Abstract

A diploma is usually used as one of the conditions to meet the requirements for registration or recruitment from a position. For example, for the nomination of legislative members to be members of the DPR, DPD, Provincial DPRD and Regency DPRD. However, most legislative candidates in the regions do not have genuine diplomas for certain reasons, eventually the legislative candidates use fake diplomas in order to qualify in the general election. The problem studied is how criminal accountability of fake diploma users by DPRD members in legislative elections (Case Example Decision Number: 196 K / Pid.Sus / 2016)? The research method that I use is a normative legal research method which is also supported by interview data. The author analyzes that criminal liability is adjusted to the condition that a person can be held accountable based on criminal acts committed and articles used where the sanctions are there, in this case the article imposed is Article 69 paragraph (1) of the Law on the National Education System. When viewed from a decision that is used as an example by referring to its legal considerations, a court judge has considered everything so that he can be held to hold criminal responsibility and the judge has the right to decide. The author advises to conduct socialization so that there is no indication of the use of fake diplomas, it is necessary to impose a severe sentence for each actor, and the legislative candidates to be honest in nominating themselves as representatives of the people.

Abstract

The paradigm of boundary management of Indonesia Timor Leste region in Atambua Bobonalo has the implementation to the boundary region condition which is relatively isolated and left behind from the economic aspect, defense aspect and national security aspect as well as the legal aspect. It is also required the welfare approach besides the security approach and also the boundary management system which is well and professionally organized. The boundary region needs more attention from the govemment for that side defense and security is very dependent. Infrastructure in Timor Leste boundary development shall be adequate in the context of defense and security such as the weapon system supply, infrastructure and suprastructure boundary development, recognition/protection of indigenous people rights regulations, the drafting and stipulating the cross-boundary regulations as well as the rule of law supremacy and the improvement of the professionalism of govemment officials. All in all, we need to maintain the nationalism to the society at the boundary region, and the implementation of policy pattern approach which would not leave the local wisdom behind.

Abstract

The direct election of regional heads and deputy regional heads by the people is a political process in the regions towards a more democratic and responsible political life. In relation, money politics is a negative behavior because money is used to buy votes or bribe voters or party members in order to win elections. The purpose of this study is to find out how to eradicate money politics in the Regional Head Election through the perspective of criminal law enforcement. This research is expected to have benefits for law enforcement officers, especially in handling corruption crimes in Indonesia, especially for Prosecutors, Judges and District Courts. This research is a normative-empirical legal research. The research is expected to provide input for law enforcement officers, especially in carrying out law enforcement and handling money politics in Indonesia. Proof of money politics will be easy when the arrests have been made. However, the problem is that it is rare for a candidate for regional head or his success team to be caught red-handed during the process of a money politics crime. What happens is people's ignorance that these actions can ensnare themselves into the realm of law. Voters who do not know about this can actually be processed, because they do not know whether they are guilty or not for their actions. Video recordings are evidence that can expedite the legal process. Which means that even though the regional head election has been completed, the public is still given stimulation on how a person can be charged with the law if proven to have committed a crime of money politics, both giving and receiving. Pemilihan Kepala Daerah dan Wakil Kepala Daerah secara langsung oleh rakyat merupakan suatu proses politik di daerah menuju kehidupan politik yang lebih demokratis dan bertanggung jawab. Dalam kaitannya, Money politics merupakan tingkah laku negative karena uang digunakan untuk membeli suara atau menyogok para pemilih atau anggota-anggota paratai supaya dapat memenangkan pemilu. Tujuan penelitian ini ialah mengetahui bagaimana pemberantasan politik uang dalam Pemilihan Kepala Daerah melalui sudut pandang penegakan hukum pidana. Penelitian ini diharapkan memiliki manfaat bagi aparat penegak hukum khususnya dalam melakukan penanganan tindak pidana korupsi di Indonesia, terlebih pada Jaksa, Hakim dan Pengadilan Negeri. Penelitian ini merupakan penelitian hukum normatif-empiris. Penelitian diharapkan dapat memberikan masukan bagi aparat penegak hukum, khususnya dalam melakukan penegakan hukum dan penanganan money politic di Indonesia. Pembuktian politik uang akan menjadi mudah ketika sudah dilakukan tangkap tangan. Namun, yang menjadi masalah ialah bahwa jarang sekali ada calon kepala daerah maupun tim suksesnya yang dapat dilakukan tangkap tangan saat proses tindak pidana politik uang itu dilakukan. Yang terjadi justru ketidaktahuan masyarakat bahwa tindakan tersebut dapat menjerat dirinya sendiri ke ranah hukum. Pemilih yang tidak mengetahui akan hal ini justru dapat diproses, sebab mereka tidak mengetahui apakah mereka bersalah atau tidak atas perbuatan mereka. Rekaman video merupakan alat bukti yang bisa melancarkan proses hukum. Yang artinya walaupun pemilihan kepala daerah sudah selesai, namun masyarakat tetap diberikan stimulasi tentang bagaimana seseorang bisa dijerat hukum jika terbukti melakukan tindak pidana politik uang, baik itu yang memberi maupun yang menerima

Abstract

In line with the rapid development of technology, goods will increase and new innovations from foreign countries will emerge. Sex toys are tools in sexual relations that are useful for self-pleasure. The users of these sex aids come from all age groups, from teenagers to the elderly, even sex toys are very easy to find because there are many selling them on social media. These objects have positive and negative impacts on the younger generation, especially on minors. The research method used is normative research. The results of the study show that actually the rules regarding sex toys do not have specific rules, but the relationship between sex toys and other laws has a relationship, namely the Criminal Code, Law no. 44 of 2008 concerning Pornography, Law No. 17 of 2006 concerning Customs. With this there must be legal certainty from the government so that the sale of sex toys is not misused by the public and does not raise doubts for sellers and buyers of sex toys.

Abstract

Today's criminal acts of fraud continue to develop following the development of existing technology, existing legal regulations function to overcome this, but existing regulations cannot reduce these crimes but increase them. This study aims to find out how existing law enforcement is against criminal acts of fraud through electronic systems, knowing various kinds of inhibiting factors in enforcing criminal law against a crime of fraud. This research was carried out using normative juridical methods through library research by examining secondary data including regulations legislation, research results, scientific journals and references. The results of the study provide an illustration, where criminal acts of fraud through electronic systems are in principle the same as fraud in conventional ways, but the difference lies in the evidence or means of action, namely using electronic systems (computers, internet, telecommunication devices), because that is law enforcement. Fraud crimes can still be overcome by Article 378 of the Criminal Code concerning fraud and Article 28 Paragraph (1) of the ITE Law concerning Information and Electronic Transactions Furthermore, obstacles in law enforcement against criminal acts of fraud based on electronic transactions are still influenced by five factors, namely legal factors, law enforcement factors , factors of facilities or facilities that support law enforcement, social factors and cultural factors.

Abstract

Instansi pendidikan seharusnya menjadi tempat teraman kedua setelah rumah, namun kekerasan seksual dapat terjadi di lingkungan sekolah. Kekerasan seksual dapat berdampak serius baik secara fisik, psikologis, serta mengganggu proses pendidikan mereka. Perlindungan hukum diperlukan untuk memastikan keadilan korban dan mencegah terjadinya kekerasan seksual di lingkungan pendidikan. Jenis penelitian hukum yang dilakukan secara yuridis normatif dengan menggunakan data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dengan penelitian kepustakaan yaitu data kepustakaan yang diperoleh melalui penelitian kepustakaan yang bersumber dari peraturan perundang-undangan, buku-buku, dokumen resmi, publikasi, dan hasil penelitian yang relevan. Sedangkan untuk teknik analisis data bersifat deskriptif kualitatif dengan menguraikan dan dipaparkan secara deskriptif. Hasil penelitian ini adalah kasus pelecehan seksual terhadap anak usia sekolah di lingkungan sekolah yang dilakukan oleh pendidik dan atau tenaga kependidikan akan dikenakan sanksi pidana untuk mempertanggungjawabkan perbuatannya dengan sanksi yang diberikan lebih berat daripada yang dilakukan oleh orang lain (selain orang terdekat korban).

Abstract

This study aims to determine the application of Restorative justice in the form of a judge's pardon for the crime of theft committed by seniors over 70 years of age. The research carried out in this study is empirical juridical research, which is carried out directly in the field to find out the real problems that occur, and then it will be connected with the applicable laws and regulations and existing legal theories. The results of the study show that the application of a new Restorative justice in the form of a judge's apology to the perpetrators who are 70 years old because they are no longer productive is deemed ineffective if imprisoned and also that the country of Indonesia is a country that has eastern customs, which means that the culture of the Indonesian state is making a decision by deliberation to reach a consensus or in other words, Restorative justice provides an opportunity for the perpetrator to become a better person so that he can organize his future life for the better, rather than having to prioritize a retributive justice system that prioritizes the imposition of law on the physical perpetrator by confining him in in detention/prison. Penelitian ini bertujuan untuk mengetahui Penerapan Restorative justice Dalam Bentuk Permaafan Hakim Dalam Tindak Pidana Pencurian Yang Dilakukan Oleh Lansia Diatas 70 Tahun. Penelitian yang dilakukan dalam penelitian ini adalah penelitian Yuridis empiris yang dilakukan secara langsung di lapangan untuk mengetahui permasalahan yang sebenarnya terjadi, kemudian akan dihubungkan dengan peraturan perundang-undangan yang berlaku dan teori hukum yang ada. Hasil penelitian menunjukkan bahwa penerapan baru sebuah Restorative justice dalam bentuk permaafan hakim kepada para pelaku yang berusia 70 tahun karena diusia yang sudah tidak produktif dirasa tidak efektive jika dimasukan di dalam penjara dan juga negara Indonesia merupakan negara yang memiliki adat ketimuran yang artinya budaya negara Indonesia adalah mengambil sebuah keputusan dengan musyawarat untuk mufakat atau dalam kata lain dari Restorative justice memberikan kesempatan kepada pelaku untuk menjadi sosok yang lebih baik agar dapat menata kehidupan kedepannya menjadi lebih baik,  dibandingkan harus mengedepankan system retributive justice yang lebih mengedepankan penjatuhan hukum terhadap fisik pelaku dengan mengurungnya di dalam tahanan/penjara.
