Abstract

Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah menentukan bahwa desa telah menjadi daerah yang istimewa dan bersifat mandiri yang berada dalam wilayah kabupaten. Oleh karena desa memiliki kewenangan untuk mengatur dan mengurus kepentingan masyarakatnya, maka desa memiliki kewenangan untuk membuat dan menetapkan peraturan perundang-undangan untuk lingkup desa, atau disebut dengan peraturan desa. Penetapan peraturan desa dilakukan oleh Badan Permusyawaratan Desa (BPD) bersama dengan Kepala Desa. BPD dalam menjalankan fungsi legislasinya memiliki peran yang sangat penting dan strategis dalam proses pemerintahan di desa karena BPD secara langsung dapat mempengaruhi dinamika kehidupan masyarakat desa, khususnya di Desa Peninjoan, Kabupaten Bangli.Berdasarkan hasil penelitian, peranan BPD di Desa Peninjoan dalam penyusunan Peraturan Desa belum berjalan secara optimal karena pembuatan peraturan desa di Desa Peninjoan yang dilakukan melalui proses penyerapan aspirasi, pembahasan dan penetapan, BPD hanya diposisikan sebagai lembaga penunjang dalam rangka pemenuhan syarat normatif dalam pembentukan peraturan desa. BPD dalam melaksanakan fungsi legislasi dalam praktiknya dipengaruhi faktor pendukung seperti pemerintah desa yang demokratis dan nilai-nilai yang hidup di masyarakat yang mendukung pelaksanaan fungsi legislasi BPD, serta dipengaruhi faktor penghambat yang meliputi Sumber Dana, Organisasi Eksternal dan SDM dari anggota BPD di Desa Peninjoan, Kabupaten Bangli.

Abstract

Salah satu pasar seni yang terdapat di kabupaten Gianyar adalah pasar seni Guwang. Pasar seni Guwang berlokasi di Desa Guwang, Kecamatan Sukawati Kabupaten Gianyar.  Berdasarkan  data perkembangan Pasar Seni tersebut, sangatlah mungkin apabila perguruan tinggi khususnya Universitas Mahasaraswati Denpasar selaku institusi pendidikan ikut berperan serta dalam pengembangan dan mempertahankan eksistensi Pasar Seni Guwang melalui Program Kuliah Kerja Nyata Pembelajaran dan Pemberdayaan Masyarakat (KKN-PPM). Perberdayaan dan pendampingan dari pengelolaan manajemen keuangan pengelola pasar, manajemen pemasaran, manajemen informasi dan manajemen lingkungan pasar serta layout kios tempat pedagang berjualan. Pasar seni Guwang berlokasi di Desa Guwang, Kecamatan Sukawati Kabupaten Gianyar. Lokasi pasar sangat strategis, karena satu jalur kearah objek wisata lainnya seperti ubud dan kintamani. Pasar seni Guwang memiliki fasilitas parkir yang luas, sehingga bisa menampung puluhan bus pariwisata. Bentuk bangunan dibuat seperti letter U, dibagi menjadi tiga blok yaitu blok A pada sisi kiri, blok B di sisi kanan dan C diujung sebagai penghubung antara blok A dengan B. Kontribusi mendasar program ini adalah pengelolaan manajemen keuangan dan pelaporan yang sesuai dengan standar, peningkatan pemasaran melalui website, peningkatan kualitas SDM, peningkatan kualitas kebersihan lingkungan Pasar Seni Guwang. Kegiatan yang telah dicapai adalah pembersihan lingkungan di areal Pasar Seni Guwang, peremajaan dan penataan kebun di halaman Pasar Seni Guwang, pembuatan garis-garis (marka) parkir sepeda motor di halaman parkir depan Pasar Seni Guwang, pengecatan ruang informasi, workshop manajemen pemasaran dan keuangan bagi para pedagang dan pengelola Pasar Seni Guwang, pelatihan ketrampilan berbahasa asing yaitu bahasa inggris dan mandarin serta melaksanakan pelatihan komputer yaitu program word dan excel bagi pengelola Pasar Seni Guwang.

Abstract

Kebebasan berserikat sebagai akibat dari Era Reformasi yang dibangun atas dasar jaminan perlindungan hak asasi manusia untuk kebebasan berserikat merupakan dasar untuk pertumbuhan serikat buruh di Indonesia. Keberadaan serikat pekerja yang pada dasarnya berfungsi sebagai alat untuk perlindungan tenaga kerja belum berjalan secara optimal sebagai akibat dari pendekatan konflik yang dibangun dalam paradigma hubungan industrial. Oleh karena munculnya asumsi keberadaan serikat pekerja pada reformasi yang dibangun sebagai "pembalasan" posisi tawar yang lemah dari organisasi buruh di era sebelumnya belum optimal fungsi tereakan bagi serikat untuk memberikan perlindungan kepada pekerja dalam kerangka Hubungan Industrial Pancasila.

Abstract

The existence of Pancasila Industrial Relations in Indonesia, which consists of three parties namely, employees, businessman and the government to put the governments role as a representative of the state in its strategic position as a regulator in an effort to provide protection to workers rights in the area of wages in order to enhance the dignity of workers. The minimum wage policy as a wage policy that is built sporadically result in not achieving the minimum wage essence of which is to protect workers wages from being hit in the low wage has caused dilematika in Industrial Relations in Indonesia. The controversy in the process of establishing, implementing and enforcing minimum wages will always happen when the construction of the minimum wage policy developed in the absence of wage system in the Pancasila Industrial Relations.

Abstract

With the enactment of Act Number 6 of 2014 concerning the Village, then granting of Village Fund by Local Government of Badung to Pelaga Village, requires a of acccountability for the use of aid allocations Village Fund. In this research discusses the Badung regency government policy in managing the allocation of village funds and the accountability Village Revenues and Expenditures Budget in Pelaga Village, Petang District, Badung Regency.

Abstract

Pecalang is a unit of traditional security officers in Bali, who have the authority to maintain the order and security in the region of customary village. This research is normative legal research. Legal materials derived from primary legal materials, secondary legal materials, and tertiary legal materials. Pecalang as an instrument for securing the customary village is the unity of the traditional safeguards of every customary village in Bali in charge of maintaining the order in their village. The existence of the pecalang in securing the conference is a requirement of the event organizer. Pecalang as a non-permanent employee in securing the conference employed only in a specified period that is prior to and during the conference. As non-permanent employees then pecalang are entitled to protection.

Abstract

The era of Industrial Revolution 4.0 encourages the implementation of information technology-based government in various fields including in the field of manpower. The Regional Government of Bali Province has a legal product in the form of the Bali Provincial Regulation Number 10 of 2019 concerning Manpower Implementation mandating the development of a labor system. In this study, two issues will be discussed, namely the basic considerations for the development of an employment information system and the formulation of a law regarding an employment information system. The development of a manpower information system is based on the government's duties in providing public services and regional autonomy. The legal formulation regarding the manpower information system is written in the form of a regional regulation which should also be followed by a governor's regulation.

Abstract

The phenomenon of online application-based transportation services is actually an answer to people's needs for transportation that is easy to get, convenient, fast, and cheap. There are many factors making this online-based application is needed by many people, especially in big cities in Indonesia. Online transportation has become an alternative mode that people want after previously they have to use the conventional modes. Behind the convenience provided, the presence of GO-JEK and Grab has contradictions from various parties. There are no regulations specifically regulating worker protection for the drivers because in Law Number 13 of 2003 concerning Manpower (hereinafter referred to as the Manpower Law) only regulates formal worker. Thus, worker standards in the Manpower Law cannot be applied to online transportation drivers. The urgency to make rules regarding worker protection for online transportation drivers should be considered by the Government. Therefore, it can create legal certainty and justice for the drivers like the formal workers.
