Abstract

Harmonisasi hukum menjadi bagian penting hukum Indonesia terutama berkaitan dengan perlindungan pekerja yang berada dalam suatu perusahaan pailit, bagian ini menjadi penting karena ketidakharmonisan yang terjadi antara undang-undang menyebabkan hilangnya hak-hak yang seharusnya diterima pekerja, dasar hak ini dilekatkan kepada pekerja yang telah melaksanakan kewajibannya demi kepentingan perusahaan, terutama bila keadilan dalam perspektif Pancasila Sila ke 5 menjadi rujukan dalam perlindungan hukum itu. Pendekatan normatif yuridis merupakan metode yang digunakan dalam tulisan ini dengan mengaitkan antara Pancasila sebagai staatfundamentalnorm dengan hak pekerja sebagai kewajiban perusahaan pailit untuk melakukan pemenuhan atas hak tersebut. Perlindungan hukum bagi pekerja melalui mekanisme hukum kepailitan yang tidak harmonis antara peraturan perundang-undangan terutama Pasal 39 Undang-Undang No.37 Tahun 2004 Tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang dengan Pasal 95 ayat (4) Undang-Undang No.13 Tahun 2003 Tentang Ketenagakerjaan, menjadi jauh dari tujuan pemenuhan keadilan bila dipandang dan dilekatkan pada Pancasila Sila ke 5. Cara untuk menjembatani terciptanya perlindungan hukum bagi pekerja adalah dengan memahami konteks keadilan yang berada di dalam Pancasila Sila ke 5, dengan komprehensif terutama terkait dengan penggunaan undang-undang dalam ruang lingkup kepailitan.Kata Kunci : Pancasila, perlindungan hukum, pekerja, perusahaan, pailit.

Abstract

Success in a learning process cannot be separated from the good role and the learning methods used. Educators need to create a pleasant atmosphere so that learning goes as expected. The purpose of this study was to evaluate the differences between inquiry learning methods and directly on student handball learning outcomes at Public Senior High School 8 Semarang, evaluating the differences between high and low levels of intelligence quotient on student handball learning outcomes at Public Senior High School 8 Semarang, and evaluating the interaction between learning methods and intelligence quotient on student handball learning outcomes at Public Senior High School 8 Semarang. This study used an experimental method with a 2x2 factorial design. The subjects in this study were students of class X at Public Senior High School 8 Semarang. This study uses to test and measurement techniques. The instruments used the intelligence quotient test and handball basic ability test. The data analysis technique used two-way Anova statistics, and hypothesis testing with the calculation of the F-test at a significant level of 5%. The results of the study were the distribution of handball learning outcomes of class X students at Public Senior High School 8 Semarang with the inquiry learning method in groups with high intelligence quotient amounting to 73.3% categorized as good, 20% categorized as good enough, and equal to 6.7% categorized as very good. The distribution of handball learning outcomes of class X students at Public Senior High School 8 Semarang with the inquiry learning method in groups with low intelligence quotient is 73.3% categorized as good, and 13.3% categorized as very good and quite good.

Abstract

The discovery of the law is according Sudikno Mertokusumo , typically defined as the process of law-making by a judge or other officer law officer who was given the task of implementing the law or apply the common law rule against concrete legal events . But especially those in the criminal case judges in Indonesia are faced with a dilemma where on the one hand he had to perform legal discovery , but on the other hand he was blasted by a tight principle of legality that does not allow any punishment unless there is a law that regulates the actions that can be convicted . The purpose of this study , to determine the legal discovery in criminal cases based on Law No. 48 Year 2009 on Judicial Power , and to determine the barriers to discovery of the law by a judge in a criminal case based on Law No. 48 Year 2009 concerning Judicial Authority .This type of research is a normative legal research or can be referred to as the doctrinal legal research . The discovery of the law in criminal cases based on Law No. 48 Year 2009 concerning Judicial Authority , still has some issues ,one of which is the discovery of this law does not have a standard or special rules , such as law , legal discovery despite having some of the methods proposed by the legal experts , and the judges , but for its use is left entirely to the judge overseeing the case , the lack of legal discovery in criminal cases is still espoused understand the principle of legality set forth in Article 1 paragraph (1) Indonesian Criminal Code Plus after the Constitutional Court ruled in its decision No. 003 / PUU - IV / 2006 on July 25, 2006 which has been decided to remove the use tort understand the material in a positive sense . Efforts to overcome the weaknesses or shortcomings of this is to make a clear and unequivocal rule of the ability of judges to perform legal discovery , especially in criminal cases in Indonesia , and there are clear rules regarding the methods of the invention legitimate law and recognized by the laws of Indonesia . Soon the passing of the Bill Indonesian Criminal Code , to make it clear that in addition to the written law / legislation , there is also customary law recognized certain in the Draft Bill and the judges do not hesitate to dig , and find a sense of justice that live in society .Keywords : The Discovery of Law - Judge – Phedofilia- Criminal Case

Abstract

Garbage generated every day can be a problem because some types of waste are difficult to decompose so they can pollute the environment. Waste that can potentially be recycled and has a selling value is inorganic waste, especially cardboard, metal, paper, glass, plastic, rubber and other waste such as product packaging. Various types of waste can be classified using machine learning models. The machine learning model used for classification of waste systems is a model with the Convolutional Neural Network (CNN) method. The selection of the CNN architecture takes into account the required accuracy and computational costs. This study aims to determine the best architecture, optimizer, and learning rate in the waste classification system. The model designed using the MobileNetV2 architecture with the SGD optimizer and a learning rate of 0.1 has an accuracy of 86.07% and the model designed using the Xception architecture with the Adam optimizer and a learning rate of 0.001 has an accuracy of 87.81%.
