social conflict and violence in Indonesia as opposed to mainstream legal thought muslim in Indonesia.

Abstract

Pattern formulation of rules of jurisprudence to find points of unity in jurisprudence existing products together with qiyâs pattern, a pattern similar to the pattern even qiyâs position and function yet still debated scholars. Become more attractive especially when some scholars claim that the whole issue of jurisprudence back on one thing rather than on, the rule was interesting mas?lah?ah, while the mas?lah?ah beneficiaries according to some scholars can be used as a source or illat law. Through content analysis models interactif and with literature data found; was mas?lah?ah has a strong relationship with the rules of fiqh concretely; the rules of fiqh is equivalent to illat law because the rules of fiqh is the point of unity of a cross section of various products in the form of jurisprudence meaning kullî of some legal juz’i, in which juz’i law derived from the Qur’an, hadîth, ijmâ’, and qiyâs order to maintain the benefit of the people in the world and the hereafter, and because of the rules of fiqh is the one mas?lah?ah itself where mas?lah?ah the one can be used as a illat if established, supported and demonstrated by nas?s? and do not contradict nas?s?.

Abstract

Determination holiday in Indonesia always interesting to follow because always ended on absence of power force by government in bringing together the determination method holiday, punctuality holiday as well as the implementation of the holiday. Though fiqh legitimizes power forcefully of the government for not invite sinners, in the corridors mas?lah?ah and related issues for the people. Fiqh escorted through governments or that emerges from government in level of history more effectively and show government authority as fiqh dug by khulafâ’ al-râshidûn. Then it becomes interesting if the determination holidays in Indonesia viewed from perspective fiqh sect government. Through the model of content analysis interactif and with the document literature found two conclusions that perspective fiqh sect government (1) The Indonesian government has full authority to set the time and method of determining holiday with a model of collective diligence, in the sense chose a method of determining holiday and time holiday with representatives of community organizations. And (2) government decree through collective diligence on holiday must be obeyed and have binding force against Muslims in Indonesia.

Abstract

The provision ijbâr Rights in Islam has become the legal umbrella of forced marriage implementation in a deep-rooted society. The existence of unbalanced understanding and strong indication of the influence of ‘urf. Through fiqh approach, munâsib al-‘illah and ‘urf focusing on review of forced reextrictions in Islamic law, obtained that right ijbâr is actually a safeguard against girls but when it becomes a guardian’s right, it can not be applied because; right of girl in the fiqh salaf takes precedence over the right of guardians as the provisions of guardians ‘ad}al and the requirements of the guardian of mujbîr; legal images of the nature of girl and nature of children in the study of munâsib al-‘illah with the approach of al-qawâ’id al-fiqhîyah has one point of similarity that ‘illat is immature in sense of not being able to determine mas?lah?ah herself that shows maqâs}id avoids girls from danger, and this is difficult to achieve by forced marriage; the basic law of the right of ijbâr is the hadith that ‘illat in hadith it is ‘urf so that the hadith’s validity depends on ‘urf; and deliberation between guardians and girls is the best and praiseworthy way of determining a potential mate.

Abstract

The diversity of opinions about childbirth, especially children resulting from illegitimate relationships (zina), interfaith marriages, marriages that are not registered so that their children are not legally recognized in Indonesia seems to cause practitioners of Islamic law (Indonesia) to still not determine an agreement about the status of the child in the problem. In addition, there is still no courage to use science and technology as one of the mechanisms in determining language. Based on this, the focus of the study of this article is to try to read and explore the opportunities for using science and technology in determining how a child is born into a marriage bond. Abstract

‘Urf in ushul fiqh is categorized as a source of Islamic law or a valid (disputed) Islamic legal proposition, but in the various products of Islamic jurisprudence that exist, it turns out that all schools use ‘urf as a source of law. The categorization seems to contradict the facts of the existing fiqh. Based on this, the focus of the study of this article is to unravel the ulama’ debate about the status of ‘urf in legal terms in each school. By using the library data analyzed in content (content analysis) in depth, it can be concluded that all schools use ‘Urf as a legal proposition or legal source even though the ushul fiqh is classified as a valid (disputed) legal proposition.

Abstract

Fiqh selalu menarik perhatian masyarakat, baik kalangan ahli maupun awam karena fungsinya sebagai hukum yang hidup di masyarakat. Kebutuhan akan fiqh ini ternyata menjadi pemicu sebuah fenomena akhir-akhir ini tentang perdebatan hukum Islam di media sosial yang kian miris ketika sudah mengarah pada justifikasi benar atau salah dan dilakukan oleh orang yang tidak berkompeten di bidang hukum Islam. Fenomena ini termati karena kurang mendalamnya pengetahuan fiqh yang dimiliki oleh mereka yang berdebat dan kurangnya kesadaran mereka akan keniscayaan perbedaan dalam dunia hukum Islam. Hal inilah yang mendorong untuk dilakukan sebuah kajian dengan fokus tujuan pada bagaimana faktor penyebab fiqh selalu ikhtila>f dan bagaimana penerapan fiqh di tengah ikhtilaf fiqh madhhab yang ada. Dengan menngunakan model penelitian kepustakaan dan dengan analisa kualitatif dengan model berfikir desriptif-analitis, disimpulkan bahwa: Pertama, faktor penyebab fiqh selalu ikhtila>f adalah aspek teoritis dan aspek praktis yang ada dalam fiqh itu sendiri. Kedua, di tengah ikhtila>f madhhab hanya fiqh yang sesuai dengan kondisi lingkungan dan masyarakat yang dapat menjadi hukum yang hidup dan efektif di masyarakat sehingga tidak memberatkan masyarakat secara umum dan tidak menimbulkan dampak sentimen antar golongan. Hal ini sesuai dengan asas penerapan hukum Islam berupa penciptaan keringanan (takhfi>f), kemudahan (taysi>r) dan penolakan bahaya serta kerusakan yang kesemuanya secara nyata dan jelas berorientasi pada maqa>s}id shari>’ah dan mas}lah}at.

Abstract

Paragraph 1, article 6 KHI and fiqih madzhab hanafiyyah both state the mandatory approval of the prospective bride. The similarity between the two raises the proposition that the article on women's consent in the KHI is relevant to the hanafiyyah school of thought. But in reality, the logical formulation sequence of the hanafiyyah version of the agreement law is built on the basic understanding that women have rights rather than their guardians so that guardians have no rights in marriage, seemingly incompatible with the Islamic Law Compilation. This encourages the importance of the hadith study on women's consent. Through a literature review (library research) with a comparative analytical descriptive model, it is concluded; First, the hadith for women's consent is understood by hanafiyyah that women are more entitled than their guardians to the agreement, contract and other things. In other languages, guardians do not have rights over their daughters so that guardians are not a condition or harmonious in marriage. Second, there is no relevance between KHI and fiqih madzhab hanafiyyah, because in the legal construction between the two is different, where women's approval of their marriage in the hanafiyyah school is based on the basic stipulation that the guardian does not have the authority to approve or marry so that the guardian is not needed in marriage, while KHI states that women only have the authority to approve their marriage while still giving marriage authority to the guardian of marriage.
