Abstract

The formulation of article 27 paragraph (1) letter b of Law Governing the election and article 27 paragraph (3) was considered discriminatory because it prohibits members of the general election commission to resign before the end of  his term. If resigned for reasons that cannot be accepted and being dishonorably  are required to reimburse the honor as much as 2 (two) times the accepted. That provision was filed judicial review to the Constitutional Court. The Constitutional Court states the phrase.... with an acceptable reason’ in article 27 paragraph (1) letter b and article 27 paragraph (3) of Law No. 15 of 2011 is contrary to the Constitution and has no binding legal force. The Constitutional Court also assess interpretation ‘acceptable reason’ it has narrowed  the  freedom  of  a  person  to  get a job and a better income in order to be better able to meet the right to life, sustaining live and  life.

Abstract

The phenomenon of a pair-single candidate threatens delays in the implementation of simultaneous Regional Head Elections in some districts until 2017. Although the Commission extends the registration period of candidates to avoid the delay of elections simultaneously, there are still some districts that have a single candidate. The law on elections has not set the provisions definitely regarding what should be done if there is the phenomenon of a single candidate. Finally the parties who feel aggrieved the rights had filed a judicial election law to the Constitutional Court (MK) to find solutions to these issues. In its decision, the Court considered that the Act mandates the election as the executor of the sovereignty of the people to elect regional heads directly and democratically. Thus, the local elections should ensure the realization of the highest power in the hands of the people. In addition, the Court also considers the formulation of norms of Law No. 8 of 2015, which requires the presence of more than one pair of candidates does not provide a solution, which led to the legal vacuum. This can result in absent of holding the elections. Local elections which are only followed by a single pair of candidates, the mechanism selection is to determine whether the “Agree”  or “Disagree” with   the prospective partner. If it turns out the people’s voice is more to select “Agree” then the candidate is designated as regional head and deputy head of the selected district. Conversely, if it turns out the people’s voice is more to select “Disagree” then in such circumstances the election is postponed until the next local elections simultaneously.

Abstract

Kewenangan pengadilan dalam proses penyelesaian sengketa melalui arbitrase antara lain, putusan arbitrase harus didaftarkan di Pengadilan Negeri. Menurut Mahkamah, Penjelasan Pasal 70 Undang-Undang Nomor 30 tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa (UU AAPS) menambah norma baru dan menimbulkan ketidakpastian hukum. Pasal 70 UU AAPS tersebut sudah cukup jelas (expressis verbis), yang justru menimbulkan multi tafsir adalah penjelasan pasal tersebut sehingga menimbulkan ketidakpastian hukum yang adil. Mahkamah menyatakan bahwa, Penjelasan Pasal 70 UU AAPS bertentangan dengan Pasal 28 ayat (1) UUD 1945 dan tidak mempunyai kekuatan mengikat. Dengan adanya putusan Mahkamah Konstitusi Nomor 15/PUU-XII/2014, bagi para pihak yang tidak puas terhadap putusan arbitrase mempunyai peluang yang lebar untuk dapat pengajukan permohonan pembatalan putusan arbitrase tanpa harus dibuktikan terlebih dahulu di Pengadilan. Hak para pihak untuk mengajukan permohonan pembatalan putusan arbitrase sebagaimana diatur dalam Pasal 70 UU AAPS dapat dikesampingkan berdasarkan kesepakatan bersama para pihak. Dengan demikian putusan arbitrase yang merupakan mahkota seorang Arbiter tidak mudah “tercabik” oleh suatu kepentingan. Putusan Mahkamah Konstitusi Nomor 15/PUU-XII/2014 harus diapresiasi dan secepatnya direspon oleh pembentuk undang-undang untuk merevisi UU No. 30 Tahun 1999 terkait dengan mekanisme pembatalan putusan arbitrase setelah adanya putusan Mahkamah Konstitusi tersebut.The jurisdiction of the court in the process of resolving disputes through arbitration among other arbitral rulings shall be registered in the district court. According to the Court, the Explanation of Article 70 of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution (Act AAPS) adds new norms and creates legal uncertainty. Article 70 of the AAPS Act is quite clear (expressis verbis), the thing which leads to multiple interpretations is an explanation of the article so that this rises fair legal uncertainty. It stated that, Explanation of Article 70 of AAPS Law is contrary to Article 28 paragraph (1) of the 1945 Constitution and has no binding force. By the decision of the Constitutional CourtNumber 15/PUUXII/2014, for the parties which are not satisfied with the arbitration decision, this provides wide opportunities to pursue cancellation request of arbitral decision without having been proofed in court. The rights of the parties to apply for the cancellation of an arbitral award under Article 70 of AAPS Law may be waived by mutual agreement of the parties. Thus the arbitration award which is the crown of an arbitrator does not easily "torn apart" by an interest.Constitutional Court decision should be appreciated and quickly responded to by the legislators to revise Law No. 30, 1999 related to the cancellation mechanism arbitration decision after the decision of the Constitutional Court.

Abstract

The problem to be studied in this paper is which body has the authority to resolve election disputes after the decision of the Constitutional Court? What  are the considerations that the court overturned its own authority to resolve dispute elections? Based on the results of analysis it can be concluded that; first, based on the decision No. 97 / PUU-XI / 2013 of the Constitutional Court, it is considered that, “... the legislators are also able to determine that direct elections were not part of  the formal Election as mentioned in section 22E of the 1945 Constitution. So that the dispute of the result is determined as an additional authority of the Supreme Court .. . “The second, the most appropriate agency to handle election disputes is the Supreme Court, which then delegates to the High Court in each region. If litigants are not satisfied with the decision of the High Court, they may appeal to  the Supreme Court. Meanwhile, Law No. 1 2015 About Election of governors, regents, and mayors, was handed over to the Constitutional Court (although temporary) to resolve the election disputes. Therefore, it is immediate to establish regulations particularly the governing competent institution to resolve election disputes.
