Abstract

Tujuan jangka panjang yang ingin dicapai dalam kebijakan hukum pidana melalui peraturan perundang-undangan adalah memposisikan pengguna narkotika sebagai korban yang membutuhkan rehabilitasi baik medis maupun sosial, bukan sebagai pelaku kriminal yang dijatuhi pidana penjara dan dimasukkan ke lembaga pemasyarakatan. Hal ini sangat penting mengingat data BNN menunjukan 80% pengguna narkotika adalah remaja. Provinsi Jambi sepanjang tahun 2011 menempati urutan ke-13 wilayah terbesar penyalahgunaan narkotika. Pengguna narkotika menurut Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika menempatkan pelaku pengguna narkotika sebagai pelaku tindak pidana sebagaimana dirumuskan dalam Pasal 127 ayat (1) huruf a yang menyebutkan bahwa pengguna narkotika diancam dengan pidana penjara maksimal 4 (empat) tahun. Tulisan ini bersifat empiris (empirical research) berdasarkan penelitian lapangan di Pengadilan Negeri Jambi, BNN Provinsi Jambi, RSJ Jambi, dan LSM Granat. Analisis dilakukan terkait perumusankebijakan hukum pidana dalam memandang pelaku pengguna narkotika sebagai korban tindak pidana. Data lapangan menunjukkan bahwa hampir 99% putusan hakim pengadilan negeri terhadap pengguna narkotika masih berupa pidana penjara walaupun 92% hakim pada Pengadilan Negeri se-Provinsi Jambi mengatakan bahwa pidana penjara bukan merupakan tindakan yang tepat, sementara putusan hakim merupakan gerbang utama dalam penanggulan tindak pidana. Criminal Law Policy on Drug Abuser as Victim in Lieu of Criminal Suspect: Field Study in JambiAbstractThe long term goal sought abuser by criminal law policy through legislation is to put drug abusers in the position of victims in need of rehabilitations both medically and socially, and not as criminals who have to be sentenced and sent to the jail. This shift of paradigm is important as the data from Indonesian National Narcotics Board shows that out of 80% of the drug abusers are mostly teenagers; and in 2011, Jambi Province ranked 13th in Indonesia as the region with the biggest number of drug abusers. Drug abusers, according to Law Number 35 Year 2009 on Narcotics, are positioned as criminals. As formulated in the Article 127 (1) a, drug abusers are sentenced withthe maximum of 4 (four) years of prison. The field data shows that almost 99% of the sentences passed by the judges in district courts are still in the form of prison sentences, although almost 92% Judges in Jambi District Courts argue that jail time are not the proper legal sentence for drug abusers. This is quite unfortunate since judicial verdicts should be the main gate of the criminal law prevention. Abstract

This research is a multi-years research that is planned to be completed in 2 (two) years.  In this year this research aims to see the implementation of child offender in The Children Penitentiary  Sei. Bulu Muara Bulian Jambi. This research is an ?Empirical Research?, that conducted  field research on The Child Penitentiary Sei. Bulu Muara Bulian, and conduct interviews to Children Inmates and   observations tothe implementation of the development ofthe children inmates, in addition this research also conducted on The Law and Human Rights Ministry of Jambi. The result of the research shows in The Children Penitentiary Sei. Bulu Muara Bulian Jambi not only populated by children in mates, but also combined with adult female in mates. The result of the field research on the 27 may 2015 the number ofadult female in mates reached47 (Forty-seven) people, the number ofchildinmatesare36 (thirty six) people. The results offield research hasserious problems: 1) from Goal of Development aspect ofthere isa big differences, the purpose of fosteringa child in mates are education and training while the fostering goal of adult women in mates are correctional. 2) From the practical aspectsof the available labor builder is a builder who should have the power (tupoksi) to foster in mates child obtains heavier burden than duties that are supposed, the obligation to implement the guidance to adult female in mates. 3) From the aspect of facilities there is no additional facilities relating with the increasing of the work load. 4) from the aspects of employee resources builder also there is no special addition.The head of the law Ministry and Human Rights Jambi province says the consideration of the merger because of the proximity characteristic still possible to combine. Seeing the empirical condition shows the needs  for the application of Law No.11 of 2012 concerning Juvenile Justice System where the children criminals tries to avoid a child in the punishment imprison ment through the efforts diversion andrestorative justice. The research on the effectiveness of restorative justice through the application of this diversion will be continued in the research studyon the second year. Abstract

This research aims to analyze protection policies for health workers amidst COVID-19. Through statute approach and based on the rights theory, this study examines legal development, or legal framework is needed to formulate and to protect health worker. Since the COVID-19 outbreak spreads quickly and massively, Health worker is at the forefront of handling COVID-19, but they are also vulnerable to get infected by the virus. Some cases showed that many health workers tested positive after providing health services. The findings of the research showed that the right of medical workers to get personal protective equipment and safety guarantees were not enough to protect them. On the other hand, the community was still ignoring the risk of this disease and broke the health protocol in the public place. Health workers can perform their job effectively if people are in healthy condition and do not need to go to the hospital. To containment measures of the COVID-19 State has to choose one of the effective ways to protect people and health workers by regulating and giving a penalty to the perpetrators of the COVID-19 protocol.

Abstract

The massive forest and land fires in Indonesia have been raging and caused haze disaster. The haze disaster is not suffered only in Indonesian territory, but it has become a transnational disaster resulting in extensive economic and health quality losses. In addition, the disaster has led damage to agricultural land and disruption of diplomatic relations among affected states. The number of perpetrators of forest and land fires that increase annually shows that the enforcement of criminal law is relatively ineffective. This article covers the problem whether the principle of strict liability can be applied to the perpetrators of forest burning. In 2019, forest fires in the Jambi Province had took placed in estimated 165.86.58 hectares. The forest fire is the main source of transnational haze disaster. Law enforcement on forest fires in Jambi has not provided a deterrent effect yet. There are forty-six companies acquiring fires in their concession land areas. Unfortunately, only four of them reached court proceedings and only two companies were declared guilty by the court. Therefore, as a deterrent effort, the principle of strict liability can be applied as the main principle to handle perpetrators of forest burning. Penerapan Asas Strict Liability (Tanggung Jawab Mutlak) terhadap Pidana Pelaku Tindak Pidana Membakar Hutan dan LahanAbstrakTingginya tingkat kebakaran hutan dan lahan yang berdampak pada bencana kabut asap, tidak hanya berdampak di wilayah Indonesia tetapi juga menjadi bencana lintas negara serta mengakibatkan kerugian yang luas, termasuk kerugian ekonomi dan kerugian akan mutu kesehatan, rusaknya lahan pertanian serta berakibat pada terganggunya hubungan diplomatik antar negara yang turut serta terdampak. Melihat pada banyaknya pelaku pembakaran hutan dan lahan yang berulang setiap tahunnya menunjukan bahwa penegakan hukum pidana melalui pemidanaan pelaku tidak efektif. Maka permasalahan dalam artikel ini adalah apakah asas strict liability ini dapat diterapkan dalam pertanggungjawaban pidana pelaku tindak pidana pembakaran hutan dan lahan sebagai upaya penjeraan pada pelaku? Kondisi empirik kebakaran hutan di Jambi pada tahun 2019 memperlihatkan luas  wilayah yang terbakar mencapai 165.86.58 hektare yang merupakan sumber penyebab utama bencana asap lintas negara. Penegakan hukum atas bencana kebakaran hutan dan lahan di Provinsi Jambi belum memberikan efek jera, dari 46 (empat puluh enam) Perusahaan yang mengalami kebakaran di wilayah konsesinya, hanya 4 (empat)  perusahaan yang perkaranya sampai pada proses peradilan dan dari 4 (empat) perusahaan tersebut hanya 2 (dua) perusahaan yang dinyatakan bersalah oleh pengadilan. Abstract

ABSTRAK Tujuan Penelitian ini adalah untuk mengetahui dasar pertimbangan hakim dalam penerapan pidana penjara sebagai pengganti pidana denda dalam putusan kasus narkotika. Penelitian ini merupakan penelitian yuridis normatif yaitu dengan mempelajari peraturan perundang-undangan yang berlaku yang berhubungan dengan putusan pengadilan tentang tindak pidana narkotika. Hasil penelitian ini menunjukkan bahwa akumulasi antara pidana penjara dan pidana denda dalam undang-undang narkotika ini belum efektif karena dalam penerapannya pidana denda tidak pernah dibayarkan oleh pelaku. Pelaku lebih memilih untuk menjalankan pidana pengganti berupa pidana penjara. Hal ini menguatkan pendapat bahwa persoalan ini terjadi karena pidana penjara pengganti denda rendah sehingga cenderung lebih menguntungkan terpidana secara pragmatis. Disarankan pembuat kebijakan hendaknya memperhatikan efektivitas penetapan sanksi pidana denda dengan merumuskan peraturan perundang-undangan yang seimbang antara beratnya pidana penjara yang dijatuhkan dan pidana penjara pengganti denda. ABSTRACT This article seeks to analyze basis of judge's consideration in exercising imprisonment as a substitute for criminal fines in narcotics abuse case. As a normative juridical research, this study examines laws and their application to court decisions regarding narcotics crime. The results of this study demonstrates that the accumulation of imprisonment and criminal fines in the narcotics' law has not been effective to urge the perpetrator pay criminal fines. In reality, the perpetrator pragmatically prefers carrying out imprisonment to substitute sanction. The result of this research has supported the idea that the problem behind the application of imprisonment as a subtitute of fines tends to be pragmatically favourable to that of fines sanction. It is recommended that the policy-makers pay attention to the effectiveness of the stipulating criminal sanctions in the form of fines by formulating a balanced legislation between the severity of imprisonment and its substitute in the form of fines sanction.

Abstract

ABSTRAK Artikel ini menganalisis pelaku penyalah guna narkotika anak dalam perspektif victimologi sehingga tujuan artikel ini untuk mendapatkan kejelasan, mengkaji dan menganalisis mengenai kebijakan hukum pidana mengenai viktimisasi anak penyalah guna narkotika.Penelitian ini merupakan penelitian normatif yaitu penelitian yang dilakukan secara kepustakaan dengan mendeskripsikan hukum positif, mensistematisasi, menginterprestasikan, menilai, dan menganalisis hukum positif tersebut.Hasil penelitian pelaku anak sebagai penyalah guna narkotika menunjukan pemidanan berupa pidana penjara masih dominan dibandingkan sanksi untuk direhabilitasi.Hal ini menunjukan bahwa anak sebagai penyalah guna narkotika dalam perspektif hukum pidana saat ini masih dipandang senagai kriminal atau pelaku tindak pidana.Hal inilah yang menarik untuk dikaji anak sebagai penyalah guna sebaiknya tidak dikatagorikan sebgai pelaku tindak pidana tetapi lebih dipandang sebagai korban dari tindak pidana narkotika dan sebagi korban ketidakmampuan negara dalam penangguangi tindak pidana narkotika di Indonesia. ABSTRACT This article analyzes child narcotics abusers from a victimology perspective so that the purpose of this article is to get clarity, study and analyze the criminal law policy regarding the victimization of child abusers of narcotics. This research is a normative study, namely research conducted in a literature describing positive law, systematizing, interpreting, assessing, and analyzing the positive law. The research results of child offenders as narcotics abusers show that imprisonment is still dominant compared to sanctions to be rehabilitated.This is what is interesting to examine as children as abusers should not be categorized as perpetrators of criminal acts but rather as victims of narcotics crimes and as victims. the inability of the state to tackle narcotics crime in Indonesia.

Abstract

This study aims to identify and analyze criminal law enforcement and obstacles in criminal law enforcement to Article 137 Paragraph (4) of the Law on Road Traffic and Transportation in the jurisdiction of the Kuala Tungkal District Court. The research method used was juridical empirical and the sampling method was carried out by using purposive sample and simple random sampling method. Constraints faced in enforcing the criminal law against Article 137 Paragraph (4) of the Law on Traffic and Road Transportation in the jurisdiction of the Kuala Tungkal District Court, among others, the legal substance in the criminal provisions is limited to imprisonment and very light and cheap fines, limited personnel of the Traffic Police in conducting surveillance, lack of guard posts and official vehicles owned by the Traffic Police. so it is necessary to increase the socialization or legal counseling to the public regarding Article 137 paragraph (4) of the Law on Road Traffic and Transportation, and the government is responsible for the provision of proper transportation vehicles for people to create orderly, safe and comfortable traffic in the community. Abstrak Penelitian ini bertujuan  untuk mengetahui dan menganalisis penegakan hukum pidana dan kendala dalam penegakan hukum pidana terhadap Pasal 137 Ayat (4) Undang-Undang Tentang Lalu Lintas dan Angkutan Jalan di wilayah hukum Pengadilan Negeri Kuala Tungkal. Metode penelitian yang digunakan adalah Yuridis Empiris dan tata cara penarikan sampel dilakukan dengan metode Purposive Sampel dan Simple Random Sampling. Kendala yang dihadapi dalam penegakan hukum pidana terhadap Pasal 137 Ayat (4) Undang-Undang Tentang Lalu Lintas dan Angkutan Jalan di wilayah hukum Pengadilan Negeri Kuala Tungkal, diantarnya substansi hukum pada ketentuan pidananya hanya terbatas pada pidana kurungan dan denda yang sangat ringan dan murah, terbatasnya personil Polisi Lalu Lintas dalam melakukan pengawasa, kurangnya pos penjagaan dan kendaraan dinas yang dimiliki oleh Polisi Lalu Lintas. sehingga perlu  ditingkatkan sosialisasi atau penyuluhan hukum kepada masyarakat mengenai Pasal 137 ayat (4) Undang-Undang Tentang Lalu Lintas dan Angkutan Jalan, serta pemerintah bertanggung jawab terhadap penyediaan mobil angkutan orang yang layak agar terciptanya lalu lintas yang tertib, aman dan nyaman dalam masyarakat.

Abstract

This study aims 1) To find out and analyze how the criminal law enforcement against illegal drilling actors in the legal area of ​​the Muara Bulian District Court; 2) To find out and analyze what are the obstacles found by enforcement of the Illegal Drilling Criminal Law in the Legal Area of ​​the Muara Bulian District Court. The method used is the empirical juridical research type. The results showed that 1) In enforcing criminal law against perpetrators of illegal drilling in the jurisdiction of the Muara Bulian District Court, there are still obstacles and cannot run properly because there are still weaknesses in the factors that affect law enforcement; 2) Constraints in the criminal act of illegal oil mining (illegal drilling) in Batanghari Regency, this is due to the lack of legal awareness of the community, regarding illegal oil mining activities (illegal drilling), the difficulty of proving criminal acts due to lack of evidence or not. There is evidence and the number of investigating officers does not match the number of cases that have occurred and due to the vast jurisdiction of Batanghari Regency which makes it difficult to enforce the law in that jurisdiction. Abstrak Penelitian ini bertujuan 1) Untuk mengetahui dan menganalisis bagaimana penegakan Hukum Pidana terhadap pelaku Illegal Drilling di Wilayah Hukum Pengadilan Negeri Muara Bulian; 2) Untuk mengetahui dan menganalisis apa saja kendala yang ditemukan penegakan Hukum Pidana Illegal Drilling di Wilayah Hukum Pengadilan Negeri Muara Bulian. Metode yang digunakan adalah tipe penelitian yuridis empiris. Hasil penelitian menunjukkan bahwa 1) Dalam penegakan hukum pidana terhadap pelaku illegal drilling di wilayah hukum Pengadilan Negeri Muara Bulian masih terdapat kendala dan tidak dapat berjalan dengan sempurna karena masih terdapat kelemahan dalam faktor-faktor yang mempengaruhi penegakan hukum; 2) Kendala-kendala dalam tindak pidana penambangan minyak ilegal (illegal drilling) di Kabupaten Batanghari, hal ini disebabkan oleh kurangnya kesadaran hukum warga masyarakat, terhadap perbuatan penambangan minyak ilegal (illegal drilling), sulitnya untuk membuktikan tindak pidana karena kurang barang bukti atau tidak ada barang bukti dan jumlah aparat penyidik tidak sesuai dengan jumlah kasus yang terjadi serta dikarenakan luasnya wilayah hukum Kabupaten Batanghari yang menjadikan sulitnya menegakkan hukum di wilayah hukum tersebut.

Abstract

This article aims to know the comparison between two laws in Indonesia that use Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga and Malaysia which uses the Kanun Keseksaan Malaysia (Akta 574) and Akta Keganasan Rumah Tangga 1994 (Akta 521). This type of research is normative. The results of this study are the arrangements and sanctions for physical violence in households in Indonesia and Malaysia have similarities and differences. Conclusion: In the Undang-Undang PKDRT and Kanun Keseksaan Malaysia (Akta 574) and Akta Keganasan Rumah Tangga 1994 (Akta 521) have similarities which include the concept of physical violence, classification of victims, formulation of criminal sanctions and patterns of imprisonment. Meanwhile, the differences include the number of articles that regulate, the classification of serious injuries, types of crimes, the formulation system of crimes, the amount of criminal threats and types of offenses. Suggestion: hopefully there will be a criminal law reform against the PKDRT Law related to the classification of serious injuries, the criminal formulation system and the amount of the threat of imprisonment. ABSTRAK Penelitian ini bertujuan untuk mengetahui perbandingan antara dua hukum di Indonesia yang menggunakan Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga dan Malaysia yang menggunakan Kanun Keseksaan Malaysia (Akta 574) dan Akta Keganasan Rumah Tangga 1994 (Akta 521). Tipe Penelitian ini adalah normatif. Hasil Penelitian ini adalah pengaturan dan sanksi kekerasan fisik dalam rumah tangga di Indonesia dan Malaysia memiliki persamaan dan perbedaan. Kesimpulan: Dalam Undang-Undang PKDRT dan Kanun Keseksaan Malaysia (Akta 574) serta Akta Keganasan Rumah Tangga 1994 (Akta 521) memiliki persamaan yang meliputi konsep kekerasan fisik, klasifikasi korban, rumusan sanksi pidana dan pola ancaman pidana penjara. Sedangkan perbedaannya meliputi jumlah Pasal yang mengatur, klasifikasi luka berat, jenis pidana, sistem perumusan pidana, besar ancaman pidana dan jenis delik. Saran: diharapkan adanya pembaharuan hukum pidana terhadap Undang-Undang PKDRT terkait klasifikasi luka berat, sistem perumusan pidana dan besar ancaman pidana penjara.
