Abstract

The purposes of this research are: first, to identify and analyze the arrangement of the consultant responsibilities in making the AMDAL in Indonesia; second, to analyze and criticize the implementation of the consultant responsibilities in making the AMDAL in Bangka Belitung. Based on these purposes, so the issues that have been discussed are: first, how the arrangement of the consultant responsibilities in making the AMDAL in Indonesia?; second, how the implementation of the consultant responsibilities in making the AMDAL in Bangka Belitung?. To discuss these issues, conducted empirical legal research with the type of research the effectiveness of the law. This research proved, that: first, the consultant responsibilities in making the AMDAL regulated by the Act Number 32 of 2009 years, and the Environment Minister Regulation Number 7 of 2010 years; second, the consultant responsibilities in makin AMDAL will be completed to the extent of agreement with the proponent. Therefore, the recommendations of this research are: first, needed to optimize the enforcement of the Act Number 32 of 2009 years, and the Environment Minister Regulation Number 7 of 2010 years; second, needed more specifically regulation concerning the recognition in makin the AMDAL document.

Abstract

Kerinci Seblat National Park (TNKS) is a conservation area which the rich in biodiversity that has been recognized internationally as a World Heritage Site. Based the Act Number 41 of 1999 years, that the supervision of TNKS implemented by the government while respecting the indegineous people. However, TNKS protection is often overlooked. There are many problems in to the protection the TNKS, such as illegal logging, burning and destruction of the ecosystem in the TNKS area. Cause of that, goverment mush be to make the rule about the protection of TNKS with the suistanable development concept.

Abstract

The more banks offer a number of products to the public, the possibility of a dispute between banks and customers is increasingly wide open as well. The existence of the customer service department in the bank is more than just a small talk. In the execution of its daily duties, in the banking world there are also frequent disputes between banks and their customers. In fact, not infrequently the dispute settlement that is used to bring the disputing parties to the world of justice that seem convoluted and long-winded. Therefore, any banking dispute requires fast and precise settlement efforts, and is empowered to achieve mutual interests.

Abstract

Verdict Sungailiat Court Number 03/Pdt.G/2012/PN.Sgt in the verdict has stated the defendant (Feng Jung) has committed acts againts the law by certifying a plot of land to a National Land Agency of Bangka Regency on the Right Certificate Number 2305 was issued by the National Land Agency if Bangka Regency in 2003, but was sued by the plaintiff (Tjong Ana) in 2012. The results of research, Paragraph 32 Sentence 2 of Government Regulation Number 24 of 1997 have been fulfilled by defendant in conducting process of land registration of Certificate of Property Number 2305 so that this provision is absolutely to run and about absolute authority to run about absolute authority of judge, that a judge of a Public Court is not authorized to declare a Certificate of Property Number 2305 has no legal force, and certificate that is a powerful evidentiary tool has become an absolute if element of Paragraph 32 Sentence 2 of Government Regulation Number 24 of 1977 has been fulfilled.

Abstract

Mining is one of the sectors that becomes an economic country’s support until now. Environmental issues is kind of difficult things and can’t even be separated from mining activities. Belitung island is as part of the largest tin-producing province in Indonesia that has been exploited since the 18 century. It also has experienced the environmental crisis as well as other mining areas has in Indonesia. This research is conducted as an effort to discover and unravel the problematic implementation of reclamation on the ex-tin mine’s land in Belitung Island by using a conceptual approach and legislative approach. Based on the observation’s result, it shows that the reclamation’s result in Belitung Island has not been successful. Data from PT Timah (Persero) Tbk about the reclamation in Belitung Island also shows that the realization is far from the plan. There is no target that achieved successfully every year, also there is no reclamation that reaches 50 percent, the maximum is only 25 percent in 2016. th

Abstract

Law enforcement against criminal acts without a permit (illegal mining) must be carried out for the sake of social justice for all Indonesian people. The Bangka Resort Police, as one of the institutions of the Indonesian National Police, has duties and obligations in realizing ideal conditions both in law enforcement efforts and other persuasive efforts, must be fast and responsive in tackling illegal mining. In this regard, this research aims to examine law enforcement problems of illegal tin mining in realizing restorative justice with the locus of study, namely the Bangka Resort Police. The formulation of the problem studied in this research is as follows. First, what are the legal issues to realizing restorative justice in the enforcement of illegal tin mining crimes by the Bangka Resort Police? Second, how are the efforts of the Bangka Resort Police to overcome the obstacles in law enforcement against the criminal act of illegal tin mining? The legal problems that occur involve various dimensions, namely the dimensions of competence, personnel commitment, supporting facilities and infrastructure, and issues from the social environment of the community. Multiple efforts have been carried out by the Bangka Resort Police in the internal aspect and implementing progressive actions as a form of dedication by law enforcement officials.

Abstract

Hak ulayat merupakan serangkaian wewenang dan kewajiban suatu masyarakat hukum adat, yang berhubungan dengan tanah yang terletak dalam lingkungan wilayahnya, merupakan pendukung dan penopang utama penghidupan dan kehidupan masyarakat yang bersangkutan sepanjang masa, termasuk tanah hak ulayat. Penegasan terhadap pengakuan tanah hak ulayat tersebar dalam berbagai peraturan perundang-undangan, dan tidak diatur secara implisit dalam satu peraturan, oleh karenanya pengaturan hak ulayat seringkali membawa permasalahan hukum di tengah-tengah masyarakat. Penelitian ini dilakukan dengan metode yuridis normatif dengan pendekatan konseptual (conceptual approach), dan pendekatan perundang-undangan (normative approach). Hasil penelitian ini membuktikan, bahwa pengautran hak ulayat terdapat pada berbagai berbagai peraturan perundang-undangan. Hal ini secara hukum membawa implikasi jika hak ulayat tidak hanya mendapat pengakuan secara hukum, namun juga terdapat pengingkaran terhadap hak ulayat itu sendiri.

Abstract

Penelitian ini merupakan penelitian yang menelaah secara yuridis mengenai Badan Penyelesaian Sengketa Konsumen sebagai alternatif dalam penyelesaian sengketa konsumen yang diatur dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen Penelitian ini dilakukan dengan metode yuridis normatif dengan pendekatan perundang-undangan. Hasil penelitian ini membuktikan, bahwa Badan Penyelesaian Sengketa Konsumen merupakan bentuk alternatif dalam penyelesaian sengketa konsumen yang kewenangannya diberikan oleh amanat Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Oleh karena itu, penyelesaian sengketa konsumen sebaiknya dilakukan melalui Badan Penyelesaian Sengketa Konsumen, hal ini dikarenakan bahwa terdapatnya perpaduan antara Konsumen, Pelaku Usaha dan Pemerintah yang merupakan kekuatan dalam menyelaraskan konflik

Abstract

Sewage pollution originating from the activities of shrimp farming companies in the Pasir Kuning Beach area raises serious concerns about its impact that damages the environment and disrupts the balance of the ecosystem. This research aims to understand and analyze the inclusiveness of social capital in local communities as an effort to prevent sewage pollution. Using a qualitative approach, this research conducted in-depth interviews with community members in the Pasir Kuning Beach Area. Respondents were selected based on criteria that ensured a balanced representation of various community groups, and secondary data was used to provide a broader context. The research findings highlight the central role of social capital in shaping relationships, trust, and cooperation among communities. The implications include developing more effective sewage pollution prevention strategies and providing a foundation for understanding community contributions to coastal ecosystem conservation. The focus on social capital inclusivity as a catalyst for positive change demonstrates the determination of local communities to overcome the negative impacts of shrimp farming activities. In the context of Bangka Belitung, which is affected by the mining sector, this research is significant in efforts to reduce environmental damage. It is hoped that these findings provide valuable insights for stakeholders in formulating sustainable solutions that support the ecology and well-being of local communities in the future.
