Abstract

The study aims at knowing the judicial power in legal reform perspective. In principle the rule of law, all public policy and election of public officials must be based on the rule of law. To realize the principle of supremacy of law, then one major factor is the presence of the judiciary is the embodiment of judicial power is independent, and authoritative. Law enforcement can not be regarded merely as a process of applying the law, however, has a broader dimension especially with regard to the dimensions of human behavior. The legal problems that will always stand out is the problem of "law in action" and not "law in the books". The judge is not only a spokesman for the law, but even further is the spokesman for law and justice. This means that the judiciary function as an institution that is able to translate the law in concrete when dealing with written legal norms/laws, and even be able to find the law, when a legal vacuum. In this perspective the judiciary can function as a locomotive of legal reform, if the judiciary can run freely and independently, and adhering to the principles of justice and expediency.Key words: Judiciary, Legal reform, and independent

Abstract

AbstractPower is a depiction of the right to do and not to act which gives birth to certain powers which have the dimension of unity between rights and obligations (rechten en plichten). In relation to the process of governance, rights contain the power to govern themselves (Zelfregelen) and manage themselves (Zelfbesturen), while obligations horizontally mean the power to administer the government properly. Thus, the substance of authority in government is the ability to take legal actions or actions of government. Therefore, every power and authority inherent in every state organizer, the moral and ethical foundation as the basis for the integrity of state administrators must be the main factor in assessing and testing its performance which is realized in the form of respectable policies in the framework of increasing dignity and value fair and civilized humanity for all Indonesian people. Thus, every state organizer must have a strong ethical foundation so that its policy products do not conflict with the constitutional mandate. AbstrakKekuasaan merupakan penggambaran tentang hak untuk berbuat dan tidak berbuat yang melahirkan  wewenang tertentu yang berdimensi kesatuan antara hak dan kewajiban (rechten en plichten). Dalam kaitan dengan proses penyelenggaraan pemerintahan, hak mengandung pengertian kekuasaan untuk mengatur sendiri (Zelfregelen) dan mengelola sendiri (Zelfbesturen), sedangkan kewajiban secara horizontal berarti kekuasaan untuk menyelanggarakan pemerintahan sebagaimana mestinya. Dengan demikian, substansi wewenang dalam pemerintahan adalah kemampuan untuk melakukan tindakan atau perbuatan hukum pemerintahan. Oleh karena itu, setiap kekuasaan dan kewenangan yang melekat pada setiap penyelenggara negara, maka landasan moral dan etika sebagai basis integritas penyelenggara negara harus menjadi faktor utama dalam menilai dan menguji kinerjanya yang diwujudkan dalam bentuk kebijakan yang bernilai terhormat dalam kerangka meningkatkan harkat dan martabat serta nilai kemanusiaan yang adil dan beradab bagi seluruh rakyat Indonesia.  Dengan demikian, setiap penyelenggara negara harus memiliki landasan etika yang kuat agar produk-produk kebijakannya tidak bertentangan dengan amanat konstitusi.

Abstract

The election of regional head has a strategic position to building democracy in transition. In order that the election of regional head can creating a dignified democracy, the implementation of its should be based on the principle of the general election i.e: independent, fair, equitable, rule of law; the orderly election, transparency, proportionality; professionalism, accountability, efficiency, and  effectiveness.

Abstract

Salah satu isu yang menjadi konteks empiris pada saat amandemen UUD 1945, adalah pinjaman luar negeri Indonesia pada masa Orde Baru. Hal ini mendorong perubahan Pasal 11 UUD 1945, yang pada pokoknya menentukan sebuah keharusan bagi Presiden untuk mendapatkan persetujuan DPR dalam membuat perjanjian pinjaman luar negeri. Akan tetapi dalam pengaturan kemudian, persetujuan DPR sebagai bentuk pembatasan kekuasaan Presiden di bidang diplomatik ini, justru direduksi menjadi persetujuan yang terbatas diberikan terhadap Undang-Undang APBN. Penelitian ini dimaksudkan untuk mengurai berbagai permasalahan seputar persetujuan DPR sebagai bentuk pembatasan kekuasaan Presiden, dan pengaturannya dalam Peraturan Perundang-Undangan Pasca amandemen UUD 1945.

Abstract

The essence of the organization of education is the intellectual counterpart towardschange. The value or quality of the desired change depends on the extent to which theactors of the change are directly involved and have the sincerity to change. Becausethe task of education is to develop the human nature to become a superior humanbeing, and able to create and develop a culture of high value and useful, so in itself theactors in the education process must have strategies and policies in building asupportive environment for the development of educational goals. In this perspective,every institution of education providers should be able to provide a direction ofeducational development that is conducive to the development of educational activities,including: the development of teaching-learning orientation, improvement of learningfacilities, the development of study networks, and self-discipline training.

Abstract

Materi muatan hukum selayaknya mampu menangkap aspirasi masyarakat yang tumbuh dan berkembang bukan hanya yang bersifat kekinian, melainkan sebagai acuan dalam mengan Ɵ sipasi perkembangan sosial, ekonomi, budaya dan poli Ɵ k di masa depan. Norma hukum pada dasarnya inheren dengan nilai-nilai yang diyakini oleh masyarakat, tetapi daya kekuatan keberlakuan hukum, Ɵ dak dapat melepaskan diri dari kelembagaan kekuasaan, sehingga hukum, masyarakat dan kekuasaan merupakan unsur dari suatu tatanan masyarakat. Oleh karena itu, Hukum Ɵ dak sekedar dipahami sebagai norma yang menjamin kepasa Ɵ an dan keadilan tetapi juga harus dilihat dari perspek Ɵ f kemanfaatan. Oleh karena itu, maka pembentukan hukum dalam perspek Ɵ f pembaruan hukum harus difokuskan pada dua hal yaitu, sistem hukum dan budaya hukum. Tulisan ini akan membahas bagaimana idealisasi peraturan perundang-undangan; bagaimana fungsi peraturan perundang-undangan dalam pembangunan hukum; dan bagaimana pendekatan metodologis terhadap pembentukan hukum. Dari berbagai pembahasan tersebut disimpulkan bahwa pembentukan hukum dalam perspek Ɵ f pembaharuan hukum, di samping harus memperha Ɵ kan aspek metodologis, juga harus merujuk dan meletakkan norma hukum dalam kesatuan harmoni ver Ɵ kal dengan aspek teologis, ontologis, posi Ɵ vis Ɵ k dan aspek fungsional dari suatu norma hukum.The substance of the law should be able to capture the aspira Ɵ ons of the people who grow and develop not only be present, but as a reference in an Ɵ cipa Ɵ on of the social, economic, cultural and poli Ɵ cal future. The rule of law is essen Ɵ ally inherent to the values that are believed by the public, but the validity of the power of the law, not to break away from the ins Ɵ tu Ɵ onal power, so the law, society and power is an element of a society. Therefore, the law does not merely understood as a norm that ensures certainty and jus Ɵ ce but also to be seen from the perspec Ɵ ve of expediency. Therefore, the legal establishment in the perspec Ɵ ve of legal reform should be focused on two things, namely, the legal system and legal culture. This paper will discuss how the idealiza Ɵ on of laws, how the laws func Ɵ on in the development of the law, and how the methodological approach to the legal establishment. It was concluded that the forma Ɵ on of the law in the perspec Ɵ ve of legal reform, in addi Ɵ on must pay a Ʃ en Ɵ on to methodological aspects, should also refer to and put the rule of law in the unity of ver Ɵ cal harmony with aspects of the theological, ontological, posi Ɵ vist and func Ɵ onal aspects of the rule of law.

Abstract

Article 18 paragraph (2) and paragraph (5) of the 1945 Constitution stipulates that the Regional Government is authorized to regulate and manage its own government affairs according to the principles of autonomy and co-administration and is granted the widest possible autonomy. The granting of the widest possible autonomy to regions is directed at accelerating the realization of community welfare through service improvement, empowerment, and community participation. Regional formation is basically intended to improve public services in order to accelerate the realization of community welfare as well as as a means of political education at the local level. For this reason, the formation of a region must take into account various factors such as economic capacity, regional potential, area, population, and considerations from socio-political, socio-cultural, defense and security aspects, as well as other considerations and conditions that enable the region to organize and realize the objectives of the establishment. By using descriptive analytical research method the results of this research are decentralization is the delegation of government power from the central government to regions to manage their own households, or regions are given autonomy to become autonomous regions. Decentralization is intended to give authority from the state government to local governments to regulate and manage certain affairs as their own household affairs. Therefore, the birth of Act No. 23 of 2014 concerning Regional Government, especially the essence of decentralization, is basically in the framework of accelerating the distribution of community welfare, especially in the regions.
