Abstract

ABSTRAK Penelitian dilatarbelakangi adanya surat pernyataan di larang menikah bagi siswa-siswi Sekolah Menengah Pertama di kota Surakarta-Solo, kemudian di cabut kembali oleh pihak sekolah. Aturan sudah berlaku selama lima tahun, pencabutan dilatarbelakangi oleh keinginan dari orang tua murid. Faktanya tidak sedikit usia anak Sekolah Menengah Pertama saat sekarang sudah banyak yang menikah. Melalui metode penelitian hukum yang normatif mengkaji permasalahan berkenaan surat larangan menikah dan kemudian melihat alur kebijakan politik hukum yang melahirkan kebijakan terhadap batas usia perkawinan. Pembahasan memfokuskan pada politik hukum nasional tentang batas usia perkawinan untuk laki-laki dan perempuan dengan melihat fenomena di dunia Pendidikan. Dilihat dari usia minimal, kemudian seperti kegelisahan pemerintah melihat dunia pendidikan, lahirnya putusan Mahkamah Konstitusi disambut oleh lahirnya undang-undang untuk membatasi usia pernikahan menjadi sembilan belas tahun. Peraturan dalam bentuk undang-undang berkenaan dengan pembatasan usia minimal pernikahan pada dasarnya bukan merupakan undang-undang Apabila ada yang kelihatanya tidak setuju dengan aturan dilarang menikah di tingkatan Sekolah Menengah Pertama juga pada dasarnya memiliki tujuan yang sama yakni untuk mengantisipasi pernikahan dini. Kata kunci: kebijakan; perkawinan; politik hukum. ABSTRACT This research is based on the existence of a forbidden marriage for junior high school students in Surakarta-Solo City which was later withdrawn by the school. This rule has been in effect for five years, its repeal is motivated by the wishes of the parents of students. Facts in the field, many junior high school children are now married. Through the normative legal research method, it examines these problems and then looks at the flow of legal political policies that give rise to policies regarding the age limit of marriage. The discussion focused on legal policy that develops in society regarding the rules of marriage as seen from the minimum age, then like the government's anxiety in seeing the world of education, the birth of the Constitutional Court decision was greeted by the birth of a law to limit the age of marriage to nineteen years. Regulations in the form of laws regarding the minimum age limit for marriage are not laws that are coercive, pervasive as a form of anti-education and child protection in Indonesia. If someone seems to disagree with the prohibition rules for marriage at the junior high school level, they have the same goal, namely to anticipate early marriage. Abstract

This article is intended to examine the movement of political parties towards the castration of village democracy. Based on two studies conducted before and after the birth of Law Number 6 of 2014 concerning Villages. Marking the economy and the domination of the village elite are clearly illustrated in winning Pilkades. The dominance of clients who are concerned with the services of their parents or siblings who have been approved as village heads. Issues that will be the subject of discussion concern the role of party wings in the process of castration of village democracy. The selection of political parties is not seen in the castration of village democracy. It turns out that the people who control the candidates are those who are involved in political wing organizations. Political organizations have no restrictions as long as they do not prioritize political parties. This situation basically depicts my organization as indirect politics which has castrated village democracy. The organizational movement of the political wing in the village is a problem that is determined by the political parties which include its regulation. The election of village heads in the political process related to the political interests of the people, local politics regulates more influences on the daily life of national politics. The political wing organizations have unwittingly castrated democracy at the village level. Ideally, the village as a laboratory for national democracy should serve as a model and limit the excessive role of politics in achieving democracy nationally.

Abstract

Introduction: This study aimed to examine the legal dialectic over the age limit for marriage and political rights in Indonesia. It was promoted by a new marriage regulation stipulating the minimum age of nineteen years for men and women. This regulation correlates with the rules containing the minimum age limit, necessitating a further discussion.Objective: Previous studies on the minimum age limit did not focus on the law dialectic.Methodology: There are contradictions between the normative method of law and the idea of legal dialectics. The conclusions were drawn inductively.Findings: There are inequalities in several laws and regulations over the minimum age. The legal products, including a minimum age, are specific to certain laws and actions. The marriage dispensation has broken through higher laws, significantly impacting political rights. Therefore, positive law that ideally becomes a thesis turns into an antithesis due to the dispensation.Paper Type: Research Article

Abstract

Mekanisme pengawalan demokrasi, bidang pengawasan memiliki Bawaslu yang kewenangan dan tugasnya melekat pada UU No. 7/2017 tentang Pemilu. Bawaslu sendiri tidak diberikan melakukan mengawasan atas mekanisme Pemilihan Kepala Desa (Pilkades) yang dapat mengarah pada politisasi desa. Penelitian mendiskusikan kemungkinan dilema hukum perluasan pengawasan dilakukan atas mekanisme demokrasi desa terutama dalam Pilkades. Metode penelitian pada diskusi dilema hukum Bawaslu atas mekanisme demokrasi desa dilakukan dengan cara pendekatan yuridis normatif, dengan menitikberatkan data penelitian kepustakaan. Metode analisis yang digunakan dalam analisis data dalam penelitian adalah analisis yuridis kualitatif dengan melihat pada permasalahan yang ada dihubungkan dengan peraturan-peraturan sebagai hukum postif, untuk kemudian dianalisis secara kualitatif. Perjalanan perubahan nama dari Panwaslu jadi Bawaslu sebagai langkah mau dalam bidang pengawasan Pemilu belum diimbangi dengan sentuhan pada pengawasan Pilkades. Ironis kemajuan Bawaslu kurang terlibat dalam pengawasan Pilkdesa meningat desa sebagai laboratorium demokrasi sangat besar terjadinya money politic jika dibandingkan dengan Pemilu ataupun Pilkada. Namun kenyataannya peran Pemerintah Daerah terkesan membiarkan dan kemungkinan besar arena Pilkades banyak dimanfaatkan untuk kepentingan Kepala Daerah. Maka untuk menghidari keadaan tersebut, sudah selayaknya Bawaslu dilibatkan langsung dalam pengawasan Pilkades tersebut. Namun peran Bawaslu sendiri telah mengalami dilema secara hukum untuk melakukan pengawasan Pilkades.

Abstract

Credit for banks is the main activity, because the largest income from banks comes from the credit sector that is almost 95% of the sector either in the form of interest, provision, or other income. The amount of credit disbursed will determine the profitability and business continuity of a bank. Therefore, lending should be done well, starting from the planning of the credit, the determination of interest rates, crediting procedures, credit analysis, to the return on credit jams. While the importance of lending activities is a strategic function of the bank and this function is also often the cause bankrutnya a bank. This study aims to find out about: 1) What is the legal basis that allows Decree (SK) Civil Servants can be used as collateral by the debtor to the creditor. 2) How the settlement process will be taken by the creditor (bank) in case of legal conflict (Bad Credit). 3) What is the juridical liability of the banker against customer bad debts. The approach method used in this research is juridical-empirical. The juridical-empirical approach method, which is an approach that examines secondary data first and then proceed with conducting primary data research in the field. Or in other words, this research is carried out by conducting assessment and processing of research data with the starting point on the legal aspects of normative accompanied by theoretical legal studies, supported by empirical facts in the field. The results showed that the PNS Teacher Educator Certificate requirement for civil servant teachers get professional allowance so that teachers can be a legal guarantee in banking law and credit law principles. In the event of a non-performing loan, the bank shall have the right to settle both peacefully and through due process of law. In addition, since PD BPR Astanajapura is a Rural Bank which is a Regional Enterprise (BUMD), then bankers have juridical responsibility for customer bad debts because it is detrimental to the state's wealth. Abstract

This study has two issues of study in its discussion, the first is a study that is directed to find out and analyze the duties, functions and authorities of the Village Consultative Body (BPD) from the point of view of positive law in Indonesia, and secondly, this study will also discuss how the role and implementation of BPD functions in overcoming and preventing the spread of Covid-19 in their respective villages. This research is a juridical-empirical research that tries to explain the role of BPD in a predetermined research location, namely in Kaliwedi Kidul Village, Kaliwedi District, Cirebon Regency, this study uses primary data as the main data, the primary data as intended by the author is obtained through the data collection techniques used with unstructured observations and interviews, the results of the study show that legally the BPD has a function, namely the legislative function at the village level, the BPD and the village head have an obligation to make a policy in the form of village regulations, however, in Kaliwedi Village, the implementation of this function has not been able to implemented optimally, especially when it is associated with the formation of village regulations concerning the issue of preventing the spread of Covid-19, so it is necessary that in the future BPD can cooperate with village heads, to make policies to overcome Covid-19 in their villages, this is important so that prevention the spread of Covid-19 can have a strong legal basis down to the village level. Abstract

In the context of regulation regional enforce, the first element as implementer in field is regional government. In this case the authority is given to the Civil Service Police Unit (Satpol PP). The civil service police unit has the job is help the Regional leader to create a peace and orderly, so that the administration of the wheels of government can run smoothly and people or society can do their activities safely. One of the objectives of Regional Regulations (PERDA) issued by regional governments (PEMDA) is to guarantee legal certainty, create and maintain public order and order. The Civil Service Police is a local government apparatus with the main jobs is enforce of regional regulations, organizing public order and public order. If connected with the performance of the civil service police Organizational of Cirebon district, so the evaluation performance is carried out based on the job that carried out. The purpose of this study is to describe how the performance of the civil service police of Cirebon district in the job of enforce the local regulation base on regional regulation in Cirebon district.
