Abstract

Intellectual property is not only beneficial for the creator, but also the community as users of products and/or services protected by intellectual property. The more intellectual property created, the better for legal subjects or business entities that are legal entities or not legal entities because they can increase the intellectual capital value of the person and/or company. The author's purpose in analyzing this is to qualitatively examine the relationship between intellectual property and the addition of the intellectual capital value of a company and whether some changes in the regulations in Law Number 11 of 2020 concerning Job Creation can affect the intellectual capital of a company. This research method is normative juridical which will explore some secondary literature, which consists of Law Number 11 of 2020 concerning Job Creation, laws and regulations related to intellectual property, books, journals, and papers related to intellectual property and intellectual capital. Research shows that the more intellectual property owned by a company that is sold in the community can increase the intellectual capital of a company. Changed arrangements related to patents and trademarks in Law Number 11 of 2020 concerning Job Creation can affect the company's intellectual capital in terms of capital structure and changes to the regulation on patent implementation can increase intellectual capital for all categories, namely human capital, structure capital, and physical /customer capital.

Abstract

Intellectual properties are not only beneficial to their creators, but also to the common public who uses the products and/or services that contains protected intellectual properties. The more intellectual properties created, the better for the subject of law or the incorporated and non-incorporated business entity since it increases intellectual capital value of the person or the business entity.  The purpose of the author in analysing this matter is to qualitatively review the relation between intellectual property and the increase of intellectual property value of a corporation and whether the change of regulation in Act number 11 of 2020 on Job Creation affects a corporation’s intellectual capital in Indonesia. The authors didn’t find any similar research on the topic that the author chose in this study. The method of this research is normative-juridical in nature and takes references from secondary literatures including Act number 11 of 2020 on Job Creation, regulations regarding intellectual properties, books, journals, and articles related to intellectual properties and intellectual capitals. This research shows that the more a corporate owns intellectual properties that yields sales, the more intellectual capital said corporate acquire. The change of regulation regarding trademarks in Act number 11 of 2020 on Job creation may impact on the intellectual capital in terms of capital structure, while the change of regulation regarding the establishment of patent may increase intellectual capital in all categories which are human capital, structure capital, and physical/customer capital.

Abstract

Aktivitas pengabdian kepada masyarakat merupakan bagian dari aktivitas penerapan ilmu pengetahuan yang dapat memberikan manfaat langsung kepada masyarakat. Fakultas Hukum Universitas Kristen Maranatha melaksanakan pengabdian masyarakat untuk mensosialisasikan pentingnya pembuatan Nomor Induk Berusaha, dan aspek hukum promosi produk melalui sosial media kepada masyarakat Kelurahan Kebonlega-Kota Bandung. Tujuan dari kegiatan pengabdian masyarakat ini adalah untuk memberikan informasi dan pendampingan teknis terkait pembuatan Nomor Induk Berusaha, dan memberikan pengetahuan kepada pelaku UMKM terkait aspek hukum dalam promosi produk melalui sosial media Usaha Mikro, Kecil dan Menengah (selanjutnya disebut UMKM). Metode yang digunakan dalam pelaksanaan abdimas ini adalah dengan melaksanakan aktivitas pendahuluan berupa pengkajian terhadap Undang-undang Nomor 20 tahun 2008 tentang Usaha Mikro, Kecil, dan Menengah yang merupakan dasar hukum pengaturan UMKM. Kemudian, dilakukan wawancara pendahuluan dengan Lurah Kebonlega terkait profil pengusaha UMKM di wilayah tersebut. Diperoleh informasi bahwa masyarakat di Kelurahan Kebonlega- Kota Bandung merupakan pengusaha UMKM di bidang produksi sepatu, usaha pangan, kerajinan aksesoris yang terbuat dari kulit seperti tas, dompet, dan sebagainya. Aktivitas inti dalam pengabdian masyarakat ini adalah penyuluhan hukum dan pendampingan pembuatan Nomor Induk Berusaha. Hasil dari kegiatan pengabdian kepada masyarakat ini menunjukan bahwa pelaku UMKM di lingkungan Kelurahan Kebonlega kota Bandung telah memiliki kesadaran tentang pentingnya memiliki NIB, dan pentingnya pengetahuan tentang promosi produk secara online. Para peserta juga telah memperoleh manfaat konkrit dari berlangsungnya kegiatan ini, di mana masyarakat langsung didampingi dalam proses pembuatan NIB dan langsung memperoleh print out NIB dari web resmi oss.go.id

Abstract

Environmental Quality Standard (environment quality standard) is intended to provide direction and guidance on environmental management in an effort to prevent and identify environmental pollution. Environmental quality and the quality of waste that has been allowed to be disposed of in environmental media can be observed thanks to the Environmental Quality Standard. Therefore, pollution and environmental damage are considered to have occurred if the quality of the environment exceeds the limits of environmental quality standards. The purpose of this study is to find out how medical waste management must be carried out based on the Regulation of the Minister of Environment. Implementation of waste disposal permits according to the Environmental Law and knowing how the law enforcement process against parties who dispose of medical waste without permits according to the Law. In this study using Normative juridical research methods. In managing the environment is based on principles related to environmental management. The provisions governing Environmental Protection and Management in the Law explain that the environment must be protected and managed properly in accordance with the principles of justice, sustainability, and state responsibility. Environmental Management Protection Permits and environmental permits are prerequisites for any business that produces medical waste. This medical waste poses a threat to society and the environment due to its nature. Thus, managing medical waste must be done through the precautionary principle by applying licensing instruments that must be properly regulated.
