Abstract

AbstrakPelaksanaan lelang dengan jaminan hak tanggungan menuntut adanya perlindungan hukum terutama bagi peserta lelang yang telah dinyatakan sebagai pemenang lelang. Pada praktek dimasyarakat, banyak kasus yang terjadi dalam pelaksanaaan lelang. Salah satu kasus yang terjadi di kantor wilayah DJKN Sumatera Utara KPKNL Medan adalah, penjualan lelang (online) yang tertuang dalam Kutipan Risalah Lelang nomor 132/04/2019, Pemenang lelang (online) dapat melakukan balik nama namun tidak bisa menguasai objek lelang karena Pemilik tidak mau meninggalkan dan mengosongkan objek lelang. Akibat tindakan tersebut, Pemenang lelang mengalami kerugian. Adapun permasalahan dalam penelitian ini, antara lain: Bagaimana pelaksanaan lelang on line eksekusi hak tanggungan menurut peraturan perundang-undangan yang berlaku di Indonesia sebelum dan sesudah PMK Nomor 213/PMK 06/2020 tentang pelaksanaan lelang, Bagaimana kendala pelaksanaan pengosongan objek lelang (online) eksekusi hak tanggungan terkait risalah lelah nomor 132/04/2019 di Kantor KPKNL Medan. Bagaimana  perlindungan hukum  terhadap pemenang lelang on line atas pengosongan dan penguasaan  objek lelang eksekusi hak tanggungan merujuk pada Risalah Lelang Nomor 132/04/2019. Perlindungan hukum  terhadap pemenang  lelang (online)  atas pengosongan dan  penguasaan objek lelang eksekusi hak tanggungan merujuk pada Risalah Lelang  Nomor 132/04/2019 adalah berupa   hak  pemenang  lelang belum mendapatkan kepastian hukum. Perbuatan debitur (Pemilik Objek Lelang) yang menolak melakukan pengosongan objek lelang eksekusi hak tanggungan telah memenuhi  unsur-unsur perbuatan melawan hukum yang terdapat dalam Pasal 1365 KUHPerdata. Tentu saja biaya penetapan pengosongan menjadi beban bagi si pemanang lelang menanggung biaya dan waktu penetapan pengosongan. Kata Kunci : Perlindungan Hukum, Pemenang Lelang (online)  , Hak Tanggunggan, Risalah Lelang  AbstractThe implementation of an auction with a mortgage guarantee demands legal protection, especially for auction participants who have been declared winners of the auction. In practice in the community, many cases occur in the implementation of the auction. One of the cases that occurred at the Regional Office of the DJKN North Sumatra KPKNL Medan was, the sale of (online) auctions as stated in the Quotation Minutes of Auction number 132/04/2019, the winner of the (online) auction could change his name but could not control the object of the auction because the owner did not want to leave and empty the auction object. As a result of this action, the auction winner suffers a loss. The problems in this research, among others: How is the implementation of the (online) auction of mortgage executions according to the laws and regulations in force in Indonesia before and after PMK Number 213/PMK 06/2020 regarding the implementation of the auction, How are the obstacles to the implementation of emptying the object of the (online) auction of the execution of rights? dependents regarding the fatigue report number 132/04/2019 at the Medan KPKNL Office. How is the legal protection for the winner of the (online) auction for the emptying and control of the auction object for the execution of the mortgage, referring to the Minutes of Auction Number 132/04/2019. Legal protection for the winner of the (online) auction for the emptying and control of the auction object for the execution of mortgage rights referring to the Minutes of Auction Number 132/04/2019 is in the form of the right of the winner of the auction not getting legal certainty. The act of the debtor (Owner of auction Object) who refuses to empty the auction object for the execution of the mortgage has fulfilled the elements of an unlawful act contained in Article 1365 of the Civil Code.
