Abstract

This paper aims at highlighting some odd court decisions on corruption typed “state financial loss” in public procurement sector. It is odd because of the following reasons: (i) the nature of the case is more about administrative or private law instead of criminal law; (ii) some consider that it will be unjust to sentence guilty the accused; (iii) the cases ensnare persons who are perceived as reformist and clean. The first point will be the focus of elaboration. It will be argued that the encroachment of criminal law towards the area of administrative and private laws are caused by the lower standard of proof for the corruption typed “state financial loss”. Currently, the applied standard is “more likely than not” instead of “beyond reasonable doubt”. The situation which some people are jailed while their faults are more about administrative and private is a justice issue. As the upright of justice is the mandate of the constitution, therefore, articles that create this injustice (Article 2 section (1) and Article 3 of the Eradication Corruption Act) should be re-reviewed by the Constitutional Court. Although the court has previously reviewed the Articles and, therefore, this should be seen as a final and binding; this paper will give some arguments which explain the needs for the court to re-settle this matter.

Abstract

Tulisan ini bertujuan untuk memaparkan sekaligus mengapresiasi aneka upaya yang telah dilakukan oleh Pemerintah Indonesia untuk mendesain pencegahan korupsi di sektor pengadaan barang/jasa, seperti (i) mendesain organisasi pengadaan yang berstruktur lebih horisontal, sehingga sesama petugas bisa saling kontrol satu sama lain; serta (ii) mendesain pengadaan barang dan jasa secara elektronik, khususnya electronic purchasing yang memungkinkan pembelian barang dengan cara efektif dan mengurangi potensi manipulasi dalam proses tender. Namun demikian, tulisan ini juga ingin memberikan catatan kritis yang perlu diperhatikan dari kedua keberhasilan ini. Selanjutnya, berdasarkan analisa perbandingan hukum administrasi negara, tulisan ini juga ingin menekankan bahwa masih terdapat berbagai hal yang dapat dipertimbangkan untuk meningkatkan efektifitas pencegahan korupsi di sektor pengadaan, seperti memperluas cakupan mekanisme sanggah lelang di Indonesia dengan mempertimbangkan mengadopsi regulasi yang diterapkan di Belanda. Di Indonesia, mekanisme sanggah hanya efektif untuk melindungi peserta tender yang merasa dirugikan dengan memberikan kesempatan untuk menyanggah keputusan pemenang lalang. Mekanisme sanggah di Indonesia tidak melindungi (tidak memberikan kesempatan sanggah) kepada calon peserta tender yang merasa dirugikan akibat dokumen pengadaan, misalnya karena desain spesifikasi dan/atau persyaratan pengadaan yang dianggap tidak adil. Mengingat pemerintah masih mempersiapkan Rancangan Undang-undang Pengadaan Barang dan Jasa, maka tulisan ini juga dapat diposisikan sebagai sumbangsih saran.

Abstract

Infrastructure Availability such as government buildings, schools, hospitals are pivotal to underpin public services. The existence of infrastructure like irrigations, ports, roads, bridges, are also important to support social and economic activities of the people. However, the process of procurement in acquiring contractor may be tainted by corruption. This article examines various court decisions which have been final and binding. Three of the selected decisions are appealing to be discussed further, because it is doubted that the legal enforcers have been appropriately enforcing the law and understanding the context. On the first case, the legal enforcers have enforced the anti-corruption law to cases which are detrimental to the state finance. However, the substance of the cases is more suitably categorized as bribery or at least as gratification. On the last two cases, the legal enforcers have applied anti-corruption law for cases that cause the state financial loss. Nevertheless, from the perspective of civil engineering, whether the defendants were guilty are still debatable.
