Abstract

The book term of Geographical Indication is a prerequisite for protecting Pandanwangi and Cianjur rice as Geographical Indication products since its registration requirements must be equipped with Geographical Indications book which provides us with a comprehensive and detailed description of the quality, reputation, and distinctive character of the product. Thus, it is highly suggested that the applicant institution represents the stakeholders of Pandanwangi and Cianjur rice have great competence and well expertise to its formulation in accordance with the applicable rules. On this basis, the research problems in this study are formulated as follows, first, are there any obstacles found in the compilation of the Book Term of Geographical Indications of Pandanwangi and Cianjur Rice? Second, how is the Participatory Model in compiling the Book Term of Geographical Indications? The method used in this study is a socio-legal research based on the approach of legal science and social sciences. The study concluded that, first, the constraints in the preparation of the Book Term of IG of Cianjur and Pandanwangi Rice include technical constraints, the legal culture of the society, and the lack of understanding of the benefits of IG protection. Second, a participatory model to guide the preparation of the Terms of IG of Cianjur and Pandanwangi Rice is applied through active cooperation between the Government, AP3C, and Universities.

Abstract

Geographical Indication Registry Mechanism was introduced as the first step to gain exclusive economy right for local products. A socialization toward the mechanisms, therefore, was inevitably for the community of ubi cilembu farmers in Sumedang District of West Jave Province.  In order to implement  socialization process,  several participants represented variety of stakeholders in community of ubi cilembu farmers were elected. By  employing two way lecturing method that inviting lively interactive discussion among participants, the aim of socialization process was to promote  awareness  among  participants  toward the importance of Geographical Indication Registry Mechanism.  As a result, participants agreed to establish representative institution for their product and to register their poduct legally for Geographical Indication rights.

Abstract

Protecting  potential geographic indication (GI) product within country territory is as an effort to optimalize potential economic  development. On the other hand, it is best viewed as a method to halt misusing of mark or  indication  by other party  from  other  region/country.   Lack  of knowledge concerning the importance and role of GI protection resulted the malfunction of GI economic right. This paper employed a sociolegal research to analyze legal aspects of geographic indication in the level of community. Considering the importance of GI, a local regulation to ensure fairness toward community for functioning GI rights is needed. The local regulation is best formulated by Proportional Finance Distribution approach for Regions and Villages.

Abstract

Hukum positif membuat kepatutan dan kewajaran dijadikan ukuran dalam pelaksanaan tanggung jawab sosial, kepatutan dan kewajaran begitu banyak makna sehingga sulit untuk digunakan sebagai ukuran dalam pelaksanaan tanggung jawab sosial perusahaan. Bahkan ada yang menyamakan bahwnyanya tanggung jawab sosial perusahaan mirip dengan kewajiban zakat dalam hal ini adalah zakat perusahaan. Namun, zakat itu sendiri dalam hukum positif telah ditetapkan pada kewajiban zakat.Dalam pandangan hukum Islam sendiri diartikan kepatutan dan keadilan yang berfungsi sebagai ukuran pelaksanaan tanggung jawab sosial sudah dijelaskan secara implisit atau secara implisit, kemudian dijelaskan dalam opini ulama yang menyatakan bahwa cocok dan keadilan harus memenuhi persyaratan uamat dan tidak bertentangan dengan hukum Islam.

Abstract

Penelitian ini mengkaji permasalahan: pertama, tanggung jawab direksi perusahaan asuransi dalam investasi beresiko tinggi yang di dalamnya terdapat Conflict of Interest. Kedua, penerapan prinsip piercing the corporate veil kepada direksi yang melakukan investasi beresiko tinggi yang mengandung Conflict of Interest. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian ini menyimpulkan: pertama, Direksi Jiwasraya sebagai pemegang amanah dalam mengelola perusahaan bertanggung jawab tidak saja kepada shareholder tetapi juga kepada stakeholder. Tanggung jawab tersebut berupa pencairan polis yang telah jatuh tempo. Selain itu direksi juga dapat bertanggung jawab secara pribadi sebagaimana tercantum dalam Pasal 97 ayat (3) UUPT. Kedua, Selain bertanggung jawab sebesar nilai saham yang disetorkannya, direksi Jiwasraya juga dapat dituntut pertanggungjawaban hingga kekayaan pribadinya sesuai dengan doktrin piercing the corporate veil karena direksi Jiwasraya telah melanggar Pasal 97 ayat (2) dimana direksi dalam menjalankan tugasnya tidak dengan itikad baik dan penuh tanggung jawab.

Abstract

Abstract. Article 43 Paragraph (2) of the Cooperative Law provides services for cooperatives to the public and this rule has been reaffirmed by the Job Creation Act, thereby worrying that the practice of savings and loan cooperatives with the lure of high interest rates will occur again. Until now, there are many cases of savings and loan cooperatives that serve non-members so that the savings and loan cooperatives. Therefore, the researcher wants to examine how the juridical review of cooperative services in saving and loan activities to the community according to the Job Creation Law and PP No. 7 of 2021 with the analytical method used by the historical interpretation method. The practice of savings and loan cooperatives for non-members resembles shadow banking because the practices both offer investment. Cooperatives do not involve non-members to participate in determining the interest even though the interest set must be discussed together in the members' meeting. With the occurrence of the case of savings and loan cooperatives, this means that the cooperative does not fulfill its purpose, namely the welfare of its members. The Job Creation Act regulates the provisions of cooperatives to serve non-members, finally PP No. 7 of 2021, which excludes savings and loan cooperatives from serving the community Abstrak. Pasal 43 Ayat (2) UU Perkoperasian koperasi dibuka pelayanannya kepada masyarakat dan aturan ini dikukuhkan lagi UU Cipta Kerja sehingga mengkhawatirkan praktik koperasi simpan pinjam iming-iming bunga tinggi terjadi lagi. Sampai saat ini banyak sekali kasus koperasi simpan pinjam yang melayani non anggota sehingga koperasi simpan pinjam. Maka dari itu peneliti ingin meneliti bagaimana tinjauan yuridis pelayanan koperasi dalam kegiatan simpan pinjam kepada masyarakat menurut UU Cipta Kerja dan PP No. 7 Tahun 2021 dengan metode analisis yang digunakan metode penafsiran historis. Praktik koperasi simpan pinjam kepada non anggota menyerupai shadowbanking karena praktiknya yang sama-sama menawarkan investasi. Koperasi tidak melibatkan para non anggotanya untuk ikut melakukan penetapan bunga padahal bunga yang ditetapkan harus didiskusikan bersama-sama dalam rapat anggota. Dengan terjadinya kasus koperasi simpan pinjam ini artinya koperasi tidak memenuhi tujuannya yaitu mensejahterakan anggota. UU Cipta Kerja mengatur ketentuan koperasi dapat melayani non anggota, akhirnya terbitlah PP No. 7 Tahun 2021 yang isinya mengecualikan koperasi simpan pinjam untuk tidak melayani masyarakat.

Abstract

Abstract. The Covid-19 Pandemic in Indonesia is currently having a significant impact on the community's economy, one of which is savings and loan cooperatives. The problem at this time is that not all savings and loan cooperatives in Indonesia are based on kinship, all problems should be resolved through member meetings, in fact it is through the courts, one of which is the commercial court. In the case of the Sharia Savings and Loans and Financing Cooperative (KSPPS) Berkah Bersama and the Hanson Mitra Mandiri Cooperative, they were recorded to have small assets compared to their total debt. Therefore, this study aims to determine and analyze the legal protection of members as concurrent creditors in the bankruptcy of savings and loan cooperatives during the covid-19 pandemic. The researcher used normative legal research methods using descriptive analysis research specifications, the research phase used library research, data sources and data collection techniques used through library research using secondary data sources consisting of primary, secondary, and tertiary legal materials, and methods Data analysis used qualitative analysis. The results of this study are: The form of legal protection and efforts provided by the government is the existence of Articles 1131 and 1132 of the Civil Code which guarantees that the distribution of debtor assets to creditors is in accordance with the principle of paripassu and pro rata that is divided proportionally, through the Regulation of the Minister of Finance of the Republic of Indonesia Number 85 /PMK.05/2020, as well as by forming a task force for handling problematic cooperatives. (max. 250 words). Abstrak. Pandemi Covid-19 di Indonesia saat ini memberikan dampak yang signifikan terhadap perekonomian masyarakat, salah satunya koperasi simpan pinjam. Permasalahannya saat ini, tidak semua koperasi simpan pinjam yang ada di Indonesia berasaskan kekeluargaan, yang seharusnya segala permasalahan diselesaikan melalui rapat anggota, dalam faktanya justru melalui jalur pengadilan, salah satunya adalah jalur pengadilan niaga. Dalam kasus Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) Berkah Bersama dan Koperasi Hanson Mitra Mandiri tercatat mempunyai asset yang kecil dibandingkan dengan total utangnya. Maka dari itu penelitian ini bertujuan untuk mengetahui dan menganalisis perlindungan hukum terhadap anggota sebagai kreditor konkuren dalam kepailitan koperasi simpan pinjam pada masa pandemi covid-19. Peneliti menggunakan metode penelitian hukum normatif dengan menggunakan spesifikasi penelitian deskriptif analisis, tahap penelitian yang digunakan studi kepustakaan, sumber data dan teknik pengumpulan data yang digunakan melalui studi kepustakaan dengan menggunakan sumber data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier, dan metode analisis data yang digunakan analisis kualitatif. Hasil dari penelitian ini adalah: Bentuk perlindungan hukum dan upaya yang diberikan pemerintah yaitu dengan adanya Pasal 1131 dan 1132 KUH Perdata yang menjamin agar pembagian harta debitur kepada krediturnya sesuai prinsip paripassu dan pro rata yaitu dibagi secara proporsional, melalui Peraturan Menteri Keuangan Republik Indonesia Nomor 85/PMK.05/2020, serta dengan membentuk satuan tugas untuk penanganan koperasi bermasalah. Abstract

Abstract, Cooperatives are business entities that uphold the principle of kinship as contained in Article 33 paragraph 1 of the Constitution. In a cooperative, satisfactory service is something that needs to be considered for the continuity of the cooperative's business. This cooperative effort is a business that is directly related to the interests of members to improve the business and welfare of members. However, Article 43 paragraph (2) of the Cooperative Law states that Cooperative services can not only be provided to members, but also to non-members.Therefore, the purpose of this study is to determine the business activities of cooperatives whose services are provided to members and non-members in terms of juridical and philosophical aspects.The research method used is a normative juridical approach by researching from library materials or secondary data. and in this approach the researcher will examine the adequacy of the juridical and philosophical aspects of the service business by the cooperative through library research as a secondary data collection method.Cooperatives whose goal is to prosper members can in fact be carried out also to the community through the advantages of cooperative business service capabilities for members. Which is after the members are prospered and given the benefits of services/business by the cooperative, people who are not members can be provided with business services as business transactions by the cooperative from the excess funds and resources owned by the cooperative. All of this is done to attract people to become members of the cooperative. and this provision does not apply to savings and credits cooperatives and savings and credits units. Abstrak, Koperasi merupakan badan usaha yang menjunjung tinggi asas kekeluargaan sebagaimana terdapat pada Pasal 33 ayat 1 Undang-undang Dasar Didalam suatu Koperasi pelayanan yang memuaskan merupakan hal yang perlu diperhatikan bagi kelangsungan usaha Koperasi. Usaha Koperasi ini merupakan usaha yang berkaitan langsung dengan kepentingan anggota untuk meningkatkan usaha dan kesejahteraan anggota. Namun pada Pasal 43 ayat (2) UU PerKoperasian menyebutkan bahwa pelayanan Koperasi tidak hanya dapat dilakukan pada anggota, tetapi masyarakat yang bukan anggota juga.Maka dari itu tujuan dari penelitian ini bertujuan untuk mengetahui Kegiatan Usaha Koperasi yang pelayanannya dilakukan kepada Anggota dan Bukan anggota Ditinjau dari Aspek Yuridis dan Filosofis.beserta implementasi kegiatan usaha Koperasi yang pelayanannya dilakukan kepada Bukan anggota dihubungkan dengan tujuan Koperasi. Metode penelitian yang digunakan adalah metode pendekatan yuridis normatif dengan cara meneliti dari bahan pustaka atau data sekunder belaka. dan dalam metode pendekatan ini peneliti akan mengkaji kecukupan aspek yuridis beserta filosofisnya mengenai usaha pelayanan oleh Koperasi melalui penelusuran pustaka sebagai metode pengumpulan data sekunder.Koperasi yang tujuannya mensejahterakan anggota nyatanya dapat dilakukan juga kepada masyarakat melalui kelebihan kemampuan pelayanan usaha koperasi terhadap anggota. Yang mana setelah anggota disejahterakan dan diberi manfaat atas pelayanan/bisnis oleh koperasi, masyarakat yang bukan anggota dapat diberikan pelayan usaha sebagai transaksi bisnis oleh koperasi dari kelebihan dana dan daya yang dimiliki koperasi tersebut. Semua itu dilakukan agar menarik masyarakat menjadi anggota koperasi. dan ketentuan ini tidak berlaku untuk koperasi simpan pinjam.dan unit simpan pinjam.

Abstract

This study examines the following issues: first, whether the merger of 3 state-owned sharia banks is included in the criteria for monopolistic practice as an activity prohibited in the Law on monopolistic practices and unfair business competition. Second, what is the relevance of the provisions of the exclusion of monopolistic practices on BUMN in the Law on monopolistic practices and unfair business competition to the merger of 3 BUMN sharia banks. This study uses a normative juridical method. The results showed that the merger or merger of 3 state-owned sharia banks could potentially lead to monopolistic practices and unfair business competition as prohibited by Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition.
