Haryono No. 169 Malang e-mail: devifebriyanti@student.ub.ac.id ABSTRAK Penelitian ini bertujuan menganalisis perspektif hakim mediator Pengadilan Agama dan Pengadilan Negeri dalam melakukan mediasi pada perkara perceraian sebelum dan selama Pandemi Covid-19 untuk menekan kasus perceraian di Kabupaten Sukoharjo dan apa saja kendala yang dihadapi oleh hakim mediator dalam melakukan mediasi perkara perceraian di Pengadilan Agama Sukoharjo dan Pengadilan Negeri Sukoharjo di masa Pandemi Covid-19. Penulisan skripsi ini merupakan penelitian hukum empiris, dengan pendekatan yuridis sosiologis, yang bersifat deskriptif yaitu penelitian yang mengidentifikasi hukum dan melihat bagaimana hukum dan efektifitas hukum yang bekerja di masyarakat. Adapun hasil penelitian menjelaskan bahwa hakim mediator Pengadilan Negeri berpandangan mediasi perceraian yang dilakukan hanya memenuhi syarat legalitas formal karena pasangan yang datang telah memiliki tekat yang bulat sejak mereka gagal melakukan mediasi yang dilaksanakan oleh gereja. Sedangkan hakim Pengadilan Agama berpendapat bahwa mediasi dilakukan demi kesepakatan perdamaian dan jika tidak menemukan titik temu maka kaukus dapat dilakukan. Adapun, kendala yang dihadapi hakim mediator Pengadilan Agama dan Pengadilan Negeri dalam melakukan mediasi perceraian sebelum pandemi Covid-19, yakni di beberapa kasus kehadiran para pihak sangat sulit untuk secara bersamaan melakukan proses mediasi, sehingga untuk menemukan titik temu antara para pihak sangat sulit jika tidak ada kehadiran para pihak secara bersamaan alasan demikian bertambah sejak adanya Pandemi Covid-19 . Kendala dari faktor internal, bagi Pengadilan Agama Sukoharjo masih kurangnya jumlah hakim mediator serta belum adanya kerjasama dengan pihak dari luar lainnya, dan bagi Pengadilan Negeri belum melakukan mediasi secara optimal. Kata Kunci: mediasi, perceraian, pandemi ABSTRACT This research aims to study the correlation between the Covid-19 pandemic and the rising trend of divorce and the perspective of mediating judges of Religious Court and District Court in the mediation process of divorce before and during the pandemic to help reduce the number of divorce cases and to find out the impeding factors faced by mediating judges of both courts in the case of divorce mediation during the pandemic. This research employed normative-juridical methods and socio-juridical approaches. Primary and secondary data were used, and the primary data were obtained from interviews based on purposive sampling from the literature. The research results reveal that the mediating judges of the District Court argued that the mediation performed to tackle the divorce was only to fulfill the procedural legality since the spouses concerned were quite determined since they failed in the mediation facilitated by the church. On the other hand, the Religious Court argued that the mediation was given for the sake of peace, and if it fails to reach an agreement, a caucus can be taken into account. Prior to the outbreak, mediation was not as easy as it is these days, where physical meetings between the parties concerned in divorce cases were almost impossible to perform, and the absence of their physical presence hindered the resolution of the cases, and this problem grew. The internal problem faced by the Religious Court of Sukoharjo was that there was a lack of mediating judges and the absence of collaborations with external parties. Moreover, the District Court did not optimally carry out the mediation. Keywords: divorce, mediation, pandemic
