Abstract

Abstract: According to General Explanation of Presidential Decree No. 1/PNPS/ 1965 on Prevention of Misuse and/or Blasphemy, there are six religions in Indonesia. There are Islam, Kristen, Katolik, Hindu, Budha, and Khong Cu (Confucius). It raises the issue of Indonesian who choose conscience or religions out of the six religions. One example is the Ahmadiyya Muslim Community who choose their conscience. Ahmadiyya Muslim Community often received public rejection and some limitations from the Government of Indonesia.  This paper aims to: (1) examine and analyze the international instrument about the limitation in the right to freedom of thought, conscience, and religion (Forum externum); (2) observe and value the limitation in the right to freedom of thought, conscience, and religion (Forum externum) in Indonesia (Ahmadiyya Muslim Community case). Deploying normative legal research, this research argues that the limitations in religious activities and sealing of several places of worship of the Ahmadiyya Muslim Community by the Government have a legal basis in the international law of externum forum principle and that- the Government limitation on religious activities of Ahmadiyya Muslim community is designed and applied to protect public safety, order, health, or morals or the fundamental rights and freedoms of others. Abstrak: Berdasarkan Penjelasan Umum Penetapan Presiden Republik Indonesia No. 1/PNPS/1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama. Hanya Ada 6 agama di Indonesia yaitu Islam, Kristen, Katolik, Hindu, Budha dan Khonghucu (Confusius). Pembatasan enam agama tersebut menimbulkan persoalan mengenai bagaimana warga negara Indonesia yang memilih kepercayaan atau agama selain dari ke enam agama tersebut, seperti kelompok Muslim Ahmadiyya yang memiih kepercyaannya sendiri. Kelompok Muslim Ahmadiyya sering mendapatkan penolakan publik dan pembatasan-pembatasan dari Pemerintah Indonesia. Penelitian ini bertujuan untuk: (1) menguji dan menganalisis instrumen internasional mengenai pembatasan hak untuk berfikir, berkeyakinan dan beragama (forum eksternum); dan (2) mengamati dan menilai bagaimana implementasi hak untuk berfikir, berkeyakinan dan beragama (forum eksternum) di Indonesia (kasus Kelompok Muslim Ahmadiyya). Dengan pendekatan hukum normatif, penelitian ini membuktikan bahwa pembatasan-pembatasan dalam melakukan kegiatan keagamaan dan penyegelan beberapa tempat ibadah jemaah Ahmadiyya oleh Pemerintah memiliki basis hukum dalam hukum internasional yakni prisip forum eksternum dan pembatasan pemerintah terhadap kelompok Muslim Ahmadiyya diterapkan demi tercipta keselamatan, ketertiban, kesehatan, atau kesusilaan umum, atau hak-hak dan kebebasan-kebebasan mendasar milik orang lain.

Abstract

Tourism development in Banten Lama area has highly made significant progress after the Banten Provincial Government revitalized Banten Lama area with a budget of 80 billion in 2018 and 20 billion in 2019. This development was not only focused on revitalization, but involved many parties. The purpose of this research is to find how is the role of local government as a regulator in the development of community-based tourism in the Banten Lama Tourism area? and how is the community group-based tourism development model in Banten Lama Tourism Area? This study employed an empirical juridical method based on a qualitative data approach. The data sources were taken from primary data collected through interviews and field research at relevant government agencies. For example, the tourism office, tourism awareness groups, tourism business actors, and communities related to tourism development in the Banten Lama area. These are analyzed and served as the findings. The findings revealed the Banten Provincial Government and the Serang City Government, the regulators of tourism development in the Banten Lama area, have a role in the carrying capacity of policies and budgets in revitalizing the Banten Lama area into leading tourism. This is stated in the Banten Province tourism development plan and has started from 2018 and 2019. The synergy of local governments with community group-based tourism development is based on the following groups: community groups who are members of tourism development groups known as tourism awareness groups, community groups who are members of community groups originating from religious elements around Banten Lama tourism area, and community groups who are members of business groups tourism. The existence of these community group must become social capital for the Banten Provincial Government and Serang City Government in preparing regulations for tourism development in the Banten Lama area as a leading destination.Pengembangan pariwisata dikawasan Banten Lama mengalami kemajuan yang sangat signifikan setelah Pemerintah Propinsi Banten melakukan revitalisasi kawasan Banten Lama  dengan anggaran 80 milyar ditahun 2018 dan 20 milyar di tahun 2019, pengembangan ini tidak hanya terfokus pada revitalisasi, tetapi banyak melibatkan berbagai pihak dimasyarakat. Tujuan penelitian untuk mengetahui bagaimana peran pemerintah daerah sebagai Regulator dalam pengembangan pariwisata berbasis kelompok masyarakat  Di kawasan Wisata  Banten Lama ? dan bagaimana model pengembangan pariwisata berbasis kelompok masyarakat di Kawasan Wisata  Banten Lama ?   Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris berdasarkan pendekatan data kualitatif yang bersumber dari data primer melalui wawancara dan penelitian lapangan pada instansi pemerintah terkait yaitu dinas pariwisata, kelompok sadar wisata, dan pelaku usaha pariwista serta masyarakat yang terkait dengan pengembangan pariwisata dikawasan Banten lama sebagi sumber data penelitian untuk dianalisis dan menjadi hasil pemebehasan dalam penelitian. Hasil penelitian yaitu Pemerintah Propinsi Banten dan Pemerintah Kota serang sebagai regulator pengembangan pariwisata dikawasan Banten Lama memiliki peran dalam daya dukung kebijakan serta anggaran dalam revitalisasi kawasan Banten Lama menjadi wisata unggulan hal ini teruang dalam rencana pengembangan pariwisata Propinsi Banten dan dimulai dari Tahun 2018 dan 2019, sinergitas pemerintah daerah dengan pengembangan pariwisata berbasis kelompok masyarakat didasarkan pada kelompok masyarakat yang tergabung dalam kelompok pengembangan pariwisata yang dikenal dengan kelompok sadar wisata, kelompok masysrakat yang tergabung dalam kelompok masyarakat yang berasal dari unsur keagamaan disekitar wisata Banten Lama dan kelompok masyarakat yang tergabung dalam kelompok usaha pariwisata. Abstract

The purpose of the research is how is the Regulatory Policy Model for the development of ecotourism-based heritage tourism in the Old Banten Tourism Area? and what is the role of the Government, tourism managers and tourism actors in the development of ecotourism-based heritage tourism in the Old Banten Tourism area?. This research method is using empirical juridical method, which is a research method that uses a juridical approach by analyzing primary data in the form of interviews and questionnaires in the field and secondary data originating from primary legal materials, namely the 1945 Constitution, laws and other regulations in legal studies. . The results of the study are Based on the Decree of the Governor of Banten No. 437/Kep.160-Huk/2018 concerning the Determination of Zoning of the Cultural Heritage Area of the Sultanate of Banten (Banten Lama), based on this decision the model for the development of heritage tourism development based on ecotourism in the Old Banten area refers to the provisions of the Conservation Law. Abstract

Indonesia merupakan negara berkembang yang tengah memasuki arus globalisasi dan era Masyarakat Ekonomi Asean (MEA) 2025. Keberadaan tenaga kerja asing bisa dianggap sebagai peluang yang dapat dimanfaatkan jika pembinaan terhadap pemberi kerja tenaga kerja asing dilakukan dengan baik sesuai dengan peraturan perundang-undangan. Wilayah Kab. Tangerang merupakan sentra industri dan banyak terdapat pemberi kerja yang menggunakan tenaga kerja asing. Identifikasi masalah dalam penelitian ini yaitu Bagaimana Kewenangan Dinas Tenaga Kerja Kabupaten Tangerang dalam Pembinaan terhadap Pemberi Kerja Tenaga Kerja Asing berdasarkan Peraturan Menteri Ketenagakerjaan Nomor 8 Tahun 2021? Dan, apa yang menjadi kendala Dinas Tenaga Kerja Kabupaten Tangerang dalam pembinaan terhadap pemberi kerja tenaga kerja asing? Teori yang digunakan dalam penelitian ini yaitu teori kewenangan dan teori tindakan pemerintah. Metode penelitian yang digunakan yaitu metode hukum yuridis empiris. Spesikasi penelitian yang digunakan yaitu penelitian deskriptif analitis. Sumber data yaitu data primer ditunjang dengan data sekunder. Teknik pengumpulan data dilakukan dengan penelitian kepustakaan, dan penelitian lapangan. Data diperoleh dianalisis secara deskriptif dengan pendekatan analisis data kualitatif. Hasil penelitian mengenai pembinaan terhadap pemberi kerja tenaga kerja asing di Kab. Tangerang dilakukan dalam bentuk sosialisasi  mengenai tata cara penggunaan tenaga kerja asing sesuai dengan peraturan perundang-undangan, penyuluhan mengenai kewajiban dan larangan dalam penggunaan tenaga kerja asing, penyusunan analisis pasar kerja terhadap penggunaan tenaga kerja asing, monitoring dan evaluasi pengesahan rencana penggunaan tenaga kerja asing terhadap kesesuaian penggunaan tenaga kerja asing dengan jabatan yang diduduki tenaga kerja asing dan pelaksanaan pendampingan tenaga kerja asing. Meskipun demikian, masih terdapat beberapa kendala dalam melaksanakan pembinaan terhadap pemberi kerja tenaga kerja asing, yaitu kebijakan produk hukum daerah yang belum terbentuk, koordinasi terkait pendataan tenaga kerja asing antara Dinas Tenaga Kerja Kab. Tangerang dengan Dinas Tenaga Kerja dan Transmigrasi Prov. Banten yang belum maksimal, dan partisipasi pemberi kerja tenaga kerja asing yang belum maksimal. Dinas Tenaga Kerja Kab. Tangerang perlu melakukan koordinasi terkait penyusunan kebijakan produk hukum daerah terkait pembinaan tenaga kerja asing, dan mengoptimalkan koordinasi dengan Dinas Tenaga Kerja dan Transmigrasi Prov. Banten, serta para pemberi kerja tenaga kerja asing perlu untuk kooperatif dalam melaporkan keberadaan tenaga kerja asing yang bekerja di perusahaan yang bersangkutan.

Abstract

Plastic is a part of human life. Plastic packaging dominates the packaging market share in the world, replacing cans and glass packaging. Plastic is used because it is an inexpensive material, not easily weathered, lightweight, and anti-rust. Human activities cannot be separated from the use of plastics, but the increasing use of plastic results in increased pollution of land and even oceans. This also certainly affects the world's ecosystem. Because of the dangers of plastic for the environment, the government has begun to aggressively create programs and policies aimed at educating the public about the impact of plastic consumption and its dangers on the environment. It also aims to change people's culture of using single-use plastics. Not only the government, but at the university policy level it is also necessary to make policies regarding the restrictions on the use of single-use plastics. This study uses an empirical juridical research method that uses a juridical approach by analyzing primary data in the form of interviews and secondary data derived from primary legal materials. The purpose of this study was to determine the policy of reducing single-use plastic waste in the Sultan Ageng Tirtayasa University environment. Abstract

Shopping centers as one of the categories of public facilities have the responsibility to support the exclusive breastfeeding program launched by the government. One form of this support is by providing lactation room facilities. Therefore, this study will discuss about how the availability of lactation space in the modern shopping center, Central Park Mall Jakarta, based on Regulation of The Minister of Health Number 15 of 2013 Concerning Procedures for Providing Special Facilities for Breastfeeding and/or Expressing Breastmilk?, How are the efforts of the management of the modern shopping center, Central Park Mall Jakarta in meeting the availability of lactation rooms?. The research method tah the author uses in the preparation of this legal writing is empirical juridicial research, with analytical descriptive spesifications that discuss the implementation of The Minister of Health Number 15 of 2013 Concerning Procedures for Providing Special Facilities for Breasrfeeding and/or Expressing Breastmilk. This study uses primary data sourced from the field in the form of interviews with mall  managers, secondary data sourced from laws regulation, official documents, and books which were analyzed qualitatively. Based on the results of the study, the Central Park Mall Jakarta Modern Shopping Center has provided lactation rooms divided into a room per floor, and all room facilities have met the standars set out in the Regulation of Minister of Health Number 15 of 2013 Concerning Procedures for Providing Special Facilities for Breastfeeding and/or Expressing Breastmilk. The efforts made by the manager of Central Park Mall Jakarta in the procurement of lactation rooms are divided into 3 elements, namely mall management, human resources, and facilities and infrastructure.

Abstract

The authority of the State Administrative Court according to Law Number 5 of 1986 concerning the State Administrative Court is to examine, decide and resolve disputes. One of the case studies is Decision No. 5/G/2020/PTUN.SRG the object of the dispute is a Certificate of Ownership that has been issued by the Head of the Lebak Regency BPN on land belonging to other people which results in mutual accusations. So the problem in this research is how is the authority of the Serang Administrative Court in resolving dual land certificates? and what is the basis for the judge's legal considerations on Decision Number 5/G/2020/PTUN.SRG? The research method that the author uses in the preparation of this legal writing is using the normative juridical method, namely research called library research because it focuses on secondary data research, with descriptive analytical research that discusses the resolution of dual certificate disputes over land in Lebak Regency which is sourced from primary data. and secondary data. Data collection techniques consist of literature study. And the method used in analyzing the data is a qualitative juridical analysis. The results of the study concluded that the Serang Administrative Court in completing the dual certificates. Decision No. 5/G/2020/PTUN.SRG is based on relevant evidence, namely seeing violations committed by the Head of the Lebak Regency BPN Office in the measurement and mapping process as well as procedures for issuing replacement certificates regulated in Article 17 paragraph 2 and Article 18 paragraph 1 and paragraph 4 PP No. 24 of 1997 concerning Land Registration. So the Panel of Judges canceled the Certificate of Ownership in Nji's name. Chusdajah Binti Sarbini.

Abstract

The government has published a regulatory of act number 41 in 2009 on The Protection of Sustainable Food Agricultural Land (LP2B) as effort to protect perennial agricultural land. It’s hoped will halt the conversion of rice fields, especially with technical irrigation can sustain regional food security to the Nation. In administration, this law has obstacle process or covering space; planning determination and can be said not to run as it should, that a comprehensive evaluation of the performance is required.The method used in this study is empirical juridical based on qualitative data approaches that come from primary data through interviews and field research on agricultural services pandeglang county's for data could be analyzed and result of discussions in research.The study of the writing requires a regulation of LP2B region and an evaluation to see how its effectiveness is connected with the various regulations that have been drafted. The mandate in act number 41 in 2009 began when planning came to completion. The data inventory efforts in planning of setting up the zoning became necessary by the government especially the region government of pandeglang district through agricultural services as a technical executioners.

Abstract

The 2019 Corona Virus Disease pandemic poses a threat to Micro, Small, and Medium Enterprises, as seen from the decline in turnover to no income and causing bankruptcy. Government policies in dealing with the economic impact during the 2019 Corona Virus Disease pandemic, the government gives priority to support for Micro Enterprises with large budget allocations. Therefore, this study discusses how the legal aspects of funding micro, small, and medium enterprises as working capital assistance during the Corona Virus Disease 2019 pandemic in Tangerang City based on the Regulation of the Minister of Cooperatives, Small and Medium Enterprises Number 6 of 2020? from the implementation of micro, small and medium business capital assistance in the Tangerang City area to the sustainability of Micro, Small, and Medium Enterprises?. The research method used in the preparation of this legal writing is empirical juridical research, namely research that sees the law as a rule in society to be obeyed, with analytical descriptive specifications that discuss working capital assistance during the Corona Virus Disease 2019 pandemic in Tangerang City which is sourced from data The primary sources are legislation, books, legal science journals, and other library materials which were analyzed qualitatively. The results of this study, that the Government implements policies through the Direct Assistance Program for Micro Enterprises with the aim of strengthening the business of Micro, Small, and Medium Enterprises. The existence of such capital assistance has a positive impact on the economy in the community, thereby increasing employment opportunities.

Abstract

Tangerang Regency is a strategic area in the tourism industry. The regional apparatus that has the authority to provide services for tourism in this area is the Department of Youth, Sports, Culture and Tourism. Situ Kelapa Dua, which is located in Kelapa Dua Village, Tangerang Regency, is a tourism area that has potential attractiveness as environmentally-based sustainable tourism or called ecotourism. This study aims to explain how the authority of local governments in developing ecotourism potential in Situ Kelapa Dua, Tangerang Regency and explain the inhibiting factors and supporting factors of local governments in carrying out their authority. The research method used in this study is an empirical juridical method based on a qualitative data approach sourced from primary data through interviews and field research at the relevant government agencies, namely the Tangerang Regency Youth, Sports, Culture and Tourism Office. Based on the results of the study, it was found that the authority had not run optimally, due to the absence of regional regulations that were formed related to the implementation of tourism in Tangerang Regency. However, the agency has plans related to the preparation of a tourism regional regulation which will take place in 2022. The need for cooperation between related institutions and local communities in overcoming the problems that are inhibiting factors in this development.
