Abstract

Supervision and Control of Alcoholic Beverages is regulated in Presidential Regulation Number 74 of 2013 concerning Control and Supervision of Alcoholic Beverages.  For the area in this case in Padang City, Control and Supervision of Alcoholic Beverages is regulated in Padang City Regional Regulation Number 8 of 2012 concerning Supervision, Control and Prohibition of Alcoholic Beverages. Based on the Regional Regulation that every circulation of alcoholic beverages must have a permit. In the case reviewed in 2 rulings, the perpetrator distributed alcoholic beverages without a distribution permit. The case has been decided by Decision Number 125/Pid.Sus/2020/PN.Pdg and Decision Number 245/Pid.Sus/2020/PN.Pdg. In the judge's decision, there is a disparity in the verdict. The problem studied is First, What is the Disparity in Criminal Verdicts Against Perpetrators of Criminal Acts of Circulation of Alcoholic Beverages Without Distribution Permits in Decisions Number 125/Pid.Sus/2020/PN.Pdg and Number 245/Pid.Sus/2020/PN.Pdg? Second, How is the judge's consideration in sentencing the perpetrators of the crime of circulating alcoholic beverages without a distribution permit in Decisions Number 125/Pid.Sus/2020/PN.Pdg and Number 245/Pid.Sus/2020/PN.Pdg? The specifics of this study are descriptive analytical. The approach used in this study is a normative juridical approach by conducting in-concreto legal research. The data used in this study are secondary data. All secondary data in the form of primary, secondary and tertiary legal materials obtained from the results of literature research / document studies are then compiled and analyzed qualitatively, and presented in qualitative descriptive form. Based on the results of the study, the discussion andanalysis concluded, First, the Criminal Disparity of Judgments Number 125/Pid.Sus/2020/PN.Pdg and  Number 245/Pid.Sus/2020/PN.Pdg is illustrated through the similarity in the indictment articles given to the defendants in both judgments and there are differences in the prison sentences imposed on each defendant. Second, the judge's consideration in sentencing the perpetrators of the crime of circulating alcoholic beverages without a distribution permit in Decisions Number 125/Pid.Sus/2020/PN.Pdg and Number 245 / Pid.Sus / 2020 / PN.Pdg includes juridical considerations, namely: relating to the elements of the article charged, witness statements, statements of the defendant evidence, and expert statements and non-juridical considerations, namely: matters related to the history and condition of the defendant.

Abstract

The certification of a land right for micro business and small is a government program which is implemented by National Land Agency (Badan Pertanahan Nasional). The program has purpose to provide certainty and legal protection for a right holder of a land and it is expected to alleviate the problems of micro business and small that do not have land right certificate. It can be committed by enhancing the access to capital of banks, so that, both of them can be more developed in order to improve people’s welfare. The findings of this study are based on two problems above. First, the issuance process of land right certificate for micro business and small in the district Sijunjung consists of pre-certification, certification, and post-certification. (1) Pre-certification of a land, is the authority of Department of Cooperatives, Industry, and Trade in the district Sijunjung. (2) Certification of a land right, is the authority of the National Land agency in the district Sijunjung. (3) Post-certification of a land right, is the authority of Department of Cooperatives, Industry, and Trade . Second, the implications of the issuance of land right certificate for both micro and small in the district Siunjung are: (1) ensuring legal certainty and legal protection for rights holders over land ownership, (2) providing the information required in performing legal acts of land affairs to related departments, (3) Resolve the land disputes, such as dispute of state administrative, civil, and criminal, (4) Land right certificate for micro and small owned by people or society can be used as collateral in banks to access the capital.

Abstract

Perkembangan pembiayaan syariah terutama Perbankan Syariah mengalami pertumbuhan yang pesat terutama setelah diundangkannya Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah. Perkembangan ini tidak hanya dalam hal overhaul tapi juga dari segi jenis usaha atau kegiatan yang ditawarkan kepada masyarakat. Kegiatan usaha Perbankan Syariah merupakan sub sistem dalam sistem perbankan syariah dan keuangan syariah telah menjadi bagian dari keseluruhan sistem dalam ajaran Islam. Oleh karena itu, Perbankan Syariah dalam menjalankan kegiatan usahanya tidak terlepas dari prinsip ekonomi syariah berdasarkan peraturan dasar yang dibangun dari Al-Qur'an dan Sunnah. Prinsip syariah dalam kegiatan bisnis Perbankan Syariah di Indonesia diwujudkan dalam Dewan Fatwa Majelis Ulama Nasional (DSN-MUI) Dewan Syariah Nasional, yang dapat dinyatakan sebagai hasil ijtihad para ulama terhadap permasalahan ekonomi berdasarkan sumber daya yang ada. Dasarnya Alquran dan Sunnah. Sehingga secara tidak langsung peraturan di DSN-MUI mengikat Lembaga Keuangan Syariah termasuk Bank Syariah untuk dipatuhi.

Abstract

Peningkatan kualitas pelayanan publik melalui penyelenggaraaan pemerintahan yang baik dan bersih, perlu didukung dengan pengelolaan keuangan yang efektif, efisien, transparan, dan akuntabel. Untuk meningkatkan efisiensi dan efektifitas penggunaan keuangan negara yang dibelanjakan melalui proses Pengadaan Barang/Jasa Pemerintah, diperlukan upaya untuk menciptakan keterbukaan, transparansi, akuntabilitas serta prinsip persaingan/kompetisi yang sehat dalam proses Pengadaan Barang/Jasa Pemerintah yang dibiayai APBN/APBD, sehingga diperoleh barang/jasa yang terjangkau dan berkualitas serta dapat dipertanggungjawabkan baik dari segi fisik, keuangan, maupun manfaatnya bagi kelancaran tugas Pemerintah dan pelayanan masyarakat. Inovasi Pemerintah untuk mewujudkan itu semua direalisasikan dengan menerbitkan Peraturan Presiden Nomor 54 Tahun 2010 tentang Pengadaan barang/jasa Pemerintah Pengadaan Barang/Jasa, yang menekankan: indikator transparansi, indikator meningkatkan persaingan usaha yang sehat, indikator memperbaiki tingkat efisiensi proses pengadaan, indikator mendukung proses monitoring dan audit, dan indikator memenuhi kebutuhan akses informasi yang real time.

Abstract

The government's effort to tackle the problem of narcotics abuse is to enact Law No. 35 of 2009 concerning Narcotics. In its development to protect addicts and victims of narcotics abuse, it no longer boils down to imprisonment sanctions, but empties into rehabilitation as stipulated in SEMA Number 4 of 2010 and SEMA Number 11 of 2011. As for rehabilitation, every addict and victim of narcotics abuse must an assessment process was carried out by the Integrated Assessment Team. The Assessment Process is the initial process where narcotics addicts and victims of narcotics abuse report to the Police and Obligatory Report Receiving Agencies (IPWL), as Satresnarkoba Polres Mentawai did which conducted four assessments during 2015 to 2017

Abstract

The offense of incitement is regulated in Article 160 and Article 161 paragraph (1) of the Criminal Code as an act whose offensive is directed to public order in which the regulation of this criminal act is intended to protect the legal interest of public order. The occurrence of an anarchist rally originated from the incitement of the suspect by inciting the masses, so that the words and sentences made by the suspect at the time of the mass rally became brutal and anarchic. Against the instigating action that resulted in anarchism, the mass of the investigator requested responsibility through the investigation process by applying the elements of the provision so that it could be qualified as a criminal act to incite others.

Abstract

Article 5 of Law No. 11 of 2008 concerning Electronic Information and Transactions states that electronic information and / or printed results from electronic information are valid evidence and have legal legal consequences. The use of digital evidence through computer forensics by investigators still encounters various problems. This research is legal research with analytical descriptive specifications. The form of print out of electronic evidence is contained in the minutes of investigation. Without going through Digital Forensics, an electronic document cannot be used as evidence because the validity of the electronic document cannot be guaranteed. In the investigation process physical evidence and digital evidence are part of a complementary investigation process. Constraints on the use of digital evidence on computer forensics are the few people who can be asked to become expert witnesses. The absence of a forensic computer laboratory at the West Sumatra Regional Police. Digital proofing is carried out by experts. Efforts are being made to overcome the obstacles in proof using digital evidence with computer forensics, among others, by using information or opinions from telematics experts who have expertise in their fields.

Abstract

Act Number 22 Year 2001 on Oil and Natural Gas regulated on prohibited and threatening acts with criminal sanctions for anyone who violates them. One of the prohibited acts is to commit criminal misuse of subsidized fuel oil (BBM). To be able to qualify such action, the police as investigator must pay attention to the elements of the provisions of Article 23 and Article 53 letter b and Article 55, so that will realize the effectiveness of law enforcement on the crime of misuse of subsidized fuel through the process of investigation with all the constraints faced in law enforcement.

Abstract

Article 75 of Law Number 35 of 2009 concerning Narcotics regulates the authority of police investigators and the National Narcotics Agency to conduct urine tests on narcotics crimes. The urine test test is intended to ensure the perpetrators consume narcotics so that they can be determined as suspects in criminal acts of narcotics abuse. The role of urine test results in an effort to apply the elements of the article and to prove a narcotics case is very important to be carried out in order to assist investigators in the inspection process and determine someone who is suspected of using narcotics as investigators of the West Sumatra Regional Police Directorate of Investigation cases of narcotics abuse committed by individual members of the National Police.

Abstract

Alat bukti petunjuk diatur dalam 188 ayat (1) KUHAP adalah perbuatan, kejadian atau keadaan yang karena persesuaiannya antara yang satu dengan yang lain dengan tindak pidana itu sendiri menandakan telah terjadi suatu tindak pidana dan siapa pelakunya. Alat bukti petunjuk memegang peranan penting dalam pembuktian kasus-kasus pembunuhan dan membantu hakim dalam pengambilan putusan di persidangan. Alat atau benda yang digunakan si pelaku untuk membunuh si korban dalam tindak pidana pembunuhan dapat dijadikan sebagai alat bukti petunjuk, penerapan alat bukti. Petunjuk oleh hakim di pengadilan dapat dilihat pada contoh kasus tindak pidana pembunuhan berencana pada putusan nomor 777/Pid.B/2016/PN.Jkt.Pst dan nomor 09/Pid.Um/2016/PN.Slk. Berdasarkan pembahasan dan analisis dapat disimpulkan bahwa: Pertama, kekuatan alat bukti petunjuk yang sangat mengikat, karena bukti yang di hadirkan oleh JPU dalam berupa rekaman CCTV dapat dijadikan sebagai perluasan dari Pasal 184 ayat (1) KUHAP sebagai “Barang Bukti” yang jika bersesuaian dengan fakta dan peristiwa pidana yang dijadikan Majelis Hakim sebagai PETUNJUK untuk memastikan peristiwa pidana. dengan adanya alat bukti petunjuk berupa CCTV sangat memberikan pengaruh yang berbeda untuk menjadi pertimbangan hakim dan sebagai dasar atas penetapan bersalahnya terdakwa dan alat bukti petunjuk dalam hal ini mempengaruhi hakim memberikan putusan akhir. Dalam Perkara Nomor 9/Pid.B/2018/PN.Slk hakim tidak mempertimbangkan alat bukti Petunjuk karena 2 (dua) alat bukti yang sah sudah di penuhi, sebagaimana pasal 183 KUHP, bukti yang di pertimbangakan hakim berupa Keterangan saksi-saksi, bukti surat dan keterangan terdakwa sebagai dasar hakim memutus perkara. Kedua, dalam kedua kasus ini majelis hakim pertama menilai setelah terpenuhi 2 (alat bukti ) yang sah, hakim memperhatikan dalam fakta persidangan hal yang memberatkan dan hal yang meringankan bagi terdakwa sebagai dasar bagi hakim memberikan pidana bagi terdakwa pembunuhan berencana.
