Abstract

Together with decentralization and assistance tasks (medebewind), deconcentration constitutes basic principles in managing central-local government relationship. From historical point of view, the degree of deconcentration and decentralization has been up and down. Until recently, there is no single believe among Indonesian experts and officials regarding the best form of deconcentration. Therefore, deconcentration continues to transform and still searching for its best formula. Under such consideration, this paper tries to tracking back the history of deconcentration and its limitations. Before coming to conclusion, it proposes four agendas to recover the implementation of deconcentration in Indonesia, i.e. clarifying the position of the head of region, improving election system, redisgning the deconcentration affairs and authorities, and explicating goals of decentralization and deconcentration.

Abstract

Previously, government?s programs on people empowerment were considered to be failed in achieving their targets. One of the reasons is that the programs were improperly designed. At that time, policy on people empowerment was constantly associated to micro credit programs which in reality, unable to strengthen social and economic independency of the citizens. In such a case, this paper offers 5 categories of empowerment program that should be linked to 4 sectors of development, namely economic, social and cultural, political and administrative, and infrastructure dimension. Another important thing is that acceleration oof empowerment programs require political will of the government (booth in central and local level) to burst through and innovate every single public policy.

Abstract

Kebijakan desentralisasi luas yang digulirkan semenjak 1999 tidak saja dimaksudkan untuk memenuhi tuntutan reformasi, namun juga untuk mendorong terwujudnya pemerintahan yang demokratis dan berkinerja tinggi. Dalam tataran akademik, wacana tentang hubungan antara rezim demokratis dengan rezim pembangunan belum menemui titik temu. Sebagian berpendapat bahwa demokrasi merupakan produk dari proses pembangunan yang berhasil, sementara sebagian lain berargumen bahwa demokrasi merupakan prasyarat untuk dapat berjalannya pembangunan di suatu negara/daerah. Dalam upaya mewujudkan kondisi kepemerintahan lokal yang demokratis sekaligus berkinerja tinggi, kebijakan otonomi luas diyakini merupakan strategi yang tepat, sebagaimana ditunjukkan oleh contoh di negara-negara yang menerapkan kebijakan serupa. Meskipun demikian, desentralisasi juga dapat mengalami kegagalan jika tidak dikelola dengan baik. Untuk itu, desentralisasi perludiikuti dengan upaya membangun kapasitas daerah serta sinkronisasi tiga pilarkekuatan lokal menuju konsep pembangunan yang terintegrasi. Tulisan ini mencoba mengevaluasi implementasi desentralisasi di Kota Bandung. Hasil analisis mengindikasikan bahwa desentralisasi di Kota Bandung berdampak lebih signifikan terhadap penguatan demokrasi lokal dibanding terhadap peningkatan pembangunan sosial ekonomi. Meskipun demikian, untuk jangka panjang desentralisasi menumbuhkan harapan besar terwujudnya rezim pembangunan yang demokratis.

Abstract

The dispute on Ambalat Block between Indonesia and Malaysia has encouragedgovernment institutions to pay more vigilance on the promotion of developmentprograms of border areas. There is a shift of paradigm posing border-areas as the?frontyard? instead of ?backyard?. It implies that efforts on promoting borderdevelopment along North Kalimantan region call for an an emergency policy orcatch-up strategy. This comprises endeavors for establishing specific institution,providing ample amount of funds, and designing an integrated action plan on thehastening of border development. This paper portrays some essential dimensions ofborder areas such as general description and problems of border areas, the nature of Ambalat conflict, legal framework of border areas, and recommended strategies to redevelop the North Kalimantan region.

Abstract

Decentralization is widely believed to be an effective tool for promoting democratic local governance as well as a cure for bureaucratic pathology. Based on literature studies and,cross-country evidence, policy on regional autonomy promises many significant improvements in varying sectors of development. In the case of Law 22/1999, however, it does not produce expected results yet, both at local and national levels. This paper examines the correlation between decentralization framework and socio-economic development in Bandung, with special reference to the six development fields, i.e. budget management, investment, physical infrastructure, education and human development, environmental protection, and people participation and community development. The general conclusion is that there are many significant changes but only little progress. This might be caused either by incorrect implementation or insufficient time to implement the law. Whatever the causes are, this paper supports the idea of revising some parts of the law in order to create a better atmosphere of local politics.

Abstract

Following the commencement of democratic and decentralized era in Indonesia, both political and socio-economic climate has tented to be more dynamic in the grassroots level. ‘Change’ is the most prominent term found in local politics, covering three fundamental aspects, i.e. political, public administration, and constitutional law. Such changes bring about the conscience to recognize their implication and the needs to readjust the current system in line with the spirit of reform. This paper analyses five essential issues faced by local government and local people, i.e. direct election of Local Government Head, institutional arrangement, development planning system and documents, evaluation of inappropriate regional regulations, and perplexing issue on legal hierarchy. It also provides some recommendations could be taken in dealing with those issues.

Abstract

The enactment of new decentralization framework has been unwisely implemented in many regions. Districts/city governments tend to promulgate new local taxes and levies result in high cost economy for regional business activities. The principle of delivering administrative approval (perijinan) is also misgiving as it is deployed for all people’s economic facets. Philosophically, not everysingle economic activity requires such kind of permission. This situation leads to the deprivation of public service quality. In order to restore government performance in delivering public services, this paper tries to offer a solution from the perspective of constitutional / public administration law (hukum administrasi negara), i.e. providing new mechanism of administratief beroep or administrative legal efforts (upaya hukum secara administratif).

Abstract

The global issue on environmental degradation is becoming solemn concern among national and local governments. One of strategies in overcoming environmental problems, particularly in the shielding / caring areas (kawasan lindung), is to promote special institution in charge of composing plan, implementing programs, controlling and evaluating performance, as well as building strategic alliances among stakeholders to protect and improve the quality of shielding areas. This paper tries to analyze the probability of making new institutions based on “collaborative management” principles. In brief, it offers two models of such institution, namely, upstream – downstream solidarity; and central – regional solidarity.

Abstract

The promulgation of extended-decentralization policy has brought about the competition climate among district/city governments in delivering public services. The capacity to accomplish public tasks, however, tends to be insufficient. That’s why, regional-cooperation-based management is believed as the paramount mode to minimize local government’s shortage on the one hand, and to improve public accountability and performance on the other hand. In the East Kalimantan case, the tradition of conducting public affairs through collaborative management seems to be disregarded. Nevertheless, the prospect to intensify regional cooperation is fairly promising. This paper examines the likely development cooperation among three autonomous regions, i.e. Bontang City, East Kutai District, and Kutai Kartanegara District, the Bosanggarong (Bontang, Sangatta, and Tenggarong) Development Forum. The study has been highlighted on three dimension of development: provision of basic infrastructure facilities (public works), environmental management, and garbage / waste-disposal services.  Keywords: Otonomi / desentralisasi, kerjasama antar daerah, pelayanan masyarakat
