Abstract

The earth atmosphere temperature is rising due to the increasing greenhouse gases. Facing the problem, the international community establishes the Climate Change Convention. One of main activities mention in that convention is to reduce deforestation and forest degradation. It has been four decades Indonesia ratified various convention relating to forest sustainability but the deforestation and forest degradation is still accelerating. This study analyzes the compatibility of the conventions on climate change in forest management in Indonesia. The research uses the narrative analysis method. Main result of the research shows that there is a discrepancy between the narrative of convention on climate change and the management of Indonesia forest. The work of the convention in Indonesia forest management requires some options related to incentives and fair access to forest uses.

Abstract

This study aims to analyze the substantial weaknesses of water utilization regulations in wildlife reserves, national parks, forest parks, nature tourism parks, and their effects on individual or organizational decision[1]making and actions. The research location is in the area of Taman Nasional Gunung Gede Pangrango (TNGGP). The analysis of this research is limited to Environment and Forestry Ministerial Regulations No. P.18/MENLHK/ SETJEN/KUM.1/4/2019, Law No. 17 of 2019, and Environment and Forestry Ministerial Regulations No. P.6/ MENLHK/SETJEN/KUM.1/1/2020. Regulatory analysis is carried out by identifying the characteristics of content of the regulations and comparing them with the conditions of water utilization in TNGGP to find out the implications of regulations on participant behavior and performance. Issues and problems are collected through interviews with participants. Furthermore, the regulations are analyzed using Ostrom's rules-in-use concept. The findin , based on the concept is that there is a discrepancy in the three regulations that all regulate water utilization permits in the conservation areas. This is mainly due to weak institutional strengthening among decision makers as well as laws and regulations made according to the interpretation of the government which often do not consider the conditions of the community.

Abstract

In forest management unit (FMU) operationalization, stakeholders are skeptical on the legitimacy of FMU policy, happening along their interaction. This interaction could encourage or inhibit the FMU policy adoption. This study goals is to analyze the FMU operationalization process and its influencing factors. Operationalization process is analyzed by analysis of qualitative descriptive based on stage of implementation and confirmation. Stakeholders interaction are analyzed by IDS method i.e. interaction between discourse/narrative, actors/networks and politics/interest. The results showed that FMU policy hasn't been fully recognized by stakeholders. Factors that affect the FMU policy operationalization are the clarity and adequacy of FMU authority, legitimacy of FMU policy and managements rights, the stakeholders support related to legality (regional policy) and action, and psychological barriers and trusts. Indicative strategies to overcome obstacles of the FMU operationalization are to establish and maintain the trust of stakeholders to support FMU operationalization bycommitment to a common goal in the FMU establishment, activity allocation suitable to the adopter needs, and participatory planning.

Abstract

Legal certainty and legitimacy of forest area can be gained through the gazettment process of forest area that starts from the designation, boundary demarcation, mapping, and ends up with the establishment. In Riau Province, these processes are stagnant, and, therefore, the legal certainty and legitimacy is difficult to achieve. What is really happenned is something that needs to be answered in this study. By using the analysis of strategy typology and descriptive qualitative analysis, this study has found that the gazettment issues of forest area consisted of three aspects, namely: designation, boundary demarcation and establishment. Social conflict has been accumulated along the gazettment process, so that the legal certainty did not lead to legitimacy. This problem happened due to: claims avoidance (PTB) to avoid failure in boundaries determination; policy narrative of the boundaries are not informed to community; inconsistency between the objective of boundary demarcation with the implementation; domination of all informed knowledge and information (BPKH); stages of gazettment were done just to fulfill administrative procedure; BPKH tasks issues; and state forest area regarded as the common pool resources (CPRs). This result proves that the improvement of government, policy in gazettment of forest area is seriously required.

Abstract

East Kalimantan has coal deposits of 37.5 billion tons and its coal business is very complex with numerous conflicts happened in the field. The objectives of the study were as follows: (i) to review the progress of coal mining business, (ii) to analyse the legal license of coal mining, (iii) to  identify overlapping policies on coal mining, and (iv) to  formulate policies on conflict resolution of coal mining in the forest areas. The results of study showed that annual coal production and export achieved 192.97 million tons and 145.82 million tons, respectively. At present, the number of coal mining business in the forest achieved 159 units which cover forest areas of 362,061 ha. However, the number of unprocedural coal companies reached 223 units with an area of 774,519 ha, or twice the legal business unit.  Conflict cases of coal mining in the forest areas are mainly due to poor  governance licensing, that trigger the conflict between mining companies and forest companies in the field due to overlapping operational area. Five recommended actions should be considered in order to resolve conflicts of coal mining in the forest areas, namely, implementation of monitoring, controlling and law enforcement, regulation harmonization, implementation of good mining governance, implementation of good communication and coordination, and implementation of one map policy.

Abstract

The style of the party facing a conflict (conflict style) needs tobe known to  find an effective dispute resolution. The main actors and supporting actors and interests/role and influence or power and its relationship needs to be carefully mapped. What are the actions that can be taken to resolve the conflict based on the style of the parties is something that needs to be answered in this study. In this study conflict styles of actors assessed  using conflicts style analysis (AGATA). This study shows that the conflict-style compromise, accommodation and collaboration facilitated and mediated for proposing Village Forest, Community Forest Partnership  to obtain legal recognition on managing state forest land as well as recognizing state forest, hence the issuance of permits The Village Forest and Community Forest Partnership can be  accelerated. The role of outside parties who are not related with conflict is essential to facilitate and mediate the parties to a conflict resolution. Competing parties need  to be  mediated so his style could change to compromise, accommodation or collaboration. Even if his style would remains unchanged it  will result in a constructive option to acquire rights to the land through forest discharge process. To the avoiding-style party an  intensive communication needs to be done  in order to be aware of the conflict or change his style to compromise.
