Abstract

On June 4 2020, the Indonesian Ulema Council (MUI) issued fatwa Number 31 of 2020 concerning "Organization of Friday and Congregational Prayers to Prevent the Transmission of the Covid-19 Outbreak. The fatwa then became the object of scientific study from various perspectives, including regarding prayers using masks and stretching the shaf when praying in congregation. However, no one has yet discussed the relevance and accuracy of the fiqh principles used in fatwas. In fact, the principles of fiqh are one of the normative dimensions of Islamic law which are directly related to practical situations. For this reason, the author feels the need to make aspects of fiqh principles in fatwa as study material - so that the discussion is carried out in a normative (doctrinal) way. After reviewing, the author concludes that the principles used in the fatwa are very relevant and accurate. Therefore, praying using a mask and stretching the shaf is a very appropriate fatwa, because this fulfills the elements of a syar'i intention, namely an endeavor to break the chain of the spread of the life-threatening Covid-19 pandemic

Abstract

The spiritual emptiness of modern humans stems from the epistemology of Western positivism, which fails to fulfill its promise to bring humans to a happy standard of living. Therefore, it is necessary to study alternative epistemology for future knowledge for the sake of human happiness itself. As a mystical science in Islam, Sufism invites people to directly absorb knowledge from the "Source of Knowledge," Allah SWT. This kind of knowledge, of course, not only gives intellectual satisfaction but also heals the spiritual emptiness of today's man. This literature study concludes the research results through an analytical description. The study's results explain that Sufi epistemology emphasizes the subject (human) to obtain correct knowledge. Subjects who want to know must first purify their souls (qalb). After the soul is pure, then, like a mirror, the soul will catch and reflect that knowledge from Allah SWT because the proper knowledge in the study of Sufism is the light of Allah. To absorb light, the mirror must first be cleaned. That way, actual knowledge or nur will bring people happiness, not just intellectual satisfaction.

Abstract

Abstract: The appointment of the Prophet Muhammad Shalla Allahu 'Alaihi Wa Sallam as an Apostle who brought revelations with legal dimensions, addressed to all humans, including unbelievers. The position of the infidels as mukallaf can be seen from the perspective of the da'wah community, not the ijabah community who accept and justify the teachings of the Apostle as believers. However, even though they are mukallaf, unbelievers are also seen as not fulfilling as legal subjects in the law of worship, because of their disbelief. Unbelief is seen as a barrier to the validity of worship. This study uses the doctrinal method. The data is obtained through the treasures of Islamic law. The results of the study found that non-Muslims are also legal subjects in muamalah matters. Islamic law can be fully enforced against infidels, because disbelief is not a barrier (mani') the fulfillment of elements as legal subjects for infidels, so that rights that are mu'amalah should not be ignored, especially in the area of application of Islamic law.Abstrak: Pengangkatan Nabi Muhammad Shalla Allahu ‘Alaihi Wa Sallam sebagai Rasul yang membawa wahyu berdimensi hukum, ditujukan kepada seluruh manusia, termasuk orang kafir. Kedudukan orang kafir sebagai mukallaf bisa dilihat dari segi ummat dakwah, bukan ummat ijabah yang menerima dan membenarkan ajaran Rasul sebagaimana orang mukmin. Namun, meskipun sebagai mukallaf, orang kafir juga dipandang tidak memenuhi sebagai subyek hukum dalam hukum ibadah, karena kekafirannya. Kekafiran dipandang sebagai penghalang dalam keabsahan ibadah. Kajian ini menggunakan metode doktrinal. Data diperoleh melalui khazanah hukum Islam. Hasil penelitian ditemukan bahwa non muslim juga sebagai subjek hukum dalam persoalan mua’amalah. Hukum Islam dapatdiberlakukan penuh terhadap orang kafir, karena kekafiran bukan sebagai penghalang (mani’) terpenuhinya unsur sebagai subyek hukum bagi orang kafir, sehingga hak-hak yang bersifat mu'amalah tidak boleh diabaikan khsusnya di wilayah pemberlakuan hukum Islam.

Abstract

Abstract: As a country with a Muslim majority population, Indonesia needs a guarantee of the halal products they will consume. This is because halal products are a necessity for every Muslim. In Law Number 33 of 2014 concerning Guarantees for Halal Products, Indonesian Muslim consumers have received guarantees for the halal products they consume. This is because the JPH Law contains rules related to halal certification, halal labels, and non-halal information. One of those responsible for halal products, of course, is the business actor as a producer. So this research is intended to determine the level of legal awareness of these business actors, namely to certify the products they distribute. This research is normative legal research; because the primary legal material is secondary data. Data collection and analysis techniques were carried out using a technical literature review. The study results show that the level of legal awareness of business actors regarding the obligation of halal-certified products is shallow. This is because business actors need to meet these four indicators, from legal knowledge, understanding, and attitudes to patterns of legal behavior.Keywords: Legal Awareness; Businessmen; Halal Product Guarantee Abstrak Sebagai negara dengan penduduk mayoritas muslim, tentunya Indonesia membutuhkan jaminan kehalalan produk yang akan mereka konsumsi. Hal ini dikarenakan produk halal merupakan kebutuhan bagi setiap muslim. Dalam Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal, konsumen muslim Indonesia telah mendapatkan jaminan kehalalan produk yang dikonsumsinya. Sebab, UU JPH memuat aturan terkait sertifikasi halal, label halal, dan informasi nonhalal. Salah satu yang bertanggungjawab atas produk halal, tentunya adalah para pelaku usaha sebagai produsen. Sehingga penelitian ini dimaksudkan untuk mengetahui tingkat kesadaran hukum pelaku usaha tersebut, yakni untuk mensertifikasi produk yang mereka edarkan. Penelitian ini adalah penelitian hukum normatif; karena bahan hukum primernya adalah data sekunder. Teknik pengumpulan dan analisis data dilakukan dengan teknis literature review. Hasil penelitian menunjukkan, bahwa tingkat kesadaran hukum para pelaku usaha terhadap kewajiban produk bersertifikat halal sangat rendah. Pasalnya, mulai dari aspek pengetahuan hukum, pemahaman hukum, sikap hukum, sampai pola prilaku hukum, para pelaku usaha tidak memenuhi keempat indikator tersebut.Kata Kunci: Kesadaran Hukum; Pelaku Usaha; Jaminan Produk Halal

Abstract

Artikel jurnal ini merupakan studi literatur (literature review). Subjek pembahasannya adalah tingkat kesadaran hukum masyarakat muslim terhadap hukum kewarisan Islam di Indonesia. Alasan penelitian dilakukan, karena seringkali Islam tidak berbanding lurus dengan kehidupan masyarakat muslim, terutama soal kewarisan. Setelah menelaah bahan-bahan hukum, yaitu hasil penelitian hukum empiris dan menggunakan teori kesadaran hukum, tahun 2018-2023, di Indonesia, yang dipulikasikan pada laman jurnal yang berputasi (terakreditasi sinta); mengikuti alur dan berpedoman pada akurasi metodologis, dapat disimpulkan bahwa tingkat kesadaran hukum masyarakat muslim terhadap hukum kewarisan Islam di Indonesia berada pada ketegori rendah. Kurangnya pengetahuan hukum masyarakat muslim terhadap hukum kewarisan Islam, berakibat pada pemahaman hukum mereka yang tidak terbentuk (utuh). Pemahaman hukum yang tidak terbentuk, menjadikan sikap masyarakat muslim memilih untuk tidak menerapkan hukum kewarisan Islam. Alhasil, masyarakat muslim masih banyak tidak mempolakan diri dalam hukum kewarisan Islam, sehingga memilih alternatif hukum lain.
