Abstract

Sengketa ekonomi syariah sebelum adanya Putusan Mahkamah Konstitusi (MK) Nomor 93/PUU-X/2012, masih terdapat pilihan forum, bisa di Pengadilan Agama atau di Pengadilan Umum. Namun dengan terbitnya putusan MK maka kewenangan mengadili perkara ekonomi syariah ada di Pengadilan Agama, sesuai dengan Undang-undang Nomor 3 Tahun 2006 tentang Peradilan Agama. Bagi Pengadilan Agama, putusan MK ini menjadi momen penting untuk meningkatkan pelayanan kepada masyarakat dengan mempersiapkan; 1) penguatan SDM Hakim dan Panitera, 2) penguatan hukum materiil dan hukum acaranya yakni Kompilasi Hukum Ekonomi Syariah (KHES) serta Kompilasi Hukum Acara Ekonomi Syariah (KHAES), serta 3) adanya dukungan masyarakat yang maksimal.Secarahukum, sengketa ekonomi syariah menjadi kompetensi Pengadilan Agama sejak berlakunya Undang-UndangRI Nomor 3 Tahun 2006 tahun. Namun faktanya sengketa ekonomi syariah tidak serta merta diselesaikan di Pengadilan Agama karena banyak peraturan dan tafsir yang berbeda.

Abstract

Perdebatan tentang hukuman mati, hingga kini masih menarik perhatian banyak kalangan. Setidaknya ada dua mainstream dalam hal ini, yaitu orang yang setuju dan menolak diberlakukan hukuman mati. Bagi yang setuju beralasan bahwa pelanggaran berat terhadap hak hidup, harus diancam hukuman mati sehingga bisa menjadi efek jera, sementara yang menolak berpendapat bahwa hukuman mati meru­pakan pengingkaran terhadap hak asasi manusia, yaitu berupa hak hidup. Hakekat hukuman mati bukanlah pelanggaran hukum, karena penerapan hukuman mati justru ditegakkan dalam rangka melindungi Hak Asasi Manusia (HAM) itu sendiri. Dalam pandangan hukum Islam, hukuman mati, dapat dilakukan terhadap empat kasus, yaitu yang melakukan zina muhṣan, membunuh dengan sengaja, ḥirābah dan murtad (keluar dari Islam). Selanjut­nya hukuman mati harus dilaksanakan sesuai dengan maqāṣid al-sharī’ah dan keadilan. Dalam perspektif maqāṣid tujuan hukuman mati harus merujuk pada tujuan me­melihara agama (ḥifẓ al-dīn), memelihara diri atau menjaga kelangsungan hidup (ḥifẓ al-nafs), akal (ḥifẓ al-‘aql), keturunan (ḥifẓ al-nasl), dan memelihara harta (ḥifẓ al-māl). Dalam perspektif keadilan, negara atas nama hukum harus melindungi warganya dari peristiwa-peristiwa hukum yang merugikan masya­rakatnya.***The debate about death penalty, is still attracted attention of people. In the view of Islamic law, death penalty, can be done on four cases, namely that of adultery, killing intentionally, Hirabah and apostasy. Furthermore, the death penalty should be carried out in accordance with maqāṣid al-sharīah and justice. In maqāṣid al-sharīah perspective, the purpose of death penalty should refer to maintain religion (ḥifẓ al-dīn), maintain body or maintain the survival (ḥifẓ al-nafs), mind (ḥifẓ al-aql), descent (ḥifẓ al-nasl), and maintaining property (ḥifẓ al-māl). Abstract

Dalam bahasa KH Abdurrahman Wahid, Pesantren merupakan sebuah sub kultur budaya masyarakat Indonesia. Kyai sebagai  pengasuh Pesantren menjadi tokoh sentral tidak saja sebagai pengeloa Pesantren tetapi Kyai juga sebagai tokoh dan panutan masyarakat Pesantren. Bahkan ada yang menyatakan bahwa Kyai di Pesantren bagaikan Raja-raja kecil yang mempunyai kekuasaan penuh atas masyarakat yang memberikan mandat kepadanya.Namun dalam dunia politik ketokohan Kyai tidak bisa disamakan dalam posisinya sebagai tokoh Pesantren. Hal ini bukan karena Kyai tidak layak untuk menjadi panutan dalam berpolitik, tetapi dalam dunia politik, Pesantren menggunakan perspektif sunni, di mana kekuasaan adalah kewajiban kelompok (fardu kifayah), sehingga politik dijadikan sebagai wasilah/media bukan ghoyah/tujuan dalam rangka mencapai kemashlahatan ummat.Banyaknya praktek politik yang mengatasnamakan politik Islam seperti khilafah Islamiyah di timur tengah semacam al-Qaedah, ISIS dan sejenisnya, menjadikan kesan politik Islam yang arogan dan menakutkan. Sementara berpolitik ala pesantren mencerminkan politik Islam yang penuh kedamaian dan persahabatan.

The debate about death penalty, is still attracted attention of people. At least, there are, two mainstream firstly those who agrees and secondly who refuses the death penalty being imposed. Abstract

The more advanced information technology, the more frequently for banking institutions including BRI Syariah to follow and to use it as a part of service system, that is called as electronic banking. The growth of technology will change banking transaction system radically that eventually will change banking culture. The transaction through electronic banking will ease the customers in doing transaction therefore they are able to opt various services related to their need. Tabungan Faedah BRISyariah delivers affordable and easy service by using electronic banking in which all the transactions are free of charge. It starts from cash withdrawal, money transfer to BRISyariah ATM network, BRI Bank, Prima and Bersama. However, since May 6 2015, there was a transaction charge change especially for transaction in Issuer ATM that is BRI ATM, Prima and Bersama. Since the regulation was applied, the number of transactions also changed. According to the data of BRISyariah Issuer ATM transaction from January to December 2015, the total transaction declined. This research is aimed to discover the influence of transaction charge change of ATM card in faedah banking account to the costumers’ proclivity in BRISyariah KC Semarang.The transaction charge change of ATM card having positive influence and significance towards the costumer’s proclivity. The transaction charge such as cash withdrawal, money transfer, and balance check which is very expensive makes the customer’s proclivity declined. It is proved by the value of t-count is 2.878 > t-table which is 2.024 by the degree od significance is 0.000 below 0.05.

Abstract

One of the company's long-term goals is to maximize the firm value. It is the present value of the company, which can be a prospect in the future. Therefore, the problem in this study is the factors that affect the company's value in the Jakarta Islamic Index for 2015-2019. This study analyzes the influence of Intellectual Capital, Good Corporate Governance, and Debt to Equity Ratio on Firm Value directly and indirectly through Financial Performance. The data used in this study is panel data using purposive sampling, and there are 17 stocks listed on the Jakarta Islamic Index for 2015-2019 period. The analysis technique of this research is Partial Least Square. The test results of the direct effect show that Intellectual Capital, Debt to Equity Ratio, and Financial Performance have a significant impact on Firm Value on the Jakarta Islamic Index. Corporate governance has a substantial effect on Financial Performance. Meanwhile, indirect testing proves that the Financial Performance variable can only mediate the impact of Corporate Governance on Firm Value. However, it cannot mediate between the relationship between the variable intellectual capital and debt ratio to equity.

Abstract

This article aims to describe the management of zakat in Indonesia in a political and legal perspective carried out by BAZNAS (Badan Amil Zakat Infaq and Sadaqah) and LAZ (Lembaga Amil Zakat). Management of zakat management in a political-law approach is manifested in the zakat management regulations in Indonesia, namely Law no. 23 of 2011 concerning Zakat Management. Through literature research with a political-law approach, this research finds the following three points. First, the existence of BAZNAS is legitimized by law as a non-structural institution under the President, which has the authority to manage zakat, whether it is the collection, distribution or development of zakat assets. Second, as a consequence, taxes that have been paid through central BAZNAS or regional BAZNAS can reduce taxable assets. Third, BAZNAS has the power to recommend LAZ as well as supervise LAZ's performance at all levels, and the results are reported to BAZNAS.
