Abstract

This study aims, first, to analyze the application of the principles of Maqashid Sharia as a principle of human rights protection against the Rohingya Muslim minority. Second, assess the extent of regional efforts (ASEAN) to protect the Rohingya Muslim minority is based on the principles of Maqashid Sharia. This study is normative juridical, i.e basic research study is conceived as legal norms or rules which apply, both contained Islamic Law and International Law. Further, legal materials collected in the process were analyzed based approach to the law (statute approach) and qualitative approach. The results showed, first, the principle of Maqashid sharia are the fundamental principles that are in line with international human rights principles set forth in the Universal Declaration Human Rights of 1948, the ASEAN Charter and the international conventions that have been globally accepted. Its application carries its own moral responsibility for the ASEAN region, to encourage its member countries (particularly Indonesia and Malaysia) obligations responsibility to protect (R2P) to the ethnic Rohingya. When referring to the ASEAN charter alone, especially member states Indonesia and Malaysia will be very limited in giving aid directly to the territory of the Rohingya, given in addition to avoiding any intervention factor that arises, as well as the government of Myanmar has declared the anti-Islamic rule in the territories of its constitution. This is the regional challenges, especially for Indonesia and Malaysia as member states that embrace the principles of Islamic law once the state of the organization with Myanmar. Secondly, efforts should be made Indonesia and Malaysia are fulfilling rights Rohingya people merely when they became refugees or asylum seeker in the country. The rights can be met as a complement of the principle maqashid sharia, among others: a) freedom of religion, the right to life and freedom from fear (maintenance of soul) in this case Indonesia has established the Integrated Community Shelter (ICS) as a residence of Rohingya refugees and build mosques or places worship for Muslims Rohingya named mosque Arakan, b) fulfill the safety assurance, guarantee of human dignity (maintenance of breath), c) custody of ethnic or tribal, the right to marriage to the breeding (maintenance of descent), d) the right to education (maintenance sense), e) the right to receive a decent living by being given the opportunity to earn a living (maintenance of property).

Abstract

This manuscript aims to analyze the extent to which the role, the tendency, the influence of the Organization of Islamic Cooperation (OIC) to protect Indonesian migrant workers in that member states. The analysis was carried out uses a juridical normative method, and resulted in that OIC to the protection of Indonesian migrant workers confirmed has a strong capacity to solve migrant workers' problems among its member states. In this case implementation of the employment policies issued by the OIC are a form of empowerment resources migrant workers through indirect protection (through education, training, dissemination, research, and development) that has prospects good enough for Indonesia to protect migrant workers although not significant.

Abstract

This article is based on the concept of a maritime axis based on several issue points in the Tomini Gulf area, researched to map issues based on a review of International Law. The article focuses on the existing conditions of the tomini bay area in its management and protection but at the level of the maritime sector that is related to the issue of security defense of the gulf tomini waters. Based on normative juridical methods, the article explains that the gulf of tomini which is semi-enclosed water, still requires significant support from the executive elements, especially in terms of regional cooperation and international cooperation in the fields of economy, defence and security. This is concerned with the territorial and EEZ regions that simultaneously border the Pacific Ocean and the development of the Gulf of Tomini from the aspect of prosperity and security. Moreover, the state does not have to refer to only one international intrusion. However, maritime synergy is needed in all aspects of the tomini bay waters, be it from environmental, utilization and socio-cultural economy. Some specifically regulated international conventions need a more profound review to implement a targeted management system and definite legal protection at the regional level.

Abstract

Justice is one of the main basic ideas in a rule or law. A rule is not considered as a law if it does not provide a sense of justice to the subject it governs. The aim of this article is to analyze the context of social justice on the effectiveness of  urban drainage construction facilities system in the cities. This study used an empirical-juridical method based on the Minister of Public Works Regulation Number 12 of 2014, the implementation of Urban Drainage. The result of data analysis showed since the planning stage, the implementation of each infrastructure development in the city of Gorontalo continually refers to the spatial planning map and collaborates with the associations engaged in the environmental sector so that it reaches the development and control processes. In this case, an infrastructure of the drainage facility does not violate its designated zone. Yet, there are several zones whose utilization is not in accordance with their designation. Thus, the problem collides with the fulfillment of social justice which affects the implementation of drainage facilities construction.Keadilan merupakan salah satu ide dasar pokok dalam sebuah peraturan atau hukum. Sebuah peraturan bukanlah hukum jika tidak memberi rasa keadilan terhadap subjek yang diaturnya. Tujuan artikel ini untuk menganalisis konteks keadilan sosial pada efektivitas pembangunan fasilitas sistem drainase perkotaan di kota dengan menggunakan metode yuridis empiris berdasarkan Peraturan Menteri Pekerjaan Umum Nomor 12 Tahun 2014 tentang Penyelenggaraan Drainase Perkotaan. Hasil penelitian Analisis data menunjukkan bahwa setiap pelaksanaan pembangunan infrastruktur di kota Gorontalo sejak perencanaannya selalu mengacu pada peta penataan ruang wilayah dan melakukan kerjasama dengan asosiasi yang bergerak di bidang lingkungan hidup sehingga sampai pada proses pembangunan dan pengendalian, sebuah infrastruktur dalam hal ini fasilitas drainase tidak menyalahi zona peruntukkannya. Meskipun masih terdapat beberapa zona yang pemanfaatannya tidak sesuai peruntukkannya sehingga permasalahan terbentur pada pemenuhan keadilan sosial yang mempengaruhi pelaksanaan pembangunan fasilitas

Abstract

Abstrak: Pandemi Coronavirus Disease (COVID-19) yang hingga kini belum usai semakin memperburuk keadaan ekonomi pada hampir seluruh sektor dan lapisan masyarakat. Di desa Bululi, pandemi telah menimbulkan permasalahan ekonomi masyarakat, dimana berkurangnya produktifitas masyarakat dalam mata pencahariannya untuk memenuhi kebutuhan ekonomi keluarga, antara lain yakni sebagai petani dan wirausaha. Tujuan pelaksanaan pengabdian ini adalah untuk menstimulasi peran masyarakat dalam rangka membangun kembali ekonomi masyarakat berbasis potensi desa. Kegiatan pengabdian ini dilaksanakan di Desa Bululi dalam bentuk pelatihan terhadap 25 rumah tangga. Metode pelaksanaan mencakup tiga tahap, yaitu pengkajian, perencanaan, dan implementasi kegiatan. Hasil pelaksanaan terlihat bahwa masyarakat antusias terhadap pelaksanaan kegiatan pelatihan UKM dan literasi pemasaran digital. Keberhasilan bermula dari identifikasi potensi desa serta potensi yang dimiliki masyarakat dalam menciptakan kreativitas yakni pembuatan produk minuman khas desa dari air perasan tebu dengan membuatnya pada berbagai varian rasa. Dari hasil pelatihan dan simulasi pembuatan produk minuman khas desa dari air tebu, beberapa masyarakat desa Bululi telah mencoba dan membuat sendiri di rumah, dan kemudian dijual ke masyarakat.Abstract: The ongoing Coronavirus Disease (COVID-19) pandemic has worsened the economic situation in almost all sectors and walks of life. In Bululi village, the pandemic has caused economic problems for the community, where the productivity of the community in their livelihoods is reduced to meet the economic needs of their families, including as farmers and entrepreneurs. The purpose of implementing this service is to stimulate community participation in order to rebuild the community's economy based on village potential. This service activity was carried out in Bululi village in the form of training for 25 households. The implementation method includes three stages, identification, planning, and implementation of activities. The implementation results show that the community is enthusiastic about the implementation of SME training activities and digital marketing literacy. This success started from identifying the potential of the village and the potential of the community in creating creativity, namely in the manufacture of village-specific beverage products from sugarcane juice by making them in various flavors. From the results of training and simulations on making village specialty drinks from sugarcane juice, several Bululi residents have tried and made their own at home, then sold it to the community.

Abstract

This article examines the Chinese government's policy towards Uighurs for the purpose of outlining and explaining indications of the policy that have implications on the legal aspects of this international law. This study was researched using normative juridical methods with expansive analysis based on logical-normative approaches. The results of the analysis show that broadly the policies China implements against the Uighur population are indicated to acts of discrimination. China's main interest is sovereignty, so of course, China will not allow the release of any territory from China. While the implications in the context of International Law as to uphold the guarantee of civil and political rights, liberal and democratic principles or independence, and individual freedom in relation to the state. The points of conflict identified, especially concerning the reach of equality of rights between ethnic Uighurs and other ethnicities in China, the prohibition of inhumane punishment and degrading dignity, and religious freedom.

Abstract

Artikel ini bertujuan untuk memenuhi luaran laporan pengabdian pada program penanganan sampah melalui Bank Sampah di Kabupaten Boalemo. Metode yang digunakan yaitu dengan mendesain peraturan desa melalui pelatihan dan pendampingan penyusunan Peraturan Desa serta sosisalisasi dan pelatihan untuk kader desa dan masyarakat dalam penanganan sampah di desa Bongo Nol. Hasil yang dicapai dalam program KKS pengabdian ini adalah ; (1) terbentuknya peraturan desa Bongo Nol tentang Pembentukan dan Pengelolaan Bank Sampah yang menjadi basis yuridis bagi pemerintah desa untuk mengelola sampah yang dapat meningkatkan pendapatan bagi desa dan masyarakat desa Bongo Nol dengan bentuk penyertaan dana desa yang menjadi modal dalam pembentukan Bank Sampah, pengangkatan pengelola bank sampah, dalam proses pencapaian pembentukan peraturan desa tersebut, dilakukan tahapan pencapaian melalui pendampingan kepada aparat desa dalam penyusunan perdes, uji publik kepada masyarakat desa, pembahasan, sementara proses penetapan, pengesahan hingga ke pengundangan perdes tentang Pembentukan dan Pengelolaan Bank Sampah akan dialkukan secara internal antara pemerintah desa (kepala desa) dengan Badan Permusyawaratan Desa yang secara yuridis memang memiliki kewenangan untuk penetapan, dan pengundangan; (2) terbentuknya bank sampah yang dilakukan dengan tahapan pendirian bank sampah (termasuk pengelolanya) yang berpusat di kantor desa dan ditambah satu uni bank sampah yang berada di Dusun yang berada di Jalan Trans Boalemo dengan pertimbangan produksi jumlah sampah yang ada di dusun tersebut cukup besar disbanding dusun-dusun lainnya. (3) keterampilan pengelolaan sampah melalui kegiatan pelatihan pengelolaan sampah oleh mitra Kelompok KKS Pengabdian.

Abstract

This study aims to provide policy recommendations in the legal context regarding regional needs for integrative problems so that the flexibility to open access to international cooperation is not only to promote regional potential but can empower that potential for sustainable development. The article was compiled using a juridical normative method supported by field data relating to the existing conditions in Gorontalo in terms of developing international law in the region, namely optimizing the role of the region in international relations as a consequence of the Regulation of the Minister of Foreign Affairs Number 3 of 2019 concerning General Guidelines for Foreign Relations by Local government. The results of the study indicate that strengthening diplomacy is part of the Gorontalo provincial government's efforts to get to know the personal identity of the region (regency and city) both in the context of local excellence and globally competent regional advantages and can even build future-oriented international relations. Sister cities or twin cities in the Gorontalo government will be one way to strengthen foreign diplomatic relations through international cooperation mechanisms that can enable the Gorontalo provincial government, both district and city, to play a strategic role to take advantage of the inter-governments/inter-federation state network. in other countries in order to realize the vision of good governance and the vision of a sustainable smart governance/smart city
