Abstract

The relations between religion and state in Islamic thought gives the principle of forming a state such as khalīfah, dawlah, or hukūmah. There are three paradigms of states in Islamic, they are; integrative paradigm, symbiotic paradigm, and secularistic paradigm. In this case, Islam emphasizes democratic values about truth and justice. This democracy can create a good political state. Therefore, this democracy concept is really prefereable in Islam, because Islam is the religion which sets out the truth values and justice. The relation of religion and human right in Islam thought has been determined, because both of these aspects have been built in by all mankind since they were born. Therefore, Islam always emphasizes about the importance of human rights that must be highly appreciated in every states.

Abstract

This paper discusses the reform of Islamic law in the Islamic Law Compilation. The main sources of Islamic law are the Quran and Sunnah shall be applied to the human race. Therefore, Islamic law must be able to respond to development and change that occur in peoples lives. Reform of Islamic law as the search for relevance to the development of contemporary Islamic law is not a stand-alone effort, but is influenced by internal factors and external factors. One Islamic law in Indonesia in the form of the regulation that has become positive law is Islamic Law Compilation. Several articles in the Islamic Law Compilation is a form of Islamic law reform. Whether it relates to marriage or about donation such grants could be a legacy. There are many other clauses which are part of the reform of Islamic law in the Islamic law compilation.

Abstract

Abstract: Court is a judicial institution, which has the authority to settle cases between the parties. In carrying out these duties and authorities, this institution adheres to the simple, quick, and low cost principles as mandated in the judicial power law. The application of simple and quick principles in terms of making lawsuits or petitions is as practiced in a Religious Court of Manado. One of the elements that helps is the existence of Legal Aid Post (POSBAKUM) based in the Religious Court of Manado. As for the settlement of cases, the application of the principle has not been implemented properly. This is because the parties are less seriously coming at the trial that has been determined and the judges often postpone the hearing by several argumentations. The cost of litigation in a Religious Court of Manado is determined based on the radius or distance of the domiciled party territory. If the Plaintiff is incompetent and has a poor card, it may incur a court fee waiver. Keywords: Application, principle, case, Religious Court Abstrak: Pengadilan merupakan lembaga yudikatif yang memiliki kewenangan menyelesaikan perkara antar para pihak. Dalam menjalankan tugas dan kewenangan tersebut, lembaga ini menganut asas sederhana, cepat dan biaya ringan sebagaimana diamanatkan dalam undang-undang kekuasaan kehakiman. Penerapan asas sederhana dan cepat dalam hal pembuatan gugatan ataupun permohonan di Pengadilan Agama yang diteliti yaitu Pengadilan Agama Manado dapat dilaksanakan dengan baik. Salah satu unsur yang membantu adalah adanya Pos Bantuan Hukum (POSBAKUM) yang berkantor di Pengadilan Agama Manado. Adapun dalam hal penyelesaian perkara, penerapan asas tersebut belum dilaksanakan dengan baik. Hal ini disebabkan karena para pihak kurang bersungguh-sungguh hadir pada persidangan yang telah ditentukan dan majelis hakim sering menunda sidang dengan alasan dinas luar atau cuti. Adapun biaya berperkara di Pengadilan Agama Manado ditentukan berdasarkan radius atau jarak wilayah pihak berdomisili. Jika Penggugat termasuk masyarakat tidak mampu dan memiliki kartu miskin, maka dapat dikenakan pembebasan biaya perkara. Kata Kunci: Penerapan, asas, perkara, Pengadilan Agama

Abstract

The addition of zeolite into the mix culture of nitrifying bacteria N-Sw was investigated in order to improve the nitrification activity. In this experiment, the ammonium conversion was investigated by zeolite as a sole agent and also mixed with nitrifying culture N-Sw.The mix culture of nitrifying bacteria N-Sw was developed from the sludge of wastewater treatment of palm oil industry, which acclimated by ammonium sulfate for about one year. The result show that the nitrification efficiency on the treatment using nitrifying culture N-Sw was 30.76%, the ammonium elimination rate was 7.46 mg N-NH /L/hour.The addition of 10 g/l zeolite, increase both the nitrification efficiency (64.58%), and the ammonium elimination rate (14.0 mg N-NH /L/hour).The nitrification efficiency increased to be 100% on the second and third day operation, and the ammonium elimination rate was increased to be 22.4–22.9 mg N-NH /L/hour. From this experiment indicated that the role of zeolite on the improving the nitrification activity was as an absorbent of ammonium.

Abstract

Abstract: Principles of justice in both of al-Qur'an and al-hadith mean: equality (al-musâwâh), honesty (al-shidq), and purity (al-ikhlâsh). Islam is a religion that upholds the value of justice. Even, justice is the main character of the Prophet Muhammad (Peace be Upon Him)  and Muslims. However, Islamic criminal law, which contains of those three values, has many problem to be criticized particularly on some applications such as the punishment of qishāsh, the practice of polygamy. They are considered not to reflect the value of justice. The main problem of this research is the contextualization of theological justice in the law of qishash and polygamy, using a normative theological approach. The conclusions are that the values of justice which found in the application of the punishment of qishāsh and the practice of polygamy contain wisdom and benefit for mankind. Keywords: Theology, justice, qishash, polygamy.   Abstrak: Prinsip keadilan dalam al-Qur’an dan hadis meliputi makna antara lain: kesetaraan (al-musâwâh), kejujuran (al-shidq), dan kemurnian (al-ikhlâsh). Islam adalah ajaran yang menjunjung tinggi nilai keadilan, bahkan sisi keadilan merupakan karakter Rasulullah saw dan umat Islam. Namun nilai keadilan tersebut dikritisi pada beberapa penerapan hukum pidana Islam, seperti hukuman qishâsh, dan pada praktik poligami dalam perkawinan, yang dianggap tidak mencerminkan nilai keadilan. Pokok permasalahan penelitian ini adalah kontekstualisasi teologi keadilan dalam hukum  qishâsh  dan poligami, dengan menggunakan pendekatan teologi normatif. Kesimpulannya bahwa nilai-nilai keadilan terdapat pada penerapan hukuman qishâsh dan praktik poligami dalam perkawinan, dan mengandung hikmah bagi kemaslahatan umat manusia. Kata Kunci: Teologi, keadilan, qishâsh, poligami.

Abstract

 Abstrak: Itsbat nikah merupakan sebuah proses penetapan pengesahan pernikahan yang telah dilangsungkan berdasarkan syariat Islam, namun tidak dicatat di KUA. Tujuan dari itsbat nikah adalah untuk mendapatkan akta nikah sebagai bukti sahnya perkawinan sesuai dengan peraturan perundang-undangan yang berlaku di Indonesia, sebagaimana diatur dalam pasal 2 ayat (1) dan (2) UU No. 1 Tahun 1974 dan pasal 7 ayat (1), (2), dan (3) Kompilasi Hukum Islam. Prosedur pengajuan itsbat nikah di Pengadilan Agama Manado setelah berlakunya Undang-Undang Nomor 1 Tahun 1974 yaitu, melakukan pendaftaran ke Pengadilan Agama Manado, membayar panjar biaya perkara, menunggu panggilan sidang dari pengadilan, serta menghadiri persidangan dan putusan pengadilan. Ada beberapa yang menjadi alasan pengajuan itsbat nikah di Pengadilan Agama Manado, antara lain; (1) kehilangan akta nikah, (2) pengurusan perceraian, (3) Perkawinan yang dilangsungkan sebelum berlakunya UU No. 1 Tahun 1974, dan (4) perkawinan yang dilakukan oleh mereka yang tidak mempunyai halangan perkawinan menurut Undang-Undang No. 1 Tahun 1974. Perkara itsbat nikah (pengesahan nikah) bisa diajukan secara voluntair (permohonan) dan diajukan secara kontentius (gugatan) ke pengadilan agama. Dasar pertimbangan hakim dalam memberikan penetapan itsbat nikah di Pengadilan Agama Manado diantaranya yaitu: 1) Legal standing (kedudukan hukum) pemohon untuk mengajukan perkara itsbat nikah di pengadilan agama berdasarkan ketentuan pasal 7 ayat (4) KHI, 2) Posita (fakta kejadian dan fakta hukum), 3) Keterangan saksi dan bukti di persidangan, serta 4) Alasan-alasan mengajukan itsbat nikah. Kata Kunci: Perkawinan, Itsbat Nikah, Voluntair, Pengadilan Agama Abstract: Itsbat of marriage is an endorsement of the assignment process, which has been held on the basis of Islamic jurisprudence, but not recorded at KUA. The goal of itsbat is to get a marriage license deed as evidence of legitimate marriage in accordance with the legislation in force in Indonesia, as provided for in article 2 paragraph (1) and (2) of law No. 1 of the year 1974 and article 7 paragraph (1), (2) and (3) Compilation Of Islamic Law. Itsbat procedure for making marriage a religious Court in Manado, after the enactment of law number 1 year of 1974, namely, registration to court Religious bias, pay fees, waiting for the call from the Court of session, as well as attend the trial and the verdict of the Court. There are some who became the reason of filing itsbat of marriage in a religious Court in Manado, among others; (1) the lost deed, (2) management, (3) the marriage took place before the enactment of law No. 1 year 1974, and (4) a marriage conducted by those who have no impediments to marriage according to the law No. 1 year 1974. Itsbat matter of marriage (endorsement of marriage) may be filed in voluntair (the petition) and filed in kontentius (the suit) to the Court. Basic consideration of judges in giving the setting of itsbat marriage in a religious Court in Manado of which namely: 1) Legal standing (legal position) the applicant to litigate itsbat marriage in a religious court based on the provisions of article 7 paragraph (4) KHI, 2) Posita (facts and legal facts of the incident), 3) witnesses and evidence in the trial, as well as 4) the reasons for filing the itsbat marriage.

Abstract

Abstract: The process of resolving marital seizure applications on joint assets in a divorce case at the Religious Court is carried out with stages starting from the application of the marital seizure to objects, both movable and immovable goods. It is highly dependent on concrete and demonstrable reasons regarding seizure placement in trial face. If the seizure request can be granted by the panel of judges according to strong evidence and proven in the trial, the panel of judges can conduct marital seizure by ordering the registrar to be assisted by the bailiff to confiscate movable or immovable items to be recorded. Marital seizure contained in the object of the dispute in the contents of the claim with the local government present. Whereas judicial legal considerations regarding marital seizure applications, the panel of judges, firstly looks at the facts from the trial. If the seizure is granted then enough reason for seizure applicants to be placed marital seizure. And if the seizure application is rejected and there is no enough reason to place the marital seizure by the panel of judges because there was no concern, the defendant will move or transfer the object of the dispute to another person who was carried out through a hearing outside the Religious Court which is also called the local hearing. Keywords: Marital Seizure, Joint Property, Case, Divorce Abstrak: Proses penyelesaian permohonan sita marital terhadap harta bersama dalam perkara perceraian di Pengadilan Agama dilakukan dengan tahapan-tahapan mulai dari permohonan peletakan sita marital terhadap objek, baik barang bergerak maupun tidak bergerak, sangat bergantung pada  alasan yang kongkrit dan dapat dibuktikan mengenai peletakan sita di muka persidangan, apabila  permohonan sita dapat dikabulkan oleh majelis hakim sesuai bukti yang kuat dan dibuktikan dalam persidangan maka majelis hakim dapat melakukan sita marital dengan memerintahkan Panitera yang dibantu oleh jurusita untuk melakukan sita baik barang bergerak atau tidak bergerak untuk dicatat, Selanjutnya panitera membuat berita acara sita marital yang terdapat dalam objek sengketa dalam isi gugatan dengan dihadirkan pemerintah setempat. Sedangkan pertimbangan hukum hakim mengenai permohonan sita marital, majelis hakim terlebih dahulu melihat pada fakta-fakta yang lahir dalam persidangan, apabila sita dikabulkan maka cukup alasannya bagi pemohon sita untuk diletakkan sita marital dan apabila permohonan sita ditolak maka tidak cukup alasan untuk diadakan peletakkan sita marital oleh majelis hakim karena tidak ditemukan kekhawatiran tergugat akan memindahkan atau mengalihkan objek sengketa kepada orang lain yang dilakukan melalui sidang di luar gedung Pengadilan Agama yang dinamakan dengan sidang pemeriksaan setempat. Abstract

Tulisan ini mengkaji tentang relasi agama dan negara perspektif pemikiran Islam. Penelitian ini bertujuan untuk mendeskripsikan bagaimana relasi antara agama dan negara dalam pandangan Islam. Metode yang digunakan dalam mendapatkan data adalah metode deskriptif melalui studi kepustakaan. Hasil kajian menunjukkan bahwa diantara tokoh atau pemikir muslim seperti Nurcholish Madjid dan Abdur Rahman Wahid bersepakat bahwa terdapat relasi yang konstruktif antara dua hal yaitu negara dan agama yang oleh kalangan revivalis memisahkannya. Beberapa indikatornya adalah: (1) Islam memberi prinsip-prinsip terbentuknya suatu negara dengan adanya konsep khalīfah, dawlah, atau hukūmah, (2) Islam menekankan pada nilai-nilai demokrasi yakni kebenaran dan keadilan, dan (3) Islam menjunjung tinggi Hak Azasi Manusia (HAM) dengan menetapkan bahwa hak dasar yang dibawa manusia sejak lahir adalah hak kemerdekaan beragama. Karena itu, Islam secara esensial menekankan pentingnya hak asasi manusia untuk ditegakkan dalam sebuah negara, karena hak asasi manusia itu adalah hak yang tidak boleh diganggu dan dirampas dari orang yang memiliki hak tersebut.

Abstract

This paper examines religious and state relations of Islamic thought perspective. This study aims to describe how the relationship between religion and state in the view of Islam. The method used in obtaining data is descriptive method through literature study. The results of the study show that among Muslim figures or thinkers such as Nurcholish Madjid and Abdur Rahman Wahid agree that there is a constructive relationship between state and religion which by revivalists separates it. Some of the indicators are: (1) Islam gives the principles of the formation of a state with the concept of khalīfah ,dawlah, or hukūmah, (2) Islam emphasizes the democratic values of truth and justice, and (3) Islam upholds Human Rights by stating that the basic rights that human beings bring ever since they are born are the right of religious freedom. Therefore, Islam essentially emphasizes the importance of human rights to be upheld in a state, because human rights are rights that should not be disturbed and deprived from the person who has the right.
