Abstract

Pendidikan merupakan elemen dasar dari hak asasi manusia yang dijamin oleh UUD 1945. Sebagai hak fundamental, pendidikan memiliki pengaruh yang signifikan terhadap hak-hak sipil lainnya, seperti ekonomi, sosial, budaya dan politik. Penelitian bertujuan untuk mengkaji produk hukum dan kebijakan lokal di Kota Semarang dalam pemenuhan hak pendidikan dasar bagi masyarakat Kota. Data yang digunakan dalam penelitian adalah adalah data sekunder (bahan hukum) dan kebijakan yang dikeluarkan oleh Pemerintah Kota Semarang terkait dengan upaya pemenuhan hak konstitusional warga masyarakat dalam meraih pendidikan dasar. Hasil penelitian ini menunjukkan bahwa kerangka hukum yang digunakan oleh Pemerintah Kota Semarang dalam memenuhi hak warga masyarakat kota untuk memperoleh pendidikan dasar disandarkan pada ketentuan perundang-undangan di tingkat Pusat. Dalam konteks itu, Pemerintah Kota tidak secara khusus mengeluarkan Peraturan Daerah dan/atau kebijakan yang terkait dengan pemenuhan hak warga atas pendidikan dasar. Namun demikian, komitmen pemerintah Kota dalam memenuhi hak warga atas pendidikan dasar cukup tinggi. Hal itu ditandai dengan semakin sedikitnya angka putus sekolah dan sebaliknya angka partisipasi kasar dalam pendidikan wajib semakin tinggi. Selain itu, komitmen terhadap pendidikan dasar juga ditunjukkan dengan komitmen anggaran APBD yang rata-rata mencapai di atas 30% melebihi ketentuan nasional. Education is a basic element of the human rights guaranteed by the 1945 Constitution. As a fundamental right, education has a significant effect on the civil rights of others, such as economic, social, cultural and political. This study is aimed to examine the laws and local policies in the Semarang City in the fulfillment of the right to basic education for the Citizen of the City. The data used in this study are secondary data (material law) and policies issued by the Government of Semarang City associated with the fulfillment of the constitutional rights of citizens in achieving basic education. The results of this study indicate that the legal framework used by the Semarang City Government in fulfilling the rights of city residents to acquire basic education was based on the statutory provisions at the national level. In that context, the City did not specifically issue a local regulation and / or policies related to the fulfillment of the right of citizens to basic education. However, the city government’s commitment to fulfill the rights of citizens to basic education is quite high. It was marked by the small number of dropouts and vice versa gross enrollment rate in higher education compulsory. In addition, the commitment to basic education is also demonstrated by the commitment of budget allocation that would average above 30% over national provisions.

Abstract

Cases of Gender-based violence increase from year to year and this raises concerns. The phenomenon that puts Boyolali as the district with the highest number of gender-based violence to former residency Surakarta need for follow up. This study aims to get information form of protection and the efforts that have been undertaken by the government of Boyolali District to meet the Constitutional Rights for victims of gender-based violence in Boyolali; Fulfillment of Constitutional Rights for victims of violence against women by the government of Boyolali Regency, among others; Complaint service spread in 19 districts in Boyolali District. Social Rehabilitation Services are given by officers and social rehabilitation. Spiritual guidance services provided by Spiritual guidance counselors are trained for women andChild victims of violence in the integrated service unit. Law enforcement from the level of investigation to court decisions on cases of violence against women and children has been carried out according to the procedure. Legal aid service to women and children of victims of violence. Repatriation of women and children Victims of violence. According to standard that has been set in SPM by 75%. Social re-integration services for women and child victims of violence, according to standards set out in the SPM at 100%

Abstract

Globalization is a global process which is unavoidable by everyone whoKeywords: Globalization, Affirmative Policy, Gender Equality.wants to interact with the international world because those who avoid it willbe isolated from the advance and even from the internationalassociation. Globalization as a must gives big impacts to the human lifeincluding the political, economical, social-culture, and legal impacts. Law is neversterile from the aspects outside law, because law is always dynamic and willfollow the society’s development. When the Globalization era emerges, lawalso follows the rhythm of the latest era. The interesting thing is that law andglobalization is related to the emergence of the movement of awareness on thegender equality in all over the world. The movement which was pioneered bythe feminist movement in all over the world wanted Human Rights equal WomanRights. The existence of CEDAW Convention which was later ratified by theIndonesian government.Gender equality is a hard-struggle of women in reaching the globalcommitment on the respect of Human Rights. Gender inequality is veryapprehensive especially in the developing countries in the world.Inequalities in politics, law, economy, and social cause the low level ofparticipation of women community and relatively have not raised theirfunction as the balanced competitor compared to the men community and thesocial construction that has a significant influence on the gender inequality.Gender equality is a global movement as a reflection on the inequalityagainst women. There is a stereotype or a negative labelling that viewswomen are lower (subordinate) than men. Even, many myths and beliefs thatcause women are often viewed from merely sex aspect, not from their ability,opportunity, and human aspects universally, that is as human being who hasintelligence, logic, feeling, and equality before the law.In the political field, the determination of representative target (quota) is as muchas 30% for women in the candidacy of Members of The House ofRepresentative in central and regional that aims at knowing the correlationbetween the woman representation in the parliament and the process of publicstrategic decision making. It means to see whether the affirmative policyfunctions effectively and is not only formality. Therefore, it caused an obstaclein struggling the strategic issues in the parliament, although the participation ofevery member of the house of representative is open democratically in everystrategic decision making.

Abstract

Pancasila is a view of life and philosophy of the Indonesian people which had once been replaced by the heart of the people of Indonesia by understanding other ideologies. Pancasila is a view of life that has Godhead, which means that humans are creatures who are obliged to believe and worship Him. Pancasila upholds humanity, justice, unity, unity, harmony, harmony and balance. Pancasila is accommodating and follows a democratic government system based on deliberation and consensus policies. Pancasila is practiced through national development in four fields of politics, economy, social culture and defense and security. By exploring the noble values of Pancasila, of course we are aware and confident of the superiority of Pancasila.

Abstract

Kemandirian Desa merupakan tujuan utama dari pemeberian otonomi desa oleh Undang-undang Nomor 6 Tahun 2014 Tentang Desa (“UU Desa”). Sejumlah rekognisi terhadap hak asal-usul desa diberikan oleh UU Desa tersebut. Secara teknis, untuk mewujudkan kemandirian desa supaya makmur dan sejahtera, maka Pemerintah Indonesia membuat kebijakan afirmasi yang sangat kuat dengan dibentuknya Kementerian Desa dan juga dana desa. Penelitian ini menganalisis tentang perwujudan otonomi desa di Indonesia dengan menggunakan metode penelitian studi kasus di Desa Selorejo, Girimarto, Wonogiri, Jawa Tengah. Artikel ini mengklaim, bahwa perwujudan otonomi desa di Indonesia bersifat semu. Hal ini ditunjukkan oleh keharusan desa mengikuti visi-misi Bupati dalam menginisiasi program-program pembangunan desa. Selain itu, intervensi pihak luar desa baik dari pemerintah yang lebih tinggi maupun korporasi dalam pembangunan desa juga sangat besar. Fakta lainnya yang mempengaruhi otonomi desa adalah kuatnya birokrasi pelaporan dana desa, sehingga menjadikan aparatur desa gamang dan takut dalam menyusun program pembangunan desa dan pelaksanaannya. Sebagai akibatnya, kemandirian desa yang dicita-citakan oleh UU Desa berjalan lambat dan kurang inisiatif. Berdasarkan temuan pengabdian ini, maka direkomendasikan agar ada pihak ketiga, seperti perguruan tinggi dan NGOs yang netral untuk melakukan program advokasi dan pemberdayaan kapasitas aparatur dan warga desa, sehingga mereka memiliki kemampuan mengorganisir diri secara independent dalam menyusun dan melaksanakan program-program desa.

Fakta lainnya yang mempengaruhi otonomi desa adalah kuatnya birokrasi pelaporan dana desa, sehingga menjadikan aparatur desa gamang dan takut dalam menyusun program pembangunan desa dan pelaksanaannya. Sebagai akibatnya, kemandirian desa yang dicita-citakan oleh UU Desa berjalan lambat dan kurang inisiatif. Berdasarkan temuan pengabdian ini, maka direkomendasikan agar ada pihak ketiga, seperti perguruan tinggi dan NGOs yang netral untuk melakukan program advokasi dan pemberdayaan kapasitas aparatur dan warga desa, sehingga mereka memiliki kemampuan mengorganisir diri secara independent dalam menyusun dan melaksanakan program-program desa.
