Abstract

Salah satu modal utama bank sebagai lembaga intermediary adalah menjaga kepercayaan dari masyarakat. Kepercayaan ini akan berkurang atau bahkan menjadi hilang apabila ada sengketa perbankan yang tidak dapat diselesaikan dengan baik oleh pihak yang bersengketa. Penyelesaian sengketa dapat dilakukan melalui jalur litigasi dan non litigasi. Akan tetapi karena dianggap tidak efisien dan efektif maka penyelesaian sengketa menggunakan jalur litigasi mulai ditinggalkan dan beralih ke penyelesaian sengketa melalui jalur non litigasi. Selama ini sengketa perbankan yang berada dalam ranah perdata sudah sering diselesaikan menggunakan jalur non litigasi. Penelitian ini bertujuan untuk menganalisis kebijakan nonpenal dalam penanggulangan tindak pidana perbankan saat ini dan akan datang yang didasarkan pada penelitian yang telah dilakukan dengan menggunakan metode pendekatan yang bersifat yuridis sosiologis. Simpulan yang diperoleh menunjukkan bahwa, pertama, kebijakan nonpenal penanggulangan tindak pidana perbankan pada saat ini masih sebatas sanksi nonpenal yang dapat dilihat di Pasal 52 ayat (2) Undang-Undang Perbankan. Bank Indonesia hanya sebagai pihak fasilitator penyelesaian sengketa antara pihak Bank dan Nasabah khususnya untuk sengketa keperdataan sebagaimana ketentuan dalam PBI Nomor: 10/1/PBI/2008 tentang perubahan atas PBI Nomor 8/5/PBI/2006 tentang Mediasi Perbankan dengan dibentuknya Lembaga Mediasi Perbankan, Bank Indonesia (BI) bertugas melakukan penyelesaian secara non litigasi (di luar pengadilan) dengan menggunakan mediasi sebagai sarana penyelesaian sengketa. Kedua, Dasar pemikiran kebijakan nonpenal dalam penanggulangan tindak pidana perbankan yang akan datang dimungkinkan tidak melalui jalur pengadilan selama pihak internal bank telah menyelesaikan kasus tersebut baik antara pihak bank dengan pelaku maupun dengan nasabah sehingga tidak menjadi temuan oleh Bank Indonesia. Tentunya dengan keputusan hasil forum kesepahaman yang didasarkan pada Nota Kesepahaman Tahun 2004 maka tindak pidana perbankan dapat diselesaikan di luar jalur pengadilan. One of the major capital intermediary bank as an institution is to maintain the trust of the community. This trust will be tarnished if there is a dispute that can not be solved banks properly by the parties to the dispute. Dispute resolution can be done through litigation and non-litigation. However, because it is not efficient and effective the use of dispute resolution litigation becoming obsolete path and switch to non-settlement of disputes through litigation. During this dispute is within the realm of banking civil lines have often solved using non-litigation. This research aims to determine the nonpenal policy in crime prevention and the current banking will come. The article was done by the method juridical sociological approach. The conclusions show that, first nonpenal policy in preventing the banking’s crime is still limited as nonpenal sanctions that can seen in Article 52 paragraph. Second, of the Banking Act. Indonesian Bank (BI) just as the dispute resolution facilitator between the Bank and the Customer in particular for civil disputes as stipulated in Regulation No. 10/1/PBI/2008 on amendments to Regulation No. 8/5/PBI/2006 about the banking mediation by establishment of the Institute of Banking Mediation Mediation Banking, Indonesian Bank (BI) assigned to conduct non-litigation settlement (out of court) through the mediation as dispute resolving. 2) the fundamental of nonpenal policy in banking’s crime prevention next is not possible come through the courts as long as the internal bank has finished the case among the banks with the actors and with customers so it is do not be the findings of  Indonesian Bank (BI). Obviously by the decision of the understanding forum result based on the Memorandum of Understanding of 2004, the banking crime can be settled out of court.

Abstract

This article will analyze the participatory paradigm for the empowerment problem of women of the village violence victims in central Java based on three questions in the form of ontology, epistemology, and methodology. Community involvement began when identifying problems to formulate joint actions, while the research results were directly applied to the problems encountered. Victims of violence in women are considered to be very understanding of the problems faced so that they are expected to be found the right solution to be applied in the community and provide results under expectations. In the process of Participatory Action Research (PAR) There is a process of digging, seeking, investigating issues and problems of women in the issue of women's trafficking, sexual exploitation in a collaborative research/collaboration. Research is done in an equal relationship which then ends up doing the action together. Related to the issue of violence against women raises participation and raises women's power to build a good relationship between victims of violence against women, between women and the wider community, and among women victims of violence with researchers.

Abstract

Masyarakat Suku Samin merupakan masyarakat adat yang mempunyai perilaku menyimpang dari tradisi masyarakat lain di Indonesia, seperti membangkang dan tidak patuh terhadap pemerintah. Keyakinan orang Samin dalam menjalani kehidupannya yang masih berpegang teguh terhadap nilai dan budaya mengakibatkan Suku Samin mempunyai karateristik yang berbeda dengan yang lain, termasuk dalam tata cara penyelesaian tindak pidana yang tidak menggunakan jalur pengadilan. Penelitian ini bertujuan: Pertama, menggambarkan mediasi penal yang selama ini dijalankan oleh masyarakat Suku Samin. Kedua, mendeskripsikan relevansi yuridis mediasi penal yang dilakukan oleh masyarakat Suku Samin. Metode yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan pendekatan kualitatif serta sumber data primer dan sekunder. Sedangkan dalam menganalisis data penulis menggunakan teknik triangulasi yang digunakan untuk membandingkan hasil wawancara dengan isi suatu dokumen yang berkaitan dengan penelitian.  Hasil penelitian pertama, mediasi penal selama ini dijalankan oleh masyarakat Desa Klopoduwur terhadap semua jenis tindak pidana, baik tindak pidana yang terjadi di intern Suku Samin, maupun tindak pidana yang dilakukan oleh masyarakat pada umumnya dengan tata cara yang berbeda. Kedua, berdasar Pasal 42 ayat (2) dan ayat (3) RKUHAP (Rancangan Kitab Undang-Undang Hukum Acara Pidana) mediasi penal yang dilakukan dapat diakui akan tetapi hanya untuk beberapa tindak pidana seperti tercantum dalam Pasal 42 ayat (3) RKUHAP. Dalam RKUHP (Rancangan Kitab Undang-Undang Hukum Pidana) mediasi penal yang dilakukan di Desa Klopoduwur dapat dikualifikasikan dalam Pasal 145 jo Pasal 146 RKUHP. Tribal community of Samin are an indigenous community who have deviant behavior of the tradition from the other communities in Indonesia, such as insubordination and disobeying toward the government. Samin belief in living life that still cling to the values and culture resulted in Samin tribe has different characteristics with the others, including the procedures for the settlement of criminal offenses that do not use the courts procedures. This research aims to: The first, to describe the penal mediation used in Samin tribe. The second, to describe the relevance of the juridical-penal mediation conducted by Samin tribe. The method used in this research is juridical sociological with a qualitative approach as well as primary and secondary data sources. Meanwhile the authors analyzed data using triangulation techniques which used to compare the results of interviews with the contents of a document relating to this research. The results from this reseach are: the first penal mediation has been used by the community of Klopoduwur for all types of crime, both offenses occurred in internal Samin tribe, as well as criminal acts committed by the society in a manner that is different. The second, under article 42 paragraph (2) and (3) RKUHAP (Draft of Criminal Court Procedure) penal mediation conducted can be recognized but only to some of criminal offenses as listed in article 42 paragraph (3) RKUHAP. In RKUHP (Draft of Criminal Code) penal mediation conducted can be qualified at article 145 in conjunction with article 146 RKUHP.

Abstract

Penanggulangan perkara pidana yang terjadi di tengah masyarakat dapat diselesaikan dengan dua metode, yaitu penal dan non penal. Penyelesaian secara non penal salah satunya merupakan Mediasi Penal. Mediasi penal sendiri lahir dari budaya yang ada di dalam masyarakat sehingga kandungan nilai-nilainya sesuai dengan karakteristik Bangsa Indonesia. Namun penerapan mediasi penal ini belum memiliki landasan yuridis yang kuat sehingga perlu diteliti lebih lanjut apa model mediasi yang digunakan serta bagaimana peran aparat penegak hukum. Dalam artikel ini akan dipaparkan proses penyelesaian perkara pidana melalui mediasi penal di tingkat penyidikan dan peran aparat penegak hukum dalam proses mediasi penal. Data pendukung artikel ini menggunakan hasil penelitian dengan jenis kualitatif dan metode pendekatan yuridis sosiologis yang mendasarkan pada data primer dan data sekunder. Pada dasarnya, mediasi penal telah familiar dilaksanakan ditingkat kepolisian didasarkan pada Surat Kapolri No Pol: B/3022/XII/2009/SDEOPS tanggal 14 Desember 2009 tentang Penanganan Kasus Melalui Alternatif Dispute Resolution dengan bentuk mediasi penal yang digunakan adalah victim offender mediation. Model VOM ini dianggap paling layak untuk diterapkan karena mempertemukan antara kedua belah pihak sehingga mengakomodir kepentingan para pihak demi terwujudnya keadilan restoratif.Overcoming criminal cases that occur in the middle of society can be solved by two methods, namely reasoning and non-punishment. Non-reasoning settlement is one of them is Penal Mediation. The reasoning mediation itself is born from the culture that exists in society so that the content of its values is in accordance with the characteristics of the Indonesian Nation. However, the application of this reasoning mediation does not yet have a strong juridical basis so it needs to be investigated further what the mediation model is used and how the role of law enforcement officers is. In this article will be presented the process of solving criminal cases through reasoning mediation at the level of investigation and the role of law enforcement officers in the process of judicial mediation. Supporting data for this article uses the results of research with qualitative types and sociological juridical approaches that base on primary data and secondary data. Basically, the reasoning mediation is familiar is carried out at the police level based on National Police Chief No Pol: B / 3022 / XII / 2009 / SDEOPS dated December 14, 2009 concerning Case Handling through Dispute Resolution Alternatives with the form of reasoning mediation that is victim offender mediation. This VOM model is considered the most feasible to implement because it brings together the two parties so that it accommodates the interests of the parties in order to realize restorative justice.

Abstract

This research aims to develop multi-representation teaching material that includes definitive,macroscopic, microscopic, and valid symbolic to determine students’ responses through multi-representation material. This research was conducted at SMA Negeri 1 Karangtengah, with subjects in class XI IPA 3. This research was applied to acid-base materials. The data obtained in this research are the results of expert validation and students’ responses tomulti-representation media teaching material: definitive, macroscopic, microscopic, and symbolic. The data retrieval was conducted by expert judgement method to determine the validity of teaching materials, and the questionnaire method to determine student response through multi-representation material: definitive, macroscopic, microscopic, symbolic was validated by three validators. The research outcome shows that multi-representation media: definitive, macroscopic, microscopic, symbolic valid with an average score of 62 from a total score of 75. The student responses through multi-representation material showed a positive response through the material.

Abstract

Abstract

Worthy children and women's Village/Sub-district is a village/sub-district development that brings together the commitment and resources of village/village government that involve the community and business world in the sub-district in order to promote, protect, Fulfilling and respecting the rights of children and women, which are planned consciously and sustainably. Some laws have been established to support the protection of children and women such as the Act of the Republic of Indonesia number 35 year 2014 about the amendment to law Number 23 year 2002 about protection Children and Law Number 23 year 2004 concerning the elimination of violence in households. In order to realize the child and women’s friendly villages, there are several efforts that can be done as the socialization of legal protection and community empowerment. Socialization programs not only provide information or knowledge but also supported by the empowerment of community that provides training and experience in the community. So that socialization tends to only provide information to be easier to understand by the community through the Community Empowerment program and increase public awareness to continue to actively participate in the realization of child and women’s friendly villages.

Abstract

The lack of Legal Aid Implementers compared to Legal Aid Recipients is expected to hamper access to justice for the poor. Therefore this research aims to provide space for Paralegals especially in the Law Faculty of UNNES to be able to provide free legal assistance outside the court of the poor in Central Java. This research will at least discuss two issues, namely 1) How is the existence of the Law Faculty UNNES Paralegal in a juridical and institutional manner in providing Legal Aid? and 2) What is the role of the Paralegal Faculty of Law at UNNES in providing Legal Aid to the poor in Central Java ?. The method used in this research is sociological juridical with a qualitative approach. The results of this study indicate that currently Paralegals can only carry out non-litigation Legal Aid. This happened because the Supreme Court based on Decision Number 22 P / HUM / 2018 had canceled the Paralegal's role in litigation. The role of Paralegals from UNNES Law Faculty students is as a facilitator or intermediary in accommodating complaints of cases and consultation from Legal Aid recipients to be conveyed to Legal Aid Providers namely lecturers who are members of the Center for Legal Aid Study, while the role of Paralegals from UNNES Law Faculty alumni is as an assistant or who helps Advocates in carrying out non-litigation Legal Assistance such as mediation, consultation, negotiation, advocating cases outside the court and making trial files. The provision of legal aid by the Paralegal is considered to be very helpful for Lecturers and Advocates in fulfilling access to justice for the poor.

Abstract

Tingginya angka pernikahan usia anak, menunjukkan bahwa pemberdayaan law enforcement dalam hukum perkawinan masih rendah. Pernikahan dini merupakan permasalahan serius yang harus segera diberikan solusi, dan salah satunya adalah masyarakat harus paham dampak negatif dari pernikahan dini. Pernikahan dini hanya akan hanya akan berdampak negatif. Pernikahan dini rentan terjadap kekerasan dalam rumah tangga (KDRT), dengan perempuan sebagai korbannya.Penyadaran kepada orang tua bahwa pendidikan adalah hal yang sangat penting untuk membangun keluarga yang sehat dan berkualitas. Komitmen dari pemerintahan Desa Munding dan masyarakat khususnya Dusun Cemanggal dibutuhkan untuk mengutamakan pendidikan, seperti yang telah diamanatkan oleh undang-undang sehingga bisa menyiapkan pasangan suami istri yang lebih siap dan layak untuk menikah. Komitmen ini bisa diwujudkan dengan pembentukan peraturan desa mengenai batas minimal usia menikah di Desa Munding. Masalah-masalah yang ditimbulkan oleh pernikahan dini membutuhkan pendampingan melalui pembentukan Kelompok Masyarakat Sadar Hukum (KADARKUM). Pembentukan kadarkum diperlukan, bekerjsama dengan pos bantuan hukum melakukan kegiatan berupa pemberian informasi, sosialisasi aturan hukum, dokumen, konsultasi atau advise hukum maupun berupa pendampingan penanganan perkara.
