Abstract

Marriage is one of the sunnah and things chosen by Allah, to reproduce offspring, and to continue human life. So that the practice of marriage has various purposes, namely to maintain offspring, to continue and maintain the safety of life between humans, because it is a form of ta'abbudiyah (servitude) and obedience to every command. This paper aims to examine what is meant by Nikah Misyar and how the law and Maslahah and Mafsadah are. This research is in the form of literature review where the legal source comes from documents or books in accordance with the theme of this research. The data that has been collected is analyzed in the context of mu'tabarah fiqh, so that it gets good and comprehensive analysis results. The scientific study of Misyar Nikah should further spread the explanation of Maslahah and Mafsadah especially to the common people, especially in Indonesia.

Abstract

Grant practice is a transaction that is commonly done by the community. Apart from that, the grant is a sunnah work that is highly recommended carried out by Muslims. The Compilation of Islamic Law (KHI) and the Civil Code (KUHPerdata/BW) have governed the implementation of grants in Indonesia. basically the purpose of the grant between husband and wife to improve the quality of family relationships that love each other. However, not all good intentions and objectives have good consequences, moreover the actions taken are not based on careful calculation. Grants between husband and wife in the Compilation of Islamic Law are permitted. That is because there are no provisions that state who is entitled or not entitled to receive or give grants. While regarding the grants between husband and wife, the Civil Code said differently. In the Civil Code, grants between husband and wife during marriage are prohibited.

Abstract

'Iddah is a waiting period that must be lived by a woman due to the termination of the marital relationship, either due to divorce or death, in order to restore mental or physical condition after being left by her husband. The implementation of 'iddah in the jahiliyyah period is considered no longer appropriate to be applied today because, at that time, a wife whose husband died would be placed in a hut (a small, fragile, and old house), given the ugliest clothes, not allowed to wear clothes. Perfume, so that the smell is very unpleasant, then brought himar animals, goats, or birds and then occupied with him. The majority of women today have a myriad of activities outside the home as career women, which sometimes makes some of them the backbone of the family, whether they are with their husbands or not. Some scholars' to leave the house, if it is in an emergency, the state of emergency is understood differently by ulama' Usul al-fiqh. Such as, al-Shatibi understands the meaning of emergency with an essential need to be maintained. a woman whose husband dies, then she has to provide for her family, then she is allowed to leave the house because she is in an emergency

Abstract

In principle, the responsibility of caring for children is the burden of both parents, whether they are still living in harmony or a divorce has occurred. Hadanah itself is an act that must be carried out against their parents, because without Hadanah it will result in the child being neglected and his life is wasted, because if the child is still small or not yet mumayyiz, it is very well nurtured and educated, and will have a negative impact on their future. , can even challenge the existence of their soul. Child care, in the view of KHI, includes all the needs that can support the development of the child's life both in the scope of primary and secondary needs, such as the need for education, living expenses, peace of life, welfare, especially in health.In Shafi'i's view regarding child custody (hadanah), children who are seven years old are allowed to choose for themselves if both parents are equally worthy to take care of their hadhanah, be it in matters of religion, property or affection. so the child is invited to choose it, on the grounds that the child is considered to be able to distinguish which one is good and what is bad for himself, therefore the child is given the freedom to choose what he thinks the child is able to make his own choice whether to follow his mother or follow his father .

Abstract

In the context of inheritance law, children are a separate discussion, because the presence of a child makes a very exciting thing for every couple. It is easy for those who are biological children, because it will not cause a problem if he gets a share of the inheritance of his parents because he is one of the legal heirs. However, the context is different if this happens to an adopted child who does not actually get a share in the inheritance law. so that researchers feel the need to do a research related to the inheritance of adopted children, how to divide inheritance, a forum for adopted children to get inheritance, and legal force which is evidence that adopted children are entitled to inherit property By using the library research method, the researcher found that the adopted child could inherit the inheritance from his adoptive parents through the mandatory will process with the provision that it should not be more than 1/3 of the inheritance of his adoptive parents before it was distributed to other heirs. With this decision, it is necessary to have an authentic deed from the notary as strong evidence for the adopted child if in the future there is a dispute regarding the assets he has received. The decision from a notary in the form of an authentic deed is evidence that has the highest legal force in overcoming disputes related to the distribution of inheritance.

Abstract

Praktek riba dalam kehidupan  masyarakat dinyatakan oleh Islam sebagai sesuatu yang dilarang dan merupakan salah satu permasalahan yang berkaitan dengan perekonomian. Praktik riba dianggap dapat  menghalangi laju ekonomi sebagai mana riba dapat menarik seluruh pendapatan masyarakat. Larangan riba sebenarnya sudah tegas dan jelas dalam Al-Qur'an dan Hadis. Stuktur keuangan Islam berkisar pada larangan atas penghasilan apapun yang berasal dari pinjaman/utang (riba) dan legalitas riba. Riba yang secara umum dikenal sebagai bunga dipahami sebagai tambahan yang diambil sebagai premi dari debitur. Pelarangan riba, pada hakekatnya adalah penghapusan ketidakadilan dan penegakan keadilan dalam ekonomi. Lulusan dari SMA Nurul Jadid selain menjadi alim sesuai jurusannya, namun juga harus terdidik dari sisi karakternya. Pada hal tentang transaksi Islam, SMA Nurul Jadid juga mempraktekkan transaksi ekonomi Islam, hal ini diwujudkan dari transaksi yang berlaku di Koperasi sekolah tersebut, selain itu pemahaman tentan perkara riba, ternyata masih minim oleh siswa tersebut. Dalam konteks internal, perlu adanya pendampingan terhadap generasi muda, untuk bisa memberikan edukasi awal tentang bahaya riba terkhusus pada internal PP Nurul Jadid. Fokus pada pengabdian ini, adalah siswa SMA Nurul Jadid Paiton Probolinggo, nantinya diharapkan para siswa tersebut memiliki pemahaman dan pandangan tentang bahaya riba pada transaksi yang akan dilakukan dikemudian

Abstract

Tatanan masyarakat Muslim Nusantara terbangun karena adanya hubungan antara ekonomi, pendidikan, dan politik. Karena, sendi sendi kebudayaan atau tradisi suatu bangsa pada dasarnya dibangun melalui proses ekonomi-akumulasi modal, pendidikan-akumulasi pengetahuan dan politik-akumulasi kekuasaan yang berkuasa. Sisi lain, perkembangan ekonomi di Indonesia semakin berkembang, dengan dibuktikan banyak berdirinya lembaga keuangan syariah yang sudah menjadi sendi kehidupan ekonomi di Indonesia, meskipun pada prakteknya masih terdapat pada wilayah kota saja. Lembaga pendidikan, khususnya pesantren bisa mengambil peran untuk perkembangan ekonomi tersebut, dengan mendirikan lembaga keuangan di internal sendiri, dalam konteks ini dengan mendirikan Bank Mini Syariah, melalui kerjasama dengan perbankan syariah yang telah ada. Keberadaan Pesantren Nurul Jadid tak lepas dari konstruksi kemasyarakatan yang mencitakan suatu transendensi atas perjalanan historisitas sosial. Hal yang menjadi titik penting adalah kenyataan eksistensi pesantren sebagai salah satu pemicu terwujudnya kohesi sosial. Keniscayaan ini karena pesantren hadir terbuka dengan semangat kesederhanaan, kekeluargaan dan kepedulian sosial. Pesantren Nurul Jadid sangat berpeluang untuk mendirikan Bank Mini Syariah sebagai layanan ekonomi masyarakat pesantren serta menjadi laboratorium bagi berbagai jurusan yang berhubungan dengan keuangan, selain itu pesantren memiliki kekuatan aset keuangan dari masyarakat pesantren yang dikemudian hari menjadi nasabah

Abstract

seeing the needs of the people in this disruptive era, the legal assurance and protection of halal product is very urgent for this, in live with the existing probematics. Having the legality of halal certification can become a standard measure of product. So in this case the state acts as a supervisor by making certification a mandatory tool . The legality of halal certification provides assurance and protection in a disruptive era. If judging in the era of disruptive, the legality oh halal certification is very urgent in a product.. This resecrh uses the type of library research with data analysis techniques. The results show that the inalibility of consumers to evaluate this, si it requires an institution that has the qualifications to evaluate it. That institution will be entitled to certify a product. After this BPJPH has been formally legalized by the goverment, the authority to issue halal certfition is in the hand of BPJPH as the halal certification guarantor institution under the auspices of the ministry of religion. Abstract

The reform of ushul fiqh is perhaps the most significant achievement in the rebirth of Islamic philosophy. Only when people realize the phenomenon of stagnation of traditional fiqh can ushul fiqh be renewed. This awareness can only be built if people realize the need for reform of religious thought and practice it on a large scale. Many scholars propose a reconstruction of ushul fiqh, intending to show that religion can be used to solve everyday problems. Sheikh Ali Jum'ah, Izzudin Ibn Abdus Salam, and Ibn Ashur were prominent figures. Brilliant ideas and practical solutions seem to have entered the paradigm of Indonesian Islamic thought, especially the paradigm of ushul fiqh reform, which is still stagnant. Another weakness of fiqh and ushul fiqh is that there is no dynamic relationship between them and the social sciences, thus losing their relevance to the needs of the people. The mufti of Egypt, Sheikh Ali Jum'ah, also had the same view regarding the reformulation of Usul fiqh produced by previous scholars. So that Usul fiqh can be more developed and adaptive to new problems. Sheikh Ali Jum'ah's tajdid offer, namely: Restoring the old study form of ushul fiqh with an updated structure; Returning several views on several issues and using new opinions on existing problems, as well as reusing aqli in discussing these problems; Returning some views on the application of the rules to this science and in this application sticking to other views; Restoring this scientific structure by the novelty of the illat, and make this renewal according to the character of ushul fiqh according to their respective streams.
